“ And in this undertaking, the Reader may see what Furniture (though it lie disperst) our Publick Records will afford for History: and how plentifully our own may be supplied and improved, if pains were taken therein : for what is hitherto made publick, hath been collected, chiefly out of old Annals, and they filled with few things but such as were very obvious, nay the Annalists themselves (for the most part residing in Monasteries) too oftened byass d with Interest, and Affection, to Times and Persons: But on the contrary, in our publick Records lye matter of Fact, in full Truth, and therewith the Chronological part, carried on, even to days of the Month. So that an industrious Searcher may thence collect considerable matter for new History, rectifie many mistakes in our old and in both gratifie the world with unshadowed verity.”— (Ashm ole's History of the Garter.)

1. The First Register of Bishop , 1358-1385. Studies PREFACE. Staffordshire

T h i s volume completes the records of Episcopal acts from the death of Bishop Roger de Northburgh in 1358 to the death of Bishop Robert de Stretton in 1385. I particularly wish to draw attention to the slip issued with this volume, containing further Addenda et Corrigenda for Book V. I am indebted for the correction of my many mistakes in Shrewsbury topographySample to aCounty paper 011 the Will of Thomas Gamel, in the Transactions o f the Shropshire Archceological and Natural History Society for 1906, to which reference should be made. A paper on Bishop Robert de Stretton, read by the Rev. W. G. D. Fletcher before the Architectural and Archaeological Society in 1887, and published Studies in the Associated Architectural Societies'1 Report, gives a much fuller account of the Bishop than that in the other volume, and an abstract of his will. I feel that the Introduction needs some apology. It is little more than an attempt to collect from the Register some par ticulars bearing upon the ecclesiastical organization of the period. I shall be grateful for corrections, criticisms, and suggestions for the improvement of these abstracts, as it is more than likely that I have not always hit the mark. R. A . W.

No complete survey of the ancient diocese is possible until the Registers of the whole period have been digested, as well as the Chapter Act Books and Papal Registers. The two volumes published are limited to a period of 27 years and to the Bishop’s jurisdiction. Peculiars and Donatives do not appear. It would therefore be premature to attempt more than a few notes on matters with which this volume is concerned.

T he REGISTER consists of one hundred and thirteen parch ment leaves, bound in sheep. The first seven leaves measure about 11J by 8b inches, the rest about 14^ by 11 inches. It is well written and in good preservation. It is chiefly a record of institutions to benefices. These include Abbacies and Priories, Deaneries and Prebends in vi INTRODUCTION.

Cathedral1 and Collegiate Churches, Archdeaconries, Rectories, Vicarages, Chapels, Chantries, Hospitals and Inclusories.

INSTITUTION (called Collation when the Ordinary is also patron) is the act by which a Bishop, or other Ordinary, commits a cure to a clerk. The procedure was substantially the same as at present. The clerk appeared, in person or by proxy, before the Bishop,Staffordshire or his commissary, and, if everything was in order— deed of presentation, orders, age and character— was admitted, and, having taken the oath of canonical obedience to the Bishop,2 and of residence3—if, as in the case of vicarages or chantries, residence was required,— was instituted : the sign used being sometimes the handing of the Bishop’s biretta,4 or a ring.5 The Bishop then issued a mandate to the Archdeacon or his official0 for induction into actual possession of the benefice.

The process of IN D U C TIO N is not described in this register, except that of the ArchdeaconSample Countyof Stafford, who was taken to the church of Stowe, and inducted by the handing or showing of the ornaments of the church, the chaplain and ministers thereof swearing obedience to him.7

The QUALIFICATIONS for a benefice depended on its nature. Orders.-—A chantry, of course, necessitatedStudies priests’ orders.8 The same rule obtained in the case of Vicarages, though in two instances men were instituted as . One of them was ordained priest a week later,0 and the other is a priest next time he appears in the register.10 Rectors were not generally required

1 The Cathedral of Coventry was monastic, with a Prior and Convent in place of Dean and Chapter. 2 Printed Obedience for short. 3 Printed Residence for short. 4 By the of York, see pp. 76, 107, 110. 0 By the Bishop of S. Asaph, see p. 208. 0 Printed Mandate for short. In the case of benefices not within the Archdeacon I jurisdiction, such as Religious Houses, Cathedral and Collegiated Churches, Free Chapels, etc., the mandate for induction was issued to some other proper person. 7 See pp. 140, 150. . 8 There is a seeming exception on p. 222 ; but R. Colet was warden, not chanter. 9 R. de Swanlowe to Froddesham, see p. 176, and Book V, p. 283. 10 T. de Wynterton to Market Drayton, see pp. 206 and 146. INTRODUCTION. vii to reside,1 and first tonsure qualified them, though they were, supposed to be in full orders, and might be required to proceed to them within a year of their institution. The of Lawton was deprived because he did not do so.2 It is evident that the majority of Rectors were priests. For Prebends nothing beyond clerkship was exacted, and residence was not required. And here it may be observed, that the designation clerk varies in meaningStaffordshire according to the context. The common significance Is a clergyman, as distinguished from a I a) man, but in records of institutions it may be taken to mean one who is not in , as distinguished from a priest, or sub-deacon.s Age.— It is stated that sundry presentees were of full age, but beyond this there are no particulars as to the observance, or non-observance, of the canons in this respect; save only in the case of the Lady Matilda Botetourt, who petitioned to be admitted of Polesvvorth in spite of her defect of age— she was twenty— and, asSample her petitionCounty was backed by the Ki ig, the Bishop authorised the necessary dispensation.4 Condition.-—There is one instance of voidance by marriage. John dc Scholhall, priest of the chantry of Road by Tarporley and incumbent of Haslingden free chapel, contracted matrimony and solemnized it with a certain MargaretStudies de London, widow'.5 Other qualifications will best be shown by a typical inquisition. W hen a benefice was vacant, the Bishop sometimes ordered the Official of the Archdeacon to make an enquiry." This he did by summoning the chapter of the (Rural) Deanery, and taking the

1 The Rector of Truslcy was deprived for absence, or rather for neglect to serve the cure, see p. 27. Also the rector of the chapel of Preston Wealdmoors, see p. 196. Residence was obligatory for the Rector o f Boyton, Sarnm dio., see p. 155* 2 See p. 180. The Rector of Morley was dispensed from proceeding further than the subdiaconate during a year of absence, see p. 73. T. de Newport, clerk, inst. to Build was, Nov. 1366 (see p. 199). Ordained subdeacon, March 1367 (see Book V, p. 207). Slvled subdeacon, July, 1367 (see P. 199). 4 See p. 28. 5 See p. 164. u When an exchange was carried out before the bishop of another diocese, an inquisition was invariably taken and sent to him. It may have been part of the usual procedure, but it does not seem to have been. In many cases the shortness of the vacancy scarcely allows time for it. INTRODUCTION. X lll benefices, but this was only about a fifth of the expenses of his household; and Walter de Campeden, Chancellor of the Duke of Lancaster, got £83 from his four. Otherwise, incomes range from £ 6 15^. to .£40, averaging about £22 ; no very large sum, seeing that the stipends of vicars or chaplains would often have to be found. No doubt the returns of other dioceses would show benefices in this diocese held by men residing outside it, but theStaffordshire general conclusion would appear to be that pluralism was not then a crying abuse.
