island of Palmas case: mere proximity was not an adequate claim to land Island of Palmas Case, (Scott, Hague Court Reports 2d 83 (1932), (Perm. Ct. Arb. 1928), 2 U.N. Rep. Intl. Arb. Awards 829), was a case involving a territorial dispute over the Island of Palmas (or Miangas) between the Netherlands and the United States which was heard by the Permanent Court of Arbitration. The Island of Palmas (known as Pulau Miangas in Bahasa Indonesian) is now within Indonesian sovereignty. This case is one of the most highly influential precedents dealing with island territorial conflicts. Facts of the case Palmas, also referred to as Miangas, is an island of little economic value or strategic location. It is two miles in length, three-quarters of a mile in width, and had a population of about 750 when the decision of the arbitrator was handed down. The island is located between Mindanao, Philippines and the northern most island, known as Nanusa, of what was the former Netherlands East Indies. In 1898, Spain ceded the Philippines to the United States in the Treaty of Paris (1898) and Palmas sat within the boundaries of that cession to the U.S. In 1906, the United States discovered that the Netherlands also claimed sovereignty over the island, and the two parties agreed to submit to binding arbitration by the Permanent Court of Arbitration. On January 23, 1925, the two government signed an agreement to that effect. Ratifications were exchanged in Washington on April 1, 1925. The agreement was registered in League of Nations Treaty Series on May 19, 1925.[1] The arbitrator in the case was Max Huber, a Swiss national. -

Various efforts were made by the Government of Indonesia to provide a territorial comprehension in order to make the younger generation understand about the circumstances of their country. One effective way is through Territorial Atlas of The Republic of Indonesia, which is the result from collaboration project between Geospatial Information Agency and Ministry of Education and Culture of Indonesia. This atlas is intended towards the benefit of teenage children, who are taking middle education level between the ages of 12-15 years. It is necessary for children at that age to be equipped with spatial intelligence related to the territorial comprehension of Indonesia, the historical development of the Republic of Indonesia, and also the natural resources potential of their country. This comprehension is needed considering that adolescence is a vulnerable age who require self-actualization, so they need to get a correct understanding of the NKRI region in order to foster the sense of nationalism. -

However, it is rarely used by managers of ecotourism and urban green spaces. Importance-Performance Analysis (IPA) was adopted from a destination perspective to understand industry demand. This study explores the visitors’ satisfaction level on ecotourism attributes i.e. attraction, urban green spaces and accessibility that affect tourist satisfaction towards Kota Kinabalu, Sabah, Malaysia using IPA scheme. A total of 384 tourists to Kota Kinabalu were provided with a list of environmental features and asked to rate the importance of and satisfaction with each attribute. IPA was performed to compare mean scores and identify areas of concern. The analysis identified eight (8) attributes which were applauded with excellent performance on highly important features and should maintain its competitiveness as a tourist destination. Six (6) attributes resulted under the poor performance on an extremely important category; indicates the areas that should be given improvement interventions, while four (4) attributes were identified as possible overkill that implies divergences of resources elsewhere are needed. -

General 1.1 Before 1 January 1949, the principal form of nationality was British subject status, which was obtained by virtue of a connection with a place within the Crown's dominions. On and after this date, the main form of nationality was citizenship of the UK and Colonies, which was obtained by virtue of a connection with a place within the UK and Colonies. 2. Meaning of the expression 2.1 On 1 January 1949, all the territories within the Crown's dominions came within the UK and Colonies except for the Dominions of Canada, Australia, New Zealand, South Africa, Newfoundland, India, Pakistan and Ceylon (see "DOMINIONS") and Southern Rhodesia, which were identified by s.1(3) of the BNA 1948 as independent Commonwealth countries. Section 32(1) of the 1948 Act defined "colony" as excluding any such country. Also excluded from the UK and Colonies was Southern Ireland, although it was not an independent Commonwealth country. 2.2 For the purposes of the BNA 1948, the UK included Northern Ireland and, as of 10 February 1972, the Island of Rockall, but excluded the Channel Islands and Isle of Man which, under s.32(1), were colonies. 2.3 The significance of a territory which came within the UK and Colonies was, of course, that by virtue of a connection with such a territory a person could become a CUKC. Persons who, prior to 1 January 1949, had become British subjects by birth, naturalisation, annexation or descent as a result of a connection with a territory which, on that date, came within the UK and Colonies were automatically re- classified as CUKCs (s.12(1)-(2)). -

Increased access to previously remote tropical for- est following logging and changes in land-use facilitates hunting of elusive wild cattle in Borneo, which preferentially select secluded habitat. We collated the first population parameters for the Endangered Bornean banteng Bos javanicus lowi and developed population models to simulate the effect of different hunting offtake rates on survival and the recovery of the population using reintroduced captive-bred individuals. Our findings suggest that the banteng population in Sabah is geographically divided into 4 management units based on connectivity: the Northeast, Sipitang (West), Central and Southeast, which all require active management to prevent further population decline and local extinction. -
The Case of Dokdo
Resolution of Territorial Disputes in East Asia: The Case of Dokdo Laurent Mayali & John Yoo* This Article seeks to contribute to solving of the Korea-Japan territorial dispute over Dokdo island (Korea)/Takeshima (Japanese). The Republic of Korea argues that Dokdo has formed a part of Korea since as early as 512 C.E.; as Korea currently exercises control over the island, its claim to discovery would appear to fulfill the legal test for possession of territory. Conversely, the Japanese government claims that Korea never exercised sufficient sovereignty over Dokdo. Japan claims that the island remained terra nullius—in other words, territory not possessed by any nation and so could be claimed—until it annexed Dokdo in 1905. Japan also claims that in the 1951 peace treaty ending World War II, the Allies did not include Dokdo in the list of islands taken from Japan, which implies that Japan retained the island in the postwar settlement. This article makes three contributions. First, it brings forward evidence from the maps held at various archives in the United States and Western Europe to determine the historical opinions of experts and governments about the possession of Dokdo. Second, it clarifies the factors that have guided international tribunals in their resolution of earlier disputes involving islands and maritime territory. Third, it shows how the claim of terra nullius has little legitimate authority when applied to East Asia, an area where empires, kingdoms, and nation-states had long exercised control over territory. * Laurent Mayali is the Lloyd M. The president, vice president, the first chamber of the Philippines. parliament (House of Representatives), half of the 24 senators (second chamber of parliament), the governors of the 80 provinces, and the mayors and council members of the cities and municipalities of the country were elected into office. Presidential elections take place every six years in a political system that is broadly modeled on the political system of its former American colonial ruling power. The presidential elections represent a decisive point in Filipino politics for the following reasons. Different than in the United States, the extraordinarily powerful president cannot run for a second term and political parties do not play an important role in the country’s entirely person- alized election system. Situation before the electionS In 2001, Vice President Gloria Macapagal Arroyo (“GMA”) became president following a national uprising by the middle-class in the greater Manila area. With the strong support of the church, the uprising was led against corrupt President Joseph Estrada, a popular actor among the poor population. GMA, an economist hailing from one of the wealthiest families in the country, was highly respected. She was generally thought capable of building on the successful presidency of Fidel V. Ramos. During his six years in office between 1992 and 1998, Ramos was able to stabilize the democracy, which had only been reinstated in 1986 after the end of the Marcos dictatorship, and give the country an economic upswing through his bold reforms. -

INTERNATIONAL COURT OF JUSTICE CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN OBSERVATIONS OF MALAYSIA ON THE APPLICATION FOR PERMISSION TO INTERVENE BY THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES 2 MAY 2001 CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN (INDONESIA/MALAYSIA) Written Observations of Malaysia on the Application for permission to intervene by the Government of the Republic of the Phiiippines Introduction 1. These written observations are made by Malaysia in response to the Registrar's letter of 14 March 2001. 2. To summarize, Malaysia categorically rejects any attempt of the Philippines to concern itself with a territorial dispute involving two small islands off the coast of Sabah (formerly North Bomeo). The subject of the dispute between Indonesia and Malaysia is not Malaysia's sovereignty over the State of Sabah (which sovereignty Indonesia explicitly accepts and recognises). It is solely the question of title to two small islands off Semporna, Malaysia. Indonesia's claim is based on an interpretation of Article TV of the Convention of 1891 between Great Britain and the Netherlands. Spain had previously expressly recognised British title over the territory which was the subject of the 1891 Convention, by Article IJJ of the Protocol of 1885.' The Philippines can have no greater rights than Spain had. The interpretation of the 1891 Convention is thus a matter exclusively between Indonesia and Malaysia, in which the Philippines can have no legal interest. Nor does the Philippines have any legal interest in the subject matter of the specific dispute submitted to the Court by the Special Agreement.
