Dear Valerie, apologies for the delay! This story has been going back and forth for months now… What we have been able to find out so far: 1. The tea for which you had submitted the non compliant label, had been sold to the US market in 2013, when ZJ Tea Group was still under IMO certification. As you probably know, IMO gave up their activities in China, and most of the clients moved to CERES. 2. ZJ Tea Group says they never sold tea with this packaging. In the past (2013), they used to sell some tea with this labeling:

This is of course not compliant either. What is displayed here (instead of "certified organic by…"), was the IMO certificate number ("Certificate number 110834‐I.V.‐NOP"). 3. ZJ Tea Group suspects that the tea with the packaging displayed in your letter, might have been sold to the US through a Chinese export company called Wenzhou Snow. ZJ Tea Group used to sell some organic tea to this company. To our knowledge, this company is currently not certified any longer.

1 4. According to what we have been able to find out, ZJ Tea Group has not been selling any organic tea to the US since they were first certified by CERES in July 2014. 5. The only retail labels that CERES has approved for ZJ Tea Group so far, are the ones in the attached recent document. However, teas with this packaging have not entered the market so far. 6. Today, we have finally received a top management commitment from ZJ Tea Group, recognising mistakes in tea labeling in the past, and promising to submit any packto CERES for approval before printing.

I hope this finally clarifies the issue and allows you to close the case?

Thanks for the notification. We are investigating the case. So far we have found out that our client Zhejiang Tea Group Co. Ltd., does not seem to sell tea with this packaging on the US market. Even the email address [email protected], as indicated on the packaging, is not their official email. We are yet to find out who is actually behind this, and if this tea is organic at all. We therefore would like to ask you for an extension of the deadline for investigation, until April 20, 2015.

Our Story Firsd Tea is new to Delaware, but the history of the company and the expertise in the tea industry dates back to the 1950 s. We offer a diverse range of specialty teas, as well as unconventional tea products to enhance the drinking experience and make it as enjoyable as possible to the consumer. We strictly monitor each step from planning, harvesting and packaging to ensure the quality and integrity of our products.

By inheriting the 4,000 year old legacy of Chinese tea culture, our group has integrated the traditional tea processing crafts with the modern technique, developing new tea products to meet the needs of the modern society. Our focus is on growth, but not without deep convictions of protecting and sustaining the Earth.

Our Roots

We are originally from the Zhejiang Province located in South East China off of the East China Sea. Zhejiang means “zigzagging river” and it is the largest tea producing province in China.

Terrain is hilly, with infamous mountain ranges: Yandang, Tiantai, Tianmu and Mogan Mountains. The highest peak is Huangyajian Peak. The West Lake region of Hangzhou lies in a valley within the mountains and is the home of the muchloved Lung Ching Tea, also known as Dragon Well Tea. The high altitude and subtropical climate creates the finest environment for growing tea. The typical summer day is warm and humid and the tea leaves flourish.

Firsd Tea is the U.S. office of Zhejiang Tea Group Co., Ltd., a corporation, whose scope is mainly the tea business. The company provides high quality products in domestic and foreign trade. Our annual business turnover is 550 million US dollars; International trade value is over 400 million US dollars.

As the largest tea enterprise in China with over 60 years experience as a leader in the tea business, the company exports more than 40,000 tons of tea annually, including green tea, black tea, oolong tea, puerh tea, scented tea, special gourmet tea and intensive processed tea products.

The company owns 21 holding subsidiaries, 4 business departments and 7 ChineseForeign equity joint venture enterprises. The company developed 10,000 high altitude tea farms and operates 10 tea factories. We have a 20,000 ton annual capacity facility and the largest tea extract factory in China. Sustainability

The tea industry is already over 4,000 years old. Over the past 60 years, our company has cultivated not only tea leaves, but the overall industry. We care deeply about prolonging the legacy of tea, therefore sustainability is a priority.

The Chinese culture is all about Ancestry. Respect for your elders and the work they have accomplished. The American culture is about Posterity, passing down a legacy onto future generations. Combine these ideals and you get sustainability, the drive to produce growth without depleting resources for future generations.

We have worked with the Ethical Tea Partnership to develop the standard for the tea industry to ensure that sustainability is a priority in all our business functions. • Strive to continually reduce the volume and types of agrochemicals to reduce toxicity levels in the environment
