NOTICE OF COUNCIL’S WISH TO BE PARTY TO PROCEEDINGS Date 19 October 2018

TO: The Registrar Environment Court Christchurch

1. wishes to be a party to the following proceedings:

Royal Forest and Bird Protection Society of New Zealand Incorporated v West Coast Regional Council ENV-2018-CHC-201.

2. Grey District Council is a local authority and made a submission about the subject matter of the proceedings.

3. Grey District Council is not a trade competitor for the purposes of s 308C or 308A of the Resource Management Act 1991.

4. Grey District Council is interested in all of the proceedings.

5. Grey District Council is interested in the following particular issues:

(a) The effect the proposed West Coast Regional Policy Statement (PRPS) will have upon the residents of the Grey District and the performance of the Council’s statutory functions.

6. Grey District Council opposes the relief sought because:

(a) The Council is the territorial authority of the West Coast. The Grey District includes large areas of conservation estate. It has a small population of approximately 13,000 residents.

(b) The Council is responsible for the functions set out in s 31 of the Act. It is required to, inter alia, prepare and change its district plan in accordance with a regional policy statement (s 74) and to give effect to any regional policy statement (s 75).

(c) The PRPS correctly identifies and responds to the significant resource management issues in the region.

(d) The decisions version of the PRPS strikes the correct balance between enabling social, economic and cultural well-being and the protection and sustainable management requirements in part 2.

(e) The PRPS gives effect to the relevant national direction, including the New Zealand Coastal Policy Statement.

(f) The relief sought does not achieve the purpose of the Act, including, but not limited to:

i. The relief sought does not promote the sustainable management of natural and physical resources under s 5 RMA. In particular the relief would not enable the community of the Grey District to provide for its social and economic well being, s 5(2) RMA.

ii. The relief sought does not provide for the efficient use and development of natural and physical resources, s 7(b) RMA.

(g) The relief sought would not enable or is not necessary for the Council to properly perform its functions under s 31 RMA when giving effect to the PRPS.

7. Grey District Council agrees to participate in mediation or other alternative dispute resolution of the proceedings.
