It sets out the developments in the various cases during the course of the year and the position taken by the governing bodies in respect of claims. The Report is not intended to reflect in full the discussions of the governing bodies. These discussions are reflected in the Records of Decisions of the meetings of these bodies, which are available on the IOPC Funds’ document server which can be accessed through the Fund’s website (www.iopcfund.org). The Supplementary Fund was not involved in any incidents during 2010. LAWRENCE SNOW CRAB CONSERVATION HARVESTING PLAN CRAB FISHING AREA 12 (12, 18, 25, 26) Moncton and Quebec – April 5, 2019 Fisheries and Oceans Canada (DFO) releases the details of the 2019 Crab Fishing Area (CFA) 12 (12, 18, 25, 26) Conservation Harvesting Plan. Quota The Total Allowable Catch (TAC) in CFA 12 is 27,905.51 t. Details of the sharing of the TAC can be found in the CFA 12 Snow Crab administrative list. Quota reconciliation Quota reconciliation is applied in this fishery. Quota overruns during the 2019 season by a licence holder will be deducted in 2020 on a one-for-one basis. It is the responsibility of the licence holder to respect the allocation granted while taking into consideration transfers and landings and has to make the necessary arrangements before departing for a fishing expedition to have quota to cover expected catches for the expedition. Temporary transfers Licence holders who are subject to the owner-operator policy may transfer up to 50% of his or her initial quota on a temporary basis, within one fishing season. At-Sea observer coverage At-sea observer coverage representing 20% of fishing trips will be required for 2019. Partnership arrangements The creation of partnerships will be permitted. The trap limit for partnerships will be equal to the total traps of one licence, plus 50%. 2019 Management measures The management measures in 2019 include, amongst others: The soft-shell crab protocol. Only one valid annual tag per trap. Tags from previous years must be removed.

The underwriters denied liability. They took the position that the Irving Group were not liable, or, if they were, their liability was not covered by the policies. The limit on liability coverage was $5 million. The Federal Court was satisfied that one or more of the Irving Group would have been found liable in public nuisance to an amount in excess of $5 million.

He holds a Bachelor's degree in Geography from the University of Toronto and has over 40 years of experience in bridging science with successful policy outcomes on such diverse subject areas as Great Lakes water quality, acid rain and persistent organic pollutants in the Arctic. He has also been directly responsible for projects such as the successful raising of the oil laden barge, the Irving Whale from the Gulf of St. Lawrence and the clean-up of the Sydney Tar Ponds. He has during his career managed Environment Canada's national water research institutes and the department's diverse programs in the Atlantic Region. He has also effectively led Canada's participation in a number of International initiatives including the first ever seven nation Circumpolar Agreement to protect the arctic environment. This agreement also set a precedent for the engagement of northern Indigenous peoples. He co-championed the development and implementation of the Nova Scotia Sustainable Communities program, which involved 37 agencies and four levels of government and won the Institute of Public Administration of Canada's Silver Medal for "Innovation in Horizontal Management in Government". Wes Foote Mr. Foote is the former Assistant Deputy Minister (ADM) of Petroleum Development with the Government of Newfoundland and Labrador. Wes is an engineering professional/consultant with over 30 years’ experience in diverse engineering roles. In his ADM role with the provincial government, he was responsible for leading a team that provided technical expertise to allow government to make informed decisions related to offshore and onshore oil and gas developments in the province as well as marketing the oil and gas potential/prospectivity.

(February 12, 1999) No. 94-CQ-56261 (Ont. Ct. Gen. Div.) In this matter the Plaintiff claimed under an all risks marine policy for damage caused to a sailboat by the accumulation of water in the interior of the vessel. The damage to the sailboat occurred during the period from 1990 to 1993. The assured put the vessel into storage at the end of the summer in 1990 and left it in storage until October 1993 when it was discovered to be full of water. The accumulation of water had rendered the vessel a constructive total loss. The insurer denied coverage on the basis that there was wilful misconduct on the part of the assured, that the Plaintiff "courted the risk" and that the damage was caused by wear and tear, an excepted peril under the policy. There was conflicting evidence as to whether the assured periodically inspected the vessel while it was in storage.
