  • Personalization Guidelines
Personalization Guidelines Purpose Our personalization services are a very important part of the Thirty-One experience. We believe our personalization services set our products and our brand apart. Although we never want to disappoint you or our Customers, there are legal and policy limits to the personalization requests that we will fulfill. These Personalization Guidelines are intended to assist you in: • Helping our Customers understand what personalization requests we cannot fulfill; • Avoiding damage to the Thirty-One brand; • Avoiding the infringement of the trademarks of others; and • Reducing potential legal liability for both Thirty-One and our Customers. Our hope is that these Guidelines will help you to advise Customers of problematic personalization requests when Customers place their orders. Why Can’t Thirty-One Fulfill All Personalization Requests? Legal Reasons There are legal reasons why we cannot fulfill certain personalization requests. Sometimes companies (like Avon or Microsoft), sports teams (like the Cleveland Browns or the Ohio State Buckeyes), and famous people (like Jennifer Lopez) make a filing with the government to register their name, the name of a product (like Apple’s iPad) or a tag line (like Nike’s “Just Do It”). If we fulfill a request to personalize a Thirty-One product with a name or phrase that has been “trademarked,” then there is a risk we could face a legal claim for “trademark infringement.” Trademark infringement can occur when someone uses a name or phrase that causes confusion with someone else’s trademark. Here is an example. The word “Coach” could refer to a sports team’s coach or it could refer to the COACH brand of handbags.

Yet, MLMs provide little information to regulators and potential participants regarding potentially material information. Although MLMs are often compared to pyramid schemes, consultants argue that participation in a MLM allows them to make money outside of the traditional full-time labor force. This paper examines the law, economics, and psychology of MLMs, suggesting that MLMs may draw on prospective consultants’ cognitive biases in persuading consultants to join and continue a MLM. Consultants may be led to focus on unlikely benefits and to conform to notions of success that seem consistent with the “American dream” — even to their financial loss. * Ph.D.

Multilevel-marketing companies like LuLaRoe are forcing people into debt and psychological crisis 8/6/17 Quartz Alden Wicker © Provided by Quartz Instagram Photo “I was urged to stop paying my bills to invest in more inventory. I was urged to get rid of television. I was urged to pawn my vehicle. I just had to get on anxiety meds over all of it because I’ve started having panic attacks.” In June 2016, Sophie (name changed) quit her job in the suburbs of Fort Worth, Texas, to sell for LuLaRoe, a rapidly growing clothing company that offers self-employment opportunities to American women in the form of hawking hyper-hued apparel. LuLaRoe’s consultants told her—and tens of thousands of other mostly rural and suburban women over the past five years—that she could provide for her family, join a sisterhood of supportive women, and find meaning in her life again through the conduit of colorful, stretchy fashion—all for a reasonable upfront investment of around $5,000. As economic opportunity has become more concentrated in urban areas in the U S , rural communities have fallen behind. Residents of towns like Casper (Wyoming), Spring Creek (Nevada), and DeRidder (Louisiana) all missed out on economic recovery following the 2007 global financial crisis. Bootstrapping, hard-working families in these regions are urgently searching for a way to regain their economic liberty, along with their dignity. Fed the fantasy of achieving the all-elusive American dream, many of them are being wooed by multilevel- marketing companies. Known as MLMs (or “direct-sales”), the current US administration is stocked with their cheerleaders: Betsy DeVos, the secretary of education, is married to a co-founder of Amway; Ben Carson is a spokesperson for a vitamin MLM called Mannatech; and president Donald Trump used to have an MLM, Trump Network, and was a spokesperson for another .

  • Institutions, the Social Capital Structure, and Multilevel Marketing Companies
Journal of Institutional Economics (2021), 17,53–70 doi:10.1017/S1744137420000284 RESEARCH ARTICLE Institutions, the social capital structure, and multilevel marketing companies Jordan K. Lofthouse1* and Virgil Henry Storr2 1The Mercatus Center at George Mason University, Arlington, Virginia, USA and 2Department of Economics, George Mason University, Fairfax, Virginia, USA *Corresponding author. Email: [email protected] (Received 12 January 2020; revised 14 May 2020; accepted 16 May 2020; first published online 14 July 2020) Abstract In multilevel marketing companies (MLMs), member-distributors earn income from selling products and recruiting new members. Successful MLMs require a social capital structure where members can access and mobilize both strong and weak social ties. Utah has a disproportionate share of MLM companies located in the state and a disproportionate number of MLM participants. We argue that Utah’s dominant religious institutions have led to the emergence of a social capital structure, making MLMs particularly viable. Utah is the most religiously homogeneous state; roughly half its population identifies as members of the Church of Jesus Christ of Latter-day Saints (LDS Church). The LDS Church’s institutions foster a social capital structure where (almost all) members have access to and can leverage social capital in all its forms. LDS institutions encourage members to make meaningful social connections characterized by trust and reciprocity with other church members in local neighborhoods and across the world. Key words: Social capital; multilevel marketing; network marketing; Mormon church; LDS church; MLM 1. Introduction In multilevel marketing companies (MLMs), also known as network marketing or direct selling, member-distributors earn income both from selling products and recruiting new members (Liu, 2018; Sparks and Schenk, 2001).
