Question 1 – Dog Pound

What has Council done in relation to new shelters for the dog pound (well overdue)? Also can Council allocate some exercise space for all animals taken into care?

The Dog Pound is being reviewed presently regarding adequacy of kennel space, overall conditions and possible long term improvements. Dog control and management practices will be considered within the review and your concerns will be considered.

Question 2 – Trees

At the last Council meeting, land was approved to go to housing. Would Council “please” consider the large trees on the land before approving clear felling of all this land – i.e. Pinjar and Caporn? Also consider the size of blocks, as so many people do not want very small places to live and not enough room to park for families.

Further Information by the Director, Planning and Development

Council at its meeting on the 5 February 2002 considered the lifting of the Urban Deferred zoning on various lots within the Sinagra locality. This area is located within the East Wanneroo Local Structure Planning Cell number 2. The structure planning for this area is ongoing and has taken into consideration the most appropriate distribution of POS for both active and passive recreational pursuits, including the preservation of native bushland. Further to this, the City has been pursuing conditions on subdivision approval to explore the opportunities that exist through the development of land to preserve vegetation within the future roads and private lots, where practicable.

The structure plan for this locality promotes a range of lots sizes pursuant to the R20 density code. It is considered desirable to promote a range of lot sizes within developing areas, in accordance with Western Australian Planning Commission Policy. Ultimately the density coding for developing areas only promotes the minimum lot size and the developers will promote lot development in response to prevailing market demand.

Question 3 – Median Strip – Wanneroo Road

When will Council brighten up our median strip on Wanneroo Road – (with Main Roads help)?

A proposal to undertake improvements to the median strip on Wanneroo Road is being put forward in the draft 2002/03 budget.

When someone on staff or Council declare an interest in an item on the agenda, could it be written in the agenda what that interest is other than what happens now?

Has a firm date been set for the opening of the Warradale Community Centre?

No date has been set as Council are still waiting for a completion and handover.

Question 2 – Replacement of Tamala Park

Regarding the new rubbish baling centre aimed for 11 years’ time. Wangara was one area mentioned as a possible new site for the replacement of Tamala Park. Will there be any community discussion on it?

There will be extensive community consultation on this matter, although the preferred site from Council’s perspective is likely to be within the Flynn Drive Industrial Estate, which is a considerable distance from Landsdale.

PQ11-02/02 Ms L Shipway, Longbeach Promenade, Mindarie

Questions and Statements regarding Long Beach Promenade Mindarie

Is Council aware of the dangers the parking bays will create when cars back out into traffic coming from both ways? Traffic coming from the north will be using the resident’s driveways to affect U-turns into the parking bays, which will create another hazard.

How can the City change a motion that was passed in June 2001? There were four surveys done on the matter and these were to be done at no cost to the ratepayers. Why were the results completely disregarded by Council who has now forced the embayments upon us?

Why was the access south of Savona altered? If it was considered dangerous why didn’t they grade it and step it down? Where else in Wanneroo will you find car bays placed on a dangerous curved road and approximately half a mile from the beach? The Foreshore Group have had over six months to bring a motion to Council. Why do it when the work has commenced? We would ask Councillors to vote to close the car park.

Further Information from the Director, Technical Services

The parking bays have been designed to formalise the on-street parking along Longbeach Promenade. The existing pavement was widened to accommodate the parking embayments and provide for a 7.4m wide carriageway. This carriageway width provides for two-way traffic and is a common standard for this class of road.

Longbeach Promenade is not on a sharp bend and there is sufficient site distance to see cars parking or leaving their parking bays and for parked cars to emerge from the bays safely.

On-street parking on curved roads has been provided in Aldersea Circle and Victorsen Parade, Clarkson in Saleno Drive and Ellison Parade, Mindarie.

The speed limit for Longbeach Promenade is 50km/hr and if residents are concerned that motorists are speeding along this road then contact should be made with the local police.

Further Information from the Director, Planning & Development

Council took into account all material presented to it when making the final decision to implement proposals for parking embayments along Long Beach Promenade.

In view of the steep gradient of the accessway south of Savona Grove, the gate at the entry of this accessway is locked. Council at its meeting of 26 February 2002 resolved to review the Mindarie Beach Foreshore Reserve Management Plan. The review will address the issues relating to the provision of beach accessways at recommended gradients.

PQ12-02/02 Mr T Martin, 103 Cathedral Avenue, Brigadoon

Question 1 – Firebreaks

I received a summons from the City for not having completed the firebreak on my property. The only portion of the property where no firebreak had been installed was a small section of roadway on Landsdale Road. (Photograph tabled by Mr Martin). The letter I got from the City advised me that the summons was due to not affecting requested works after appropriate warnings from Council Administration.

The reason for not completing the works was due to telephone lines – I had been warned not to interfere with them. This is the first summons I have ever received in my 81 years and I’m very upset about it. It’s not the money but the principle that I object to.

PQ13-02/02 Ms J Ashman, Longbeach Promenade, Mindarie

Statement 1 – Parking Bays

When we were looking at buying our property 6 months ago, I rang the Council to find out if any works would be taking place in Longbeach Promenade and was informed that an extension may be considered in the future. Nothing was mentioned about car parking bays.

Response by the Director, Technical Services

The City has a formal Property Enquiry System which provides for a written response to these types of enquiries. It is noted however that the final decision to proceed with the car parking bays was not made until August 2001 when the Council budget was adopted. This may have been after the property enquiry was made.

Statement 2 – Safety Concerns

I have safety concerns with regard to the parking bays. A representative from Council stated that the road was wide enough to accommodate these bays in safety. The representative is not a resident of the area and does not see what the residents see, therefore cannot understand the issues at hand.

Question 1 – Closing of Access Way

I’d like the access way to the car park closed. I think it’s detrimental to the rehabilitation of the dunes to keep it open. There is a lot of anti social behaviour as well as cars/four wheel drives entering the area. I cannot understand why the Council did not improve the car park at the main beach, as the access from the main beach is a lot easier than trudging through sand dunes.

How will the parking embayments impact on the residents? They are actually on the opposite side of the street and a person would have to drive to the end of the street and come back to park. I’m concerned about people using driveways as turn around points, going over reticulation or leaving rubbish on the side of the road when getting back from the beach.

At the time of the proposed review of the Mindarie Beach Foreshore Reserve Management Plan the issues relating to the access way to the closed car park and the improvements to the car park at the main beach will be considered.

The parking embayments should improve the situation for residents as they will formalise the on-street parking along Longbeach Promenade. Motorists may use crossovers for turning movements, however, cars cannot be parked on or in front of crossovers.

PQ14-02/02 Mr P Jenzen, 6 Shiel Way, Hamersley

Question 1 - Item PD01-02/02

Request for a reduction in infrastructure. On first signing for the property on 23 February last year, a deposit was paid and an application to develop a truck and bus-parking bay at Lot 27 Windsor Road Wangara was made on 28 May. On 10 July we received a letter stating the conditions of the development, which included an amount for infrastructure, which we had not previously been informed about. This cost for this is $67,000. We asked the City to consider a reduction from $67,000 back to $48,000.

The subsequent proposal put forward was $8,000 on approval of the building licence, $20,000 in June and $20,000 in June 2003. If there was no reduction the balance was to be paid in June 2004.

We are planning to use the site to park semi trailers and trucks - 50% of the property will be lost as this will be used for turning circles. We would therefore request that the City consider 3 payments, the first ($8,000) due on approval of licence; $20,000 in June; $20,000 in December, the remainder in 2003. Due to everything being so late we would like the first payment to stay as is and the rest to be put back six months.

The City staff have been working closely with the applicant on this proposal. The difficulty in reducing the infrastructure payment is that the costs for Cell 7 has been based on a square metre rate, calculated by taking into account all developable land in that cell. Council does have discretion to vary this but the difficulty is that other landowners would have to pick up the shortfall.

During discussions with the applicant it was evident that there were difficulties in making the up front payment which is a requirement of the City however the report recognises his request to stage the payments over a 2 year period.

PQ15-02/02 Mr B Barr Toulon Circle, Mindarie

Question 1 – Street lighting and footpath, Montrose Walk

The City of Wanneroo has an obligation to the ratepayers of Toulon Circle to provide street lighting and a footpath on Montrose Walk. If this is not done, who will be responsible for an accident to pedestrians - the City or the developers? Why can't the City also install temporary bollards as suggested in a letter to me from the Development Manager of Mirvac Fini.

Response by Director, Planning and Development

Administration is working closely with the developers to see closure of Montrose Walk to vehicular access. It is private land and is not owned by the Crown which is a considering factor in terms of any infrastructure or investment.

Question 2 – Re-opening of Anchorage Drive

I can only reiterate what I said before about Anchorage Drive in that it should be resolved to the satisfaction of ratepayers. This does not appear to be happening.

There are two opposing views within the community regarding this issue. There are strong arguments on both sides as to why it should be retained or why it should be open. Perhaps at the upcoming election there should be a referendum involving the community of Mindarie to resolve the matter. Council’s role is to fairly and in an unbiased way put forward both cases.

PQ16-02/02 Mr P Roberts, 37 Longbeach Promenade, Mindarie

Statement

I would like to acknowledge the extensive research Council has undertaken to establish the correct method of car parking along Long Beach Promenade. Congratulations on the current construction of the parallel parking embayments.

Question 1 – Beach Access Way to Mindarie Beach

The decision, I believe, resulted from a petition regarding preference for the type of parking and the community’s desire to maintain adequate and proper beach access.

Regarding the proposed amendment by Cr Loftus. I believe the words “location and alignment of beach access ways” are to be removed from point 1 of the recommendation. This would therefore mean that Council undertakes a review of the Mindarie Beach Foreshore Management Plan to determine beach access ways. I would like to request that Councillors pay particular attention to the intent of the change that has been put to them?

Given that the existing car park was constructed in association with the provision of beach access under the Mindarie Beach Foreshore Management Plan; given that the removal of the carpark is only taking place following alternative car parking means being provided for beach access; given that construction of parallel parking is under way in support of the provision of beach access and given that the petition last year from residents of Mindarie Beach and the community clearly show they were desirous of beach access, surely the proposed amendment is not asking whether or not beach access is still needed?

PQ17-02/02 Mr T Priddle, Barnabas Boulevard, Quinns Rock

Statement – Item PD19-02/02

It states in the report that “the transfer option was not pursued by the purchaser as he now operates outside the City of Wanneroo”. We are not operating, the business has ceased. A licence was requested for a food machine and within 14 days the business had ceased. I understand that the City does not give refunds but this is not stated in the application.

I was told the City had referred the matter to their solicitors and that negotiations would have to take place between my solicitors and the City’s.

It is not the money, it’s the principle as it is not documented anywhere that refunds are not given. I ask that Councillors please re- look at the issue as we have done everything required.

Council will debate the issue later tonight. The reason for involving solicitors was that you were not happy with Administration advice, which was that the City’s local law does not provide a mechanism for refunds.

Statement – Tuart Grove

I’d like to thank the CEO and Council staff in recognizing the importance of working towards a safer, more practical and better access way to Tuart Grove. Based on the NKCCA suggestions for the area, if fully implemented, would meet the expectations of the majority of the 200 people who reside in the area and who have responded to public comment previously.

Statement – Bollards Rather Than Gates

As a resident living in the southern end of Longbeach Promenade, I refer to a proposed amendment to the Council recommendation. It has been requested that a gate similar to that at the southern end be installed at the northern end. This gate currently hinders people trying to access the park land and although a statement was made that this would reduce the antisocial behaviour in the area, it should be noted that antisocial behaviour stems from young people who can easily negotiate a gate as well as a bollard. We would like bollards at the southern end as we do not want to stop people accessing the parklands, which are there for all people to share.

The section of collapsed wall near the children’s play area will be replaced by a sand batter, stabilised with stone pitching.

The section of wall adjoining the footpath will be stabilised with pine poles and rails. This method is cost effective and is considered suitable for a period of up to five years.

These works are of a short-term nature to resolve the existing safety concerns. The ultimate location of infrastructure will be dependent on the recommendations of the revised foreshore management plan for the area.

Further Information from the Director, Planning & Development

The Western Australian Planning Commission granted subdivision approval over the land south of Montrose Walk. This approval requires the creation of a Pedestrian Accessway over the eastern portion of Montrose Walk (near Anchorage Drive intersection), thereby removing through vehicle traffic. The developers (Mirvac Fini) have indicated that the subdivisional works will not occur in the short term, and as such, the existing pavement will remain in place. However, there have been ongoing discussions with the developers to facilitate the closure of Montrose Walk to vehicles, through the use of bollards. City Administration will further explore the opportunity for the developers to erect bollards and cease vehicle traffic as an interim measure until such time as the next stage of subdivision is initiated.

PT05-02/02 Cr Salpietro – Mariginiup Townsite Rezoning

Cr Salpietro presented a petition signed by 33 residents stating that the residents and owners of the land in the Mariginiup Townsite wished to remain zoned rural resource to enable them to continue their lawful use and enjoyment offered under this zoning. Council is therefore formally requested to consider opposing the proposed MRS Amendment – Proposal 10 – rezoning of the Mariginiup Townsite from rural zone to urban rural.

PT06-02/02 Cr Monks – Speed and Traffic Issues in Fillans Bend, Regent Waters, Wanneroo

The City's Administration staff met with the petition organiser on the evening of 20 February 2002 and discussed the concerns and presented a concept design currently proposed for the intersection. It was agreed that City Administration would undertake a traffic survey (ie install traffic counters for a seven day period). On completion of the survey the data will be analyzed and traffic calming options reconsidered. A report to Council will follow the review of the investigation.

PT02-02/02 Cr Newton – Dangerous Driving, Residential Roads, Wanneroo

Cr Newton presented a petition at the 05 February 2002 Council meeting on behalf of 28 residents of Nannatee Way and Wonyill Street advising Council of dangerous and careless driving and requesting Council consider road calming devices to curb this activity.

ACTION

Nannatee Way is under investigation with a report to Council on completion.

PT03-02/02 Cr Salpietro – Joondalup Drive

Cr Salpietro presented a 517 signature petition at the 05 February 2002 Council meeting requesting the completion of Joondalup Drive, stating that the residents of Banksia Grove are potentially trapped in the estate in the case of fires.

ACTION

At its meeting of 18 December 2001, Council resolved to prepare Amendment No. 9 to District Planning Scheme No. 2 to facilitate the early construction of Joondalup Drive from its current eastern end at Cheriton Drive, Carramar to the northern boundary of the Peet and Co. landholding at Tumbleweed Drive, Banksia Grove.

The WA Planning Commission’s consent has been sought to advertising of the amendment and when the Commission decision is received, a full report will be presented regarding this petition.

PT04-02/02 Cr Loftus – Increase to Yanchep Surf Life Saving Club,

Cr Loftus presented a 175 signature petition at the 05 February 2002 Council meeting requesting an increase in size to the Yanchep Surf Life Saving Club to meet the demands of beach patrols and safety of our beaches.

ACTION

A report will be prepared and presented to Council as soon as all the necessary information is collected.

d) The introduction, on a cost effective basis (as vehicles and other items are replaced or purchased), of revised branding of the service with the following logos (in corporate colours);

5. ENDORSE the continued operation of the Safer Citizens Working Group, to guide the direction of the program and submit a quarterly report on operations to Council
