Introduction 2 INTRODUCTION In 1999 the U.S. Congress directed the National Park Service to conduct a multi-state study of civil rights sites to determine the national significance of the sites and the appropriateness of including them in the National Park System. To determine how best to proceed, the National Park Service partnered with the Organization of American Historians to develop an overview of civil rights history entitled, Civil Rights in America: A Framework for Identifying Significant Sites (2002, rev. 2008). The framework concluded that while a number of civil rights sites had been designated as National Historic Landmarks, other sites needed to be identified and evaluated. Taking this into account, the framework recommended that a National Historic Landmarks theme study be prepared to identify sites that may be nationally significant, and that the study be based on provisions of the 1960s civil rights acts. These include the Civil Rights Act of 1964 (covering voting rights, equal employment, public accommodations, and school desegregation enforcement), the Voting Rights Act of 1965, and the Fair Housing Act of 1968. This specific portion of the study focuses on the aspect of public accommodations.1 Inclusion in the National Park System first requires that properties meet the National Historic Landmark criteria, and then meet additional tests of suitability and feasibility. To establish guidance on meeting landmark criteria, this study provides a historic context within which properties may be evaluated for their significance in civil rights and establishes registration guidelines for National Historic Landmark consideration. Completion of this study will also assist in the identification of sites for National Historic Landmark evaluation. Public Accommodations Overview The physical separation of the races in public accommodations was a resented and demeaning practice for those denied equal access. Segregation in theaters, restaurants, hotels, and buses was a constant irritant in everyday life and an insulting inconvenience. It resulted in direct confrontations between racial minorities claiming the right to pay for goods and services in the marketplace, and white business owners who claimed the right to serve whom they chose. Overall, the civil rights movement forced federal intervention that destroyed the legal foundations of racism and transformed race relations in the nation, particularly the South. The resulting 1964 Civil Rights Act “was a landmark in legislative attempts to improve the quality of life for African Americans and other minority groups.” Title II of the act “[o]utlawed discrimination in hotels, motels, restaurants, theaters, and all other public accommodations engaged in interstate commerce.”2 A thorough study of desegregation of public accommodations requires an initial understanding of how racial segregation has operated in the United States. Segregation did not occur uniformly throughout the United States, and the form and content of this practice changed over time. Variations in this practice had much to do with the places in which they occurred and the groups involved. Introduction 3 that the denial of equal access to public accommodations to a group or groups had much to do with the common experience of being labeled nonwhite, and therefore not worthy of equal access on racial grounds. What made each group nonwhite differed from place to place, but the fact that these beliefs applied to various groups in different locations throughout the nation over many years is a testament to the ways in which race has shaped our society. State laws, local ordinances, and customs that segregated whites and blacks were also applied to other minorities. To represent this aspect, this study expands beyond the African American story to include the Hispanic and Asian American stories. Of special note in documenting the Hispanic experience in discrimination is the level of documentation available in the area of public accommodation segregation and desegregation as compared to other areas of discrimination. Quite simply, their lives too closely resembled the status quo antebellum. Indeed, African Americans remained landless, lacked ownership of the fruits of their labor, lost the vote (through elec- toral fraud and discriminatory changes to state constitutions) shortly after they had received it, and were subject to vicious, vulgar, and random acts of racial terrorism as a result of the federal government being more interested in protecting the southern economy than in protecting black folk. In response, African Americans organized to implement their vision of freedom, which differed substantially from that of white southerners and white northerners. By agitating for their civil and human rights, especially for good-quality education, political participation, personal safety, and control of their own labor, the former slaves launched the fight for racial justice that continues to this day (Harding 1981). The most important link in this intergenerational struggle is the modern Civil Rights Movement. It represents the most highly organized manifestation of African Americans’ post-emancipation search for a new freedom and, if measured narrowly in legislative terms, the most successful. Popular interest in the Civil Rights Movement has swelled during the last two decades. Evidence of this trend is the surge in the number of feature-length films that explore aspects and events of the civil rights era, such as Freedom Song and Boycott.

Rosa Parks of Montgomery, Alabama, refused to give up her seat to a white bus rider, thereby defying a southern custom that required blacks to give seats toward the front of buses to whites. When she was jailed, a black community boycott of the city's buses began. The boycott lasted more than a year, demonstrating the unity and determination of black residents and inspiring blacks elsewhere. Martin Luther King, Jr., who emerged as the boycott movement's most effective leader, possessed unique conciliatory and oratorical skills. He understood the larger significance of the boycott and quickly realized that the nonviolent tactics used by the Indian nationalist Mahatma Gandhi could be used by southern blacks. "I had come to see early that the Christian doctrine of love operating through the Gandhian method of nonviolence was one of the most potent weapons available to the Negro in his struggle for freedom," he explained. Although Parks and King were members of the NAACP, the Montgomery movement led to the creation in 1957 of a new regional organization, the clergy-led Southern Christian Leadership Conference (SCLC) with King as its president. King remained the major spokesperson for black aspirations, but, as in Montgomery, little-known individuals initiated most subsequent black movements. On February 1, 1960, four freshmen at North Carolina Agricultural and Technical College began a wave of student sit-ins designed to end segregation at southern lunch counters.

Abstract National measures of student achievement, such as the National Assessment of Educational Progress (NAEP), provide evidence of the gap in success between African- American and white students. Despite national calls for increased school accountability and focus on achievement gaps, many African-American children continue to struggle in school academically, as compared to their white peers. Ladson-Billings (2006) argues that a deeper understanding of the legacy of disparity in funding for schools serving primarily African- American students, shutting out African-American parents from civic participation, and unfair treatment of African-Americans despite their contributions to the United States is necessary to complicate the discourse about African-American student performance. The deficit model that uses student snapshots of achievement such as the NAEP and other national assessments to explain the achievement gap suggests that there is something wrong with African-American children.     Building Racial Bridges: Why We Can’t Wait by Martin Luther King, Jr. February 2, 2016 Discussion led by Collin College Professor Michael Phillips Background information: “Jim Crow” was a character in the minstrel shows where white entertainers would blacken their faces and perform satirical reviews of current events as if they were African Americans. The Jim Crow Laws came to set the boundaries of segregation. Racial separation rose after slavery and became legal in the 1880’s. At that time poor whites had the distinction of never being someone’s property, bought or sold, or families separated. With the 13th (abolishing slavery), 14th (giving blacks citizenship), and 15th (giving blacks voting rights) amendments being passed, poor whites became discontent. They had no distinctive rights over the Negro. Populism, a radical movement working for justice and equal rights for all, rose in the 1880’s and ‘90’s. It involved the support of both black and white farmers working together toward economic justice and represented a threat to the Southern economic power structure. Two types of segregation: De jure – by law, evident in the South (separate schools, doors for public places, separate Bibles for swearing in, even the emergency blood supply, black women not allowed to try on or even touch clothes before purchase) De facto – practiced in the North (understood parameters, cultural, redlining in which banks and realtors would keep people of color out of certain neighborhoods) Populist Movement collapsed in 1896 with the re-establishing of segregation laws. 1919 Red Summer – labeled for the volume of blood shed, whites attacking blacks.

    BIRMINGHAM PUBLIC LIBRARY Department of Archives and Manuscripts Connor, Theophilus Eugene 'Bull' Papers, 1951, 1957-1963 Background: Theophilus Eugene Connor was born in Dallas County, Alabama in 1897. Trained as a telegraph operator, Connor settled in Birmingham in the 1920s and worked as a radio sports announcer. Capitalizing on his popularity with radio listeners and his well-known nickname (,Bull'), Connor entered politics in 1934 and was elected to the Alabama House of Representatives. Connor was elected Public Safety Commissioner of Birmingham in 1937, a position that gave him administrative authority over the city's police and fire departments, public schools, public health and the public libraries. He held this position until 1954, and held the position again from 1958 to 1963 when he was forced from office by a change in the city form of government. During his long political career Connor ran two unsuccessful campaigns for governor of Alabama and was a leader of the 1948 Dixiecrat revolt. From 1964 to 1973 he served as President of the Alabama Public Service Commission, the state agency that regulates public utilities. Connor died in Birmingham in 1973. Eugene 'Bull' Connor is most famous for his staunch defense of racial segregation and for ordering the use of police dogs and fire hoses to disperse civil rights demonstrators in Birmingham during the spring of 1963. Scope and Content: These papers, which consist of letters, memoranda, clippings, photographs, and reports are the office files kept by Connor during his last five years as Commissioner of Public Safety. The papers from Connor's earlier terms were destroyed when he left office in 1954.

Organizations and individuals throughout the United States called for racial justice and for the termination of segregation in the South. A group that had a significant impact on the outcome of the Civil Rights movement in Birmingham, Alabama was young children. In Birmingham, the local coalition began to call for children to march in protests in place of their parents. So, if arrests were to transpire, less economic stress would occur because adults could still be working and making an income. From May 2nd to May 7th, 1963, over 2,000 children marched across Birmingham, Alabama to nonviolently protest racial inequality in their city. Children’s involvement in the 1960s civil rights protests in Birmingham was critical to a successful outcome in the movement.
