Motion 1

That Council adopts the proposed resolution, directing the administration to submit a grant application for the Municipal Asset Management Program with FCM.

Motion 2

Be it resolved that Council directs staff to apply for a grant opportunity from the Federation of Canadian Municipalities’ Municipal Asset Management Program for a condition assessment to be produced for both the Embrun and Russell arenas.

Be it therefore resolved that Russell Township commits to conducting the following activities in its proposed project submitted to the Federation of Canadian Municipalities’ Municipal Asset Management Program to advance our asset management program:

• Condition assessment of the Embrun arena;

They are also unbounded in their enthusiasm to use their own talent, skills, and hard work to make a difference in others’ lives; and

WHEREAS, Members of Optimist International will celebrate OPTIMIST DAY throughout the world the first Thursday of every February to promote their efforts in helping and recognizing the young people that make a difference in their communities and who will encourage a greater exchange of ideas between young people and adults; and

WHEREAS, there are 2400 Optimist Clubs, with more than 70,000 Members, in Optimist International and Optimist members throughout the world that carry out more than 6500 service projects that serve six million young people a year; now therefore be it

RESOLVED, that the Council of the Corporation of the Township of Russell do hereby proclaim Thursday, February 4th, 2021 as Optimist Day in the Township of Russell. May this day instill pride in our Township Optimists clubs for all their accomplishments and for the impact they have to truly make a difference in others’ lives. MOTION APPROVED

Clear cutting near 1044 St-Guillaume (roundabout) Resolution will not be brought to council, no councillor to support it Clear cutting for this project has already been approved by Council Request from members to be better informed on projects involving environmental topics. Council or administration can ask feedback from Committees Committee will ask to have the landscaping plan of this project to have a look at it and make suggestions c. Recycling update Province is moving forward with the transition of the Blue Box program Resolution was approved by Council in 2020 for the township to transition in 2023 which would have significant cost saving but the proposed regulation has the township of Russell scheduled for 2025 only A letter as been sent to MPP Simard by Mayor to ask for her assistance and to have details on the decision to include our township in the 2023 transition group. MPP Simard has sent a letter to the Minister of the Environment, Mr. Jeff Yurek about it and fully supports that the Russell Township be included in the 2023 group. e. Route 300 intersections improvements EA Jonathan Bourgon briefed committee about the EA process. Intersection of St- Guillaume and Route 300 will be added in the study to be reviewed by the public at the beginning of 2021. A council report will follow to approve the future upgrades of the full corridor of Route 300 in Embrun. Proposed roundabouts at intersections of Limoges Rd/Route 300, St-Pierre/Route 300 and St-Guillaume/Route 300 and turning lanes at intersections of St- Thomas/Route 300 and St-Augustin/Route 300 EA process is to evaluate how much land that we need to acquire, minimize the impact on existing residents and then a report will be presented to Council and then proceed with best alternative to design next year.

Timothy Schmitz - What is the turn out about the third leaves and yard waste collection? Was there less material collected at the third leaf and yard waste collection? Noticed that there was not as much material at the curb as for the previous collections. Most of the material was from the missed collection of October. 3. Business arising from last meeting

a) Cityscape completed inspection of the tree and spent approximately 3 hrs re-configuring the lights as it appears the tree has grown since the original layout. Anticipated cost of $700-$800.

b) Mike will pick up a timer in the next couple of days as the old one was inadvertently packed with luggage going to Calgary

c) COI has not yet been received for John Corvinelli. Dave will pursue before the 26th.

4. New Business

a) Ag Society Grant applications was received from Lindsay Welk requesting $3,000 in support for “Christmas on the Farm. Grant request for $3,000 was approved.

b) The Grant application from the Museum Board submitted by Harry Baker requesting support of $2,000 was withdrawn because of uncertainty around the renovation schedule on the exterior cladding of the building. The original application was modified at the request of Mr. Baker. The Trustee’s approved a grant of $200 for garland on the front railing of the Keith Boyd Museum.

c) The two options for the front of the Russell Arts Centre were discussed. The Trustee’s agreed to support the initial phase of the proposal from Cityscape of $2,175 plus HST once a formal application was received from the Arts Centre. The Application focussing on the Cityscape proposal was received on Nov. 24. The Grant request for $2,458 was approved.

d) The Trustee’s reviewed the options presented for the “Jean Paul (JP) St. Pierre Building” by the contractors. The Township of Russell Library Board will meet on the 19th. In order to expedite the

The pre-approval approach would provide the Library Board the option to choose either of the two proposals they have received.

e) Dave indicated that John Corvinelli was planning on participating in the program at the entrance to Russell Trails. No funding request was anticipated.

f) Mike suggested that in order to cover our existing commitments to Russell Village Lights we transfer $10,000 from the Scotia Mcleod investment account to our bank account. This was approved.

g) It was confirmed we would target November 26 to Light Up the Tree beside Russell Public School.

And whereas VIA Rail has agreed to extend the overholding period of the Lease Agreement, notwithstanding the notice of termination delivered to it, for a period of up to six (6) months.

Jean Leduc Chief Administrative Officer HISTORY, REFERENCE AND SUPPORT INFORMATION Place St-Thomas Subdivision received draft approval in 2010 from the United Counties of Prescott and Russell. A plan of subdivision was registered on title for each Phase 1a & 1b, 2, 3, 4, 5 and 6.

The Rochon, Lemieux, Bourdeau extension of Cologne and Namur Streets, as a separate subdivision connected to the Place St-Thomas subdivision received draft approval on November 3, 2020. The draft plan approval conditions included a condition that lands had to be rezoned from R1A-h to R1A, R2 and R3 to allow the proposed mix of detached, semi-detached and townhouse dwellings.

The subject properties are part of Phase 6B of the Place St-Thomas subdivision (Block 34 and Lot 26) and the entirety of the Rochon, Lemieux, Bourdeau extension of Cologne and Namur Streets (see Map 1 for the location of the subject lands).

A total of 123 dwelling units are proposed on the subject lands as follows: • Detached dwellings: 24 units (Lots 1 to 24) • Semi-detached dwellings: 30 units (Blocks 25-37, Block 60 and Block 34 and Lot 26) • Townhouse dwellings: 69 units (Blocks 38-54)

Lot and Block numbers are shown in Figure 1.

A pre-servicing agreement for the Place St-Thomas Subdivision Phase 6 was signed in July 2020 between 1437137 Ontario Inc. and the Corporation of the Township of Russell to develop new municipal watermain and sewer works for Namur Street in Embrun to service the subject lands.

A pre-servicing agreement has not yet been signed for the Rochon, Lemieux Bourdeau subdivision including the majority of the subject lands.

The subject property is currently designated “Residential” in the Township of

Map 3 shows the zoning of the subject and surrounding properties.

The property part of the Rochon, Lemieux, Bourdeau subdivision is currently vacant. Full municipal services will be installed as part of subdivision development following signing of a pre-servicing agreement or subdivision agreement.

To the north of the subject property, is an agricultural field outside of village boundaries, designated Agricultural Policy Area in the United Counties of Prescott Russell Official Plan and zoned “Restricted Agricultural (A1)” (see Map 3).

To the south of the subject property, is existing and proposed parkland along the creek, on the other side of the creek is existing parkland and existing detached dwellings. These lands are designated Residential in the Township of Russell Official Plan and zoned “Residential One A (R1A)” with some areas along the creek zoned “Floodplain (FP)” (see Maps 2 and 3).

West of the property is existing and proposed parkland along the creek, on the other side of the creek are existing detached dwellings and vacant land. These lands are designated Residential in the Township of Russell Official Plan and zoned “Residential One A (R1A)” with some areas along the creek zoned “Floodplain (FP)” (see Maps 2 and 3).

To the east of the property are existing and proposed detached dwellings on Cologne Street and existing and proposed townhouses along the west side of Namur Street. See Map 2 for the Official Plan designation (Residential) and Map 3 for the zoning of the properties to the east.

DISCUSSION PROVINCIAL POLICY STATEMENT (2020) The Provincial Policy Statement section 1.4.3. states that:

“Planning authorities shall provide for an appropriate range and mix of housing options and density to meet projected market-based and affordable housing needs of current and future residents of the regional market area by: … b) Permitting and facilitating: 1. All housing options required to meet the social, health, economic and well-being requirements of current and future residents, including special needs requirements and needs arising from demographic changes and employment opportunities; and 2. All types of residential intensification, including additional residential units, and redevelopment in accordance with policy 1.1.3.3”; c) Directing the development of new housing towards locations where appropriate levels of infrastructure and public service facilities are or will be available to support current and projected needs; d) Promoting density for new housing which efficiently use land, resources, infrastructure and public service facilities, and support the use of active transportation and transit in areas where it exists or is to be developed; …”

The Provincial Policy Statement states that settlement areas, such as the Village of Embrun, should be the focus of growth.

Section 1.1.3.2 of the PPS directs land use patterns within settlement areas by stating:

Land-use patterns within settlement areas shall be based on density and a mix of land uses which: a) Efficiently use land and resources; b) Are appropriate for, and efficiently use, the infrastructure and public service facilities which are planned or available, and avoid the need for their unjustified and/or economic expansion; …”

The proposed zoning by-law amendment would allow for intensification in an area and on lots where municipal water and sewer services are planned and which represents an efficient use of land and infrastructure.

UNITED COUNTIES OF PRESCOTT AND RUSSELL (UCPR) OFFICIAL PLAN

The United Counties of Prescott and Russell Official Plan designates the subject property as “Urban Policy Area”, a designation that is intended to absorb a significant portion of future growth in the United Counties of Prescott Russell.

The urban policy area is intended to provide a range and mix of low, medium and high-density housing types to satisfy a broad range of residential requirements and to create a planning framework that will encourage and support diversified, mixed-use communities.

The proposed detached dwellings, semi-detached dwellings and townhouse dwellings would be low and medium density housing within a growing neighbourhood development that includes a mix of detached dwellings, semi- detached dwellings, townhouses and will soon include apartment dwellings (under construction). The proposed amendment from “Residential One A with holding (R1A-h)” to “Residential One A (R1A),” “Residential Two (R2)” “Residential Three (R3)” will allow for a continued broad range of housing types within the development.

TOWNSHIP OF RUSSELL OFFICIAL PLAN The Official Plan’s role is to guide and direct the use of land within the Township’s four villages. The Plan provides a vision for the future growth within these areas and a policy framework to guide their physical development for the next 20 years. All zoning amendments and development must conform to the policies contained within the Official Plan while also, to the extent possible, advancing the policy objectives expressed within it.

The subject property is designated “Residential” in the Township of Russell Official Plan. The objectives and policies for this section are within section 4.2 of the Official Plan. The objectives speak to promoting a range of housing types and tenures generally limited to low and medium density housing, including detached dwellings.

The proposed detached, semi-detached and townhouse dwellings on the subject property, proposed at a density of approximately 21 units per net

The proposed zoning amendment is in keeping with the policies of the Township of Russell Official Plan.

The proposed amendment is to change the zoning of the lot (shown on Map 1) from “Residential One A with holding (R1A-h)” to “Residential One A (R1A),” to permit detached dwellings, “Residential Two (R2)” to permit semi-detached dwellings and “Residential Three (R3)” to permit townhouse dwellings.

A holding symbol is required for all lands until municipal services are installed or are in eth process of being installed. A pre-servicing agreement has not yet been signed for eth Rochon, Lemieux, Bourdeau subdivision therefore the Planning Department recommends the requested change in zoning provided the subject lands (with the exception of the lot within the Cloutier subdivision Phase 6) are subject to a holding symbol.

DISCUSSION The Zoning By-law #2018-094 provisions for the proposed “Residential One A (R1A “Residential Two (R2)” and “Residential Three (R3)” zone could be met by future detached, semi-detached and townhouse dwellings. The proposed zoning amendment would be in keeping with the Official Plan policies of both the Township and the United Counties of Prescott Russell and the PPS.

A pre-servicing agreement has not been signed to bring services to the subject lots, therefore the holding symbol cannot be removed and should apply to the new requested zones. The holding symbol can be removed once a pre-servicing or subdivision agreement to install services has been signed.

The Planning Department recommends approval of the Zoning By-law amendment to amend the zoning from “Residential One A with holding (R1A- h)” to “Residential One A with holding (R1A-h)” to permit detached dwellings, “Residential Two with holding (R2-h)” to permit semi-detached dwellings, and “Residential Three with holding (R3-h)” to permit townhouse dwellings. The holding symbol is to remain until a pre-servicing agreement or subdivision agreement including eth installation of services as been signed.

PLANNING ADVISORY COMMITTEE There were no questions from the members of the Planning Advisory Committee on this item. There were questions from a member of the public related to this item, however, these questions related to the draft plan of subdivision approval. The member of the public was asked to contact Planning Department staff to discuss the subdivision approval related questions. See the Planning Advisory Committee meeting minutes in attachment for the specific questions posed.

The Planning Advisory Committee voted unanimously to concur with the recommendations of the Planning Department to approve the requested zoning by-law amendment but keep the holding symbol in place until a pre-

The vacant land on the creek's west side is part of the same parcel as the subject property. This vacant land is used by the landowners on Radisson. Instead of being a riparian buffer for the creek, the land has several sheds, a trampoline, and most of the vacant land has been turned into lawns. Could the developed consider turning this area into parkland as well? Dominique Tremblay: Those are all questions related to the draft plan of subdivision and are not related to the zoning amendment we are discussing tonight. As stated previously by email to Mr. Young today, I have no problem discussing this with him. I will send him a copy of the draft plan of subdivision approval conditions. Jamie Laurin: I agree that we should only be dealing with the zoning amendment issues or concerns tonight. That’s more of a plan of subdivision issue. Brian Young, 200 Equinox, Embrun: 3. Is the developer installing fencing along the rear lot line of the new lots to be created on Cologne Street? The creek and its floodplain are adjacent and, in some places, touching the rear lot lines. In my opinion fencing is required to mark the lot boundaries. This will remind future homeowners not to encroach on areas bordering the waterway. 4. If encroachment were to occur in the future, how does the

The subject property has a frontage of 24.4 m (fronting on Forget Street) and a depth of 30.5 m, and has an approximate area of 963.8 sq. m.

An application for Zoning By-law amendment was received from the property owners Fritz Pierre and Ruthny Petigny in December 2020. The Zoning By- law amendment application requests a change in zoning from “Residential One (R1)” to “Residential Two (R2)” in order to permit construction of an addition which will result in the existing building becoming a semi-detached dwelling with an accessory dwelling unit. See Map 1 for the location of the subject lands.

Figure 1 presents the proposed site plan for the subject property. Figure 2 presents the preliminary elevations of the proposed addition.

The subject property is currently designated “Residential” in the Township of Russell Official Plan. Map 2 shows the Official Plan designation of the subject and surrounding properties.

To the north of the subject property, across Forget Street, are 66 and 68 Forget Street and 11 Jeanne D’Arc Street. 68 Forget Street is an existing split level detached dwelling with one-storey and two-storey sections to the home. 66 Forget Street is an existing one and a half storey detached dwelling. 66 and 68 Forget are designated Residential in the Township of Russell Official Plan and zoned “Residential One (R1)” (see Maps 2 and 3). 11 Jean D’Arc Street is an existing 2 storey detached dwelling, designated as Commercial in the Official Plan and zoned “General Commercial (C)” in the zoning by-law.

To the south of the subject property, are 965 and 969 Notre Dame Street. These lands are designated as Village Core in the Township of Russell Official Plan. 965 Notre Dame Street has an existing detached dwelling and is zoned “Village Core (VC).” 969 Notre Dame Street has an existing two-storey multi- unit residential building and is zoned a combination of “Village core exception 33 (VC-33)” and “Village Core exception 34 (VC-34)” in the zoning by-law (see Maps 2 and 3).

West of the property is 69 Forget Street. 69 Forget Street has an existing one-

The proposed semi-detached dwelling with secondary dwelling unit would allow for a small intensification project while remaining low-density housing within an existing neighbourhood that includes mostly detached dwellings. The proposed amendment from “Residential One (R1)” to “Residential Two (R2),” will allow for a broader range of housing types within the existing development.

The objectives speak to promoting a range of housing types and tenures generally limited to low and medium density housing, including semi-detached dwellings. Development within Residential designation within village boundaries should occur on full municipal services. The objectives identify that intensification and redevelopment must be compatible with the surrounding uses and that housing is provided in proximity to work, shopping, etc. and that a range of housing types and density are provided.

The Development Policies contained within Section 3 of the Official Plan are policies which apply to all land use designations. Section 3.1.3 discusses intensification describing it as “the efficient use of land through the promotion of a more compact form of development.”

Intensification is not only valuable because of the more efficient use of land, but it is also a cost-effective way in which to provide infrastructure and community services, decreases the pressure for the expansion of the village boundary, and provides for more vibrant and complete communities.

New development in existing areas should be compatible with surrounding uses. Section 3.2.3 of the Official Plan identifies 10 compatibility criteria new development should be assessed based on, particularly for intensification. The proposed zoning by-law amendment is assessed based on the compatibility criteria.

a) Height and massing The proposed new semi-detached dwelling addition would be two storeys, and approximately 8 m tall based on plans provided. The maximum building height under the current “Residential One (R1)” zoning is 10 m tall. Under the proposed “Residential Two (R2)” zoning the maximum height would be 10.5 m, however, the building as currently proposed is well below the maximum height. Given that the variety of heights and massing of the surrounding existing detached dwellings which are between one to two storeys tall, the proposed addition would be in keeping with existing height and massing of the neighbouring properties along the street.

b) Setbacks The proposed addition is setback further than the existing dwelling from the street and is therefore not expected to disrupt the existing pattern of setbacks along the street. The proposed addition does reduce the existing rear and side yard setbacks; however, the proposed addition still meets all applicable setbacks and the setbacks proposed are not out of keeping with setbacks on other properties in the area.

c) Outdoor amenity areas The outdoor amenity areas of adjacent residential units must be respected. The proposed semi-detached dwelling would have no more impact on the amenity areas of adjacent properties than a detached dwelling permitted under the current zoning which has the same side and rear yard setbacks for an interior lot.

d) Shadowing No additional shadowing impact is expected for the neighbouring properties for the semi-detached dwelling when compared to single detached dwelling as currently permitted.

e) Lighting Exterior lighting proposed is limited to near the front and rear entrances and near the garage. This lighting is in keeping with lighting on some of the neighbouring properties and is expected to have little to no impact on neighbouring properties in comparison to the lighting that could be expected for a single detached dwelling which would similarly be provided at entrances and near the garage.

f) Noise and air quality There is not expected to be a major increase in noise or air quality once construction is complete. The proposed semi-detached dwelling would create only two more residential units than a single detached dwelling with no secondary dwelling units.

g) Parking Parking meets the minimum requirements of the zoning by-law for the proposed use which is two per dwelling unit plus one parking space for the secondary dwelling unit proposed for a total of 5 parking spaces required. 2 garage parking spaces plus 3 driveway parking spaces have been proposed for a total of 5 parking spaces.

h) Vehicular access The proposed access to the property is similar in alignment with the existing access to the detached garage. The proposed semi-detached dwelling would block glare from headlights towards the rear of the detached dwelling and apartment building south of the property. Dwellings north of the property face Forget Street and the additional two units are not anticipated to have a significant impact on glare for the existing dwellings facing Forget Street.

j) Traffic Impacts No significant traffic impacts are anticipated for the additional two dwelling units. The subject property is only one lot away from Jeanne D Arc which provides vehicular access to Forget Street.

The proposed semi-detached dwelling on the subject property, proposed at a density of approximately 27 units per net hectare, is in keeping with the permitted maximum density (55 units per net hectare) and development forms permitted in the residential designation. The proposed project is in an area serviced with full municipal water and wastewater services with enough capacity to service the proposed development. An application of additional allocations of water and sewer services will need to be approved prior to building permit issuance. Additional stubs for water and wastewater services may be required depending on how the applicant prefers to service the proposed addition; a road cut permit may be required if an additional stub for services is planned.

The proposed zoning amendment is in keeping with the policies of the Township of Russell Official Plan.

The proposed amendment is to change the zoning of the lot (shown on Map 1) from “Residential One (R1)” to “Residential Two (R2)” to permit construction of an addition which will convert the existing detached dwelling to a semi-detached dwelling with one secondary dwelling unit.

PLANNING ADVISORY COMMITTEE The proposed Zoning By-law Amendment was presented to the Planning Advisory Committee at a public meeting on January 25, 2021. There were no questions or comments from members of the public or the Committee on this item. The Planning Advisory Committee concurred with the recommendations of the Planning Department and voted unanimously to recommend Council approve the requested Zoning By-law amendment.

PROJECT DESCRIPTION

HISTORY, REFERENCE AND SUPPORT INFORMATION On December 17, 2018, the Council of the Corporation of the Nation Municipality approved resolution # 691-2018 whereby the Township of Russell was allocated 187 equivalent units of water and 142 equivalent units of wastewater from the Limoges Water and Sanitary Sewer Systems as per Nation Municipality Report # WS-09-2018.

As per By-law # 2021-010, being a by-law to establish a growth management and development allocation system for the water distribution and sewage treatment systems of the Corporation of the Township of Russell the apportionment of the development allocation is as follows:

1.Fifteen percent (15%) for Priority Development; 2.Sixty-five percent (65%) for General Development, but not more than 40 percent (40%) to one owner and; 3. Twenty percent (20%) for Infill Development.

Based on allocations since December 17, 2018, the Council of the Township of Russell there remains the following number of units in the respective categories:

Priority development: 28.05 - 12 = 16.05 General Development: 121.55 - 70 = 51.55 Infill Development: 37.4 - 4.25 = 33.15

Vacant lot on Limoges Road, Limoges (subject property): Zoning of Property: Village Core (VC).

The application was submitted by the property owner who is proposing to build a private road with 16 townhouse units off of Oasis Street and a mixed-use building with one (1) non-residential unit and three (3) apartment units as shown in the site plan in Figure 1. The proposed townhouses require one (1) unit of water and sewer allocation each, the non-residential space requires one (1) water and sewer allocation and each of the three (3) apartment dwellings will require 0.65 units of allocation. The total allocations required for the development are 18.95.

The proposed project is considered a mix of general development and infill development.

Infill Development means development on vacant land (either existing or created by severance) where such vacant land is located in an established area. Infill Development shall not include land developed by approval of a condominium under Section 50 of the Condominium Act or draft approval of a plan of subdivision under Section 50 of the Planning Act.

Since the mixed-use building, including one (1) non-residential unit and three (3) apartment units is development on a vacant lot in an established area, along a street that has existing development the mixed-use building is considered an infill development.

General Development means general-purpose development (residential, commercial and industrial as defined in the Municipality's Zoning By-law) which is not otherwise defined in this by-law;

Since the property owner has discussed the intention of registering the townhouse development under the Condominium Act the townhouse development is considered general development for the purposes of this by-

law.

The allocations for the development, if approved, would result in the following remaining allocation units in the respective categories:

Unit allocations should be valid for a period of two (2) years, subject to the conclusion and execution of a subdivision agreement, site plan agreement or Condominium Plan.

By-laws # 2019-046 & 2019-047 will be applicable with respect to the cost of water and sewer rate for the capital costs in the Village of Limoges as supplied by the Nation Municipality.

Bowling Hall

A grant application was sent in December 2020, for the Investing in Canada Infrastructure Program. We are requesting funding for the replacement project of the pinsetter and scoring system at the Embrun Bowling Hall. We are waiting for an answer.

Recreation Complex

On December 7, 2020, the administration presented to Council report PR-23- 2020 about the recreation complex. Following the report, Council has approved the Phase 1 and 2 of the project. Council also approved Colliers Group as consultant for phases 1 and 2. Phase 1 consist the conception and construction of 2 tennis courts, two basketball courts and the Jonathan Pitre Park, as well as the conception of a snow hill. Phase 2 consist of public consultations, community engagement, specific user group consultations, surveys, geotechnical investigations, environmental reviews, traffic studies and other specialty reviews. Phase 2 will end with a report to council to take decisions relative to the installations in the future complex. The tables in Appendix 2 describe in detail the type of membership sold. We saw a decrease in revenues in the sale of membership for the gym, the walking and running track and the multisport court. SUBJECT Authority to apply for a grant from the Federation of Canadian Municipalities to the Municipal Asset Management Program. RECOMMENDATION That Council adopts the proposed resolution, directing the administration to submit a grant application for the Municipal Asset Management Program with FCM. FINANCIAL IMPLICATION The condition assessments being recommended were not part of the 2021 budget. We are estimating a total cost up to $62,500. FCM would cover 80% of these costs ($50,000). The municipal share of $12,500 can be covered by the Asset Management operational budget.

Page 155 of 173 Regular Council Meeting 16 Feb 2021 On January 19th, 2021, we received news that FCM’s Municipal Asset Management Program had reopened for a second round of funding. In 2018, the Township successfully secured $47,000 in funding to produce an Asset Management RoadMap and to obtain training for the Asset Management committee on our Asset Management software.

This second round of funding was not expected when we prepared the 2021 budget, so this is an opportunity for us to move forward with some initiatives that would likely have been part of the 2022 budget.

On September 21st, 2020, with report AM-03-2020, we presented to Council a Routine Condition Assessment schedule. Not all our assets are up to date with this schedule, and this is a great opportunity to catch up.

We are proposing to complete the assessment for both arenas. Understanding that we are currently preparing plans for a new Recreation Complex and that the use of these arenas could potentially be terminated in the short to medium term, we believe that the information coming from this study will help Council make informed decision on the timing of these closures or repurposes. Information included in this study will be:

-Updated annual requirement; -10 year capital plan; -Breakdown and condition of components included in the arenas.

**This will provide Council with more accurate lifecycle costing in order to maintain the current level of service of the arenas.

This information will also help Council be strategic about the timing of key milestones in the delivery of a new recreation complex.

The administration will report to Council with more specifics about the scope of this project once we have a better idea of the costs. At a minimum, we would like for the study to encompass the mechanical components of both arenas, which may have significant investment requirements in the upcoming years.

OTHER OPTION(S) TO THE RECOMMENDATION 1. Apply for a condition assessment for the Community Centre;

2. Apply for a condition assessment of another asset of Council’s choice.

Purpose and Effect of the By-Law

The land affected by this by-law is legally described as Parts of Lot 9 and 10, Concession 8, including Block 34 and Lot 26 on Plan 50M-352 vacant lands situated on the future Namur Street and Cologne Street in Embrun. The affected property is indicated on the attached map, Schedule “A”, which forms part of this By-law.

The subject property is presently zoned “Residential One A with holding (R1A-h)” in By-Law #2018-094. The Zoning By-Law amendments will change the zoning to “Residential One A with holding (R1A-h)” to permit construction of single detached dwellings, “Residential two with holding (R2-h)” to permit construction of semi-detached dwellings and “Residential Three with holding (R3-h)” in order to permit construction of townhouse dwellings.

BEING A BY-LAW TO AMEND ZONING BY-LAW #2018-094, AS AMENDED;

WHEREAS By-law #2018-094, the Comprehensive Zoning By-Law, regulates the use and erection of buildings and structures in the Township of Russell;

WHEREAS an application has been received to change the zoning of a certain parcel of land in the Township of Russell;

AND WHEREAS the Council of the Township of Russell considers it appropriate to amend Zoning By-Law #2018-094, as described;

NOW THEREFORE, be it resolved that the Council of the Township of Russell enacts as follows:

Section 1: The property being Parts of Lot 9 and 10, Concession 8, including Block 34 and Lot 26 on Plan 50M-352 vacant lands situated on the future Namur Street and Cologne Street in Embrun, identified on Schedule “A”, attached to and forming part of this by-law, shall be the property affected by this by-law.

Section 2: That Schedule “A1d” of By-Law #2018-094 is hereby amended to change the category of zoning from “Residential One A with holding (R1A-h)” TO “Residential One A with holding (R1A-h)”, “Residential two with holding (R2-h)” and “Residential Three with holding (R3-h)” as per Schedule “A”, attached.

Section 3: Subject to the notice of the passing being given, in accordance with Section 34(18) of the Planning Act, R.S.O. 1990 as amended, this by-law shall come into force on the date of the passing by Council of the Township of Russell where no notice of appeal or objection is received, pursuant to Section 34(21) of the Planning Act, R.S.O. 1990 as amended.

Being a by-law to provide for interim tax levies for the year 2021.

WHEREAS section 317 of the Municipal Act, S.O. 2001, c.25, as amended, provides that the council of a local municipality, before the adoption of estimates for the year under section 290, may pass a by-law levying amounts on the assessment of property in the local municipality rateable for local municipality purposes; and

WHEREAS Council of this municipality deems it appropriate to provide for such interim levy on the assessment of property in this municipality; now therefore be it

RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWNHIP OF RUSSELL ENACT AS FOLLOWS:

In this by-law, the following words shall be defined as:

“Collector” shall mean the Tax Collection Officer; “Minister” shall mean the Minister of Finance; “MPAC” shall mean the Municipal Property Assessment Corporation;

1. THAT the amounts levied shall be as follows:

1.1 For the Residential, Pipeline, Farmland and Managed Forest property classes there shall be imposed and collected an interim levy of fifty percent (50%) of the total taxes for municipal, county and school purposes levied on in the year 2020.

1.2 For the Multi-Residential, New Multi-Residential, Commercial and Industrial property, classes there shall be imposed and collected an interim levy of fifty percent (50%) of the total taxes for municipal, county and school purposes levied on in the year 2020.

2. THAT for the purposes of calculating the total amount of taxes for the year 2020 under paragraph 1, if any taxes for municipal, county and school purposes were levied on a property for only part of 2020 because assessment was added to the collector’s roll during 2020, an amount shall be added equal to the additional taxes that would have been levied on the property if taxes for municipal, county and school purposes had been levied for the entire year.

Page 168 of 173 Regular Council Meeting 16 Feb 2021 3. THAT the amounts under paragraph 1 shall be levied on the assessment according to the assessment roll as returned by MPAC.

4. THAT the provisions of this by-law apply in the event that assessment is added for the year 2020 to the collector’s roll after the date this by-law is passed and an interim levy shall be imposed and collected.

5. THAT there shall be imposed on all taxes a penalty for non-payment or late payment of taxes in default of the due date set out below. The penalty shall be one and one-quarter percent (1 ¼%) of the amount in default on the first day of April 2021 and on the first day of each calendar month during which the default continues, but not after the end of 2021.

6. THAT the interim tax levy imposed by this by-law shall become due and payable in two installments, on the 26th day of March 2021 and the 27th day of May 2021.

7. THAT the Collector shall send a tax bill to the taxpayer’s residence or place of business or to the premises in respect of which the taxes are payable unless the taxpayer directs the Collector in writing to send the bill to another address, in which case it shall be sent to that address, 2001, c. 25, s. 343 (6).

8. THAT the Collector may send a tax bill to the taxpayer electronically in the manner specified by the municipality, if the taxpayer has chosen to receive the tax bill in that manner, 2017, c, 10, Sched 1, s. 43.

9. THAT the notice to be mailed under this by-law shall contain the particulars provided for in this by-law and the information required to be entered in the Collector’s roll under section 343 of the Municipal Act.

10. THAT the subsequent levy for the year 2021 to be made under the Municipal Act shall be reduced by the amount raised by the levy imposed by this by-law.

11. THAT the provisions of section 317 of the Municipal Act, as amended apply to this by-law with necessary modifications.

12. THAT the Collector shall be authorized to accept part payment from time to time on account of any taxes due and to give a receipt of such part payment, provided that acceptance of any such part payment shall not affect the collection of any percentage charge imposed and collectable under section 6 of this by-law in respect of non-payment or late payment of any taxes or any installment of taxes.

Page 169 of 173 Regular Council Meeting 16 Feb 2021 13. THAT nothing in this by-law shall prevent the Collector from proceeding at any time with the collection of any tax, or any part thereof, in accordance with the provisions of the statutes and by-laws governing the collection of taxes.

14. THAT in the event of any conflict between the provisions of this by-law and any other law, the provisions of this by-law shall prevail.

15. THAT this by-law shall come into force and take effect on the day of the final passing thereof.

WHEREAS subsection 50(5) of the Planning Act, R.S.O. 1990, Chapter P.13, as amended, provides for part-lot control over all lands within plans of subdivision registered before or after the coming into force of this subsection; and

WHEREAS authority is vested in Council by subsection 50(7) of the Planning Act to enact by-laws which provide that Subsection 50(5) of the Planning Act does not apply to such lands as are designated in the by-law; now therefore be it

RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF RUSSELL ENACTS AS FOLLOWS:

1. THAT subsection 50(5) of the Planning Act does not apply to those lands designated as Block 52 on Plan 50M-334, being Parts 1 and 2 on Reference Plan 50R-11067 (PIN 69007-0558), subject to an easement in gross over Part 2 on Plan 50R-11067 (PIN 69007-0558) in the Township of Russell, County of Russell and registered in the Land Registry Office for the Land Titles Division of Russell (No.50).

2. THAT subsection 50(5) of the Planning Act does not apply to those lands designated as Block 52 on Plan 50M-334, being Parts 3, 4 and 5 on Reference Plan 50R-11067 (PIN 69007-0558), subject to an easement in gross over Part 4 on Plan 50R-11067 (PIN 69007-0558), subject to an easement in gross over Part 5 on Plan 50R-11067 (PIN 69007-0558) in the Township of Russell, County of Russell and registered in the Land Registry Office for the Land Titles Division of Russell (No.50).

A by-law to confirm the proceedings of the Council of The Corporation of the Township of Russell at its Regular Council Meeting held on February 16, 2021.

WHEREAS pursuant to Section 5 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended (“Municipal Act”), the powers of a municipality are to be exercised by its council by by-law; and

WHEREAS it is deemed expedient that the proceedings of the Council of The Corporation of the Township of Russell at this meeting be confirmed and adopted by by- law; now therefore be it

RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF RUSSELL HEREBY ENACTS AS FOLLOWS:

1. THAT the actions of the Council of The Corporation of the Township of Russell in respect of any reports from departments and committees and each motion and resolution passed and other actions taken by the Council of The Corporation of the Township of Russell at this meeting are hereby adopted and confirmed as if all such proceedings were expressly embodied in this by-law.

2. THAT the Mayor and Clerk and the appropriate other officials of the Corporation of the Township of Russell are hereby authorized and directed to do all things necessary to give effect to the actions of the Council of The Corporation of the Township of Russell referred to in the preceding section.

3. THAT unless otherwise provided, the Mayor and Clerk are authorized and directed to execute all documents necessary in that behalf and to affix thereto the seal of The Corporation of the Township of Russell.

4. THAT this By-Law shall come into force and take effect upon final reading thereof.
