Generally speaking, everyone is capable of entering into a contract, although exceptions are made for minors, those with mental disabilities and intoxicated persons. This is because contracts must be performed “consensus ad diem”, meaning there must be mutual understanding of the terms of a contract. With the above exceptions, the individuals may be entering into a contract while not having the capacity to do so. Therefore, consensus ad diem may not exist. unenforceable contracts While there is no automatic right to cancel a contract, not every contract can be enforced by law. Contracts may be voided in the following situations: Misrepresentation Knowingly making misrepresentations or false statements to persuade a consumer to enter into a contract can make that contract voidable. This means that either party can cancel the contract if they want to. But the misrepresentation must be about a major part of the contract, not some minor detail, and the contract must be cancelled within a reasonable amount of time. For example: Pat is thinking of buying a duplex from Dale LIFE INSURANCE – EVERYBODY and renting it out. Dale tells Pat that the rent IS ACCEPTED BUT iS is enough to cover the mortgage payments. IWU Alumni, Friends Answered the Call This issue of the Triangle, the annual President’s Report, is a bit thicker than usual, and there is a reason for that. You are the reason. The last half of the magazine features our annual Honor Roll of Donors for 2003. A year ago, there were 3,300 names on the list. This year, there are 5,800. To say that alumni and friends answered the call to support Indiana Wesleyan University during the past year would be an understatement of significant proportions. We are overwhelmed and amazed, but mostly humbled and thankful, by your response. There are at least two explanations for the 75 percent increase in the number of individual donors in just one year: • Five years ago, IWU launched a $48 million capital campaign. The goal was so aggressive that even we were shaking our heads at times. But as the capital campaign draws to a close on Dec. 31, we are within reach of our goal. • In June 2002, Lilly Endowment issued a challenge to every college in Indiana. If we could raise $3.5 million—$3 million of it from alumni—Lilly would match those gifts dollar-for-dol- lar. We are well on our way to doing that by Dec. 31. The Lilly Endowment challenge was specifically designed to encourage more alumni of Indiana colleges and universities to support their alma maters.

Selected court decisions concerning the Department's regulatory programs are also included. The Department is required to publish its rules and regulations in the Federal Register and, therefore, they are not included in AGRICULTUREDECISIONS. Beginning in 1989, AGRICULTUREDECISIONSis comprised of three Parts, each of which is published every six months. Part One is organized alphabetically by statute and contains all decisions and orders other than those pertaining to the Packers and Stockyards Act and the Perishable Agricultural Commodities Act, which are contained in Parts Two and Three, respectively. The published decisions and orders may be cited by giving the volume number, page number and year, e.g., 1 Agric. Dec. 472 (1942). It is unnecessary to cite a decision's docket or decision numbers, e.g., D-578; S. 1150, and the use of such references generally indicates that the decision has not been published in AGRICULTUREDECISIONS. Consent Decisions entered subsequent to December 31, 1986, are no longer published. However, a list of the decisions is included. The decisions are on file and may be inspected upon request made to the Hearing Clerk, Office of Administrative Law Judges.

The process will only allow a carrier to hold operating authority without insurance reflected on our Licensing and Insurance database for up to three (3) days. Revocation decisions will be tied to our enforcement program which will focus on the operations of uninsured carriers. This process will further ensure that the public is adequately protected in case of a motor carrier crash. Accordingly, we are adopting the following procedure for revocation of authority; 1) The first notice will go out three (3) days after FMCSA receives notification from the insurance company that the carrier's policy will be cancelled in 30 days. This notification informs the carrier that it must provide evidence that it is in full compliance with FMCSA's insurance regulations within 30 days. 2) If the carrier has not complied with FMCSA's insurance requirements after 30 days, a final decision revoking the operating authority will be issued.
