O R D E R Sri Mathangi Yesubabu, Suryapet District has filed 2nd appeal dated 06-06-2018 which was received by this Commission on 12-06-2018 for not getting the information sought by him from the PIO / O/o the Mandal Parishad Development Officer, MPP-Nelakondapalli Mandal, Khammam District PIO / The Panchayat Secretary, Nelakondapalli Village, Nelakondapalli Mandal, Khammam District and 1st Appellate Authority / The Mandal Parishad Development Officer, MPP- Nelakondapalli Mandal, Khammam District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 07-03-2018 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: TSIC The Public Information Officer / O/o the Mandal Parishad Development Officer, MPP- Nelakondapalli Mandal, Khammam District, Vide Letter No. RTI/53/EORD/2018, Dated 17-03- 2018, has transferred the 6(1) application to all the Panchayat Secretarys in the Nelakondapalli Mandal. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 10-04-2018 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. Note: This is system generated copy and no signature is required. As per the records the 1st Appellate Authority has not taken action to hear the appeal and pass appropriate orders. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 20-9-2019. On 20-9-2019 the case is called. The appellant and the Public Information Officer, O/o the MPDO, MPP-Nelakondapalli Mandal are absent. The Public Information Officer, Panchayath Secretary, Nelakondapalli Village Gram Panchayath is present. The First Appellate Authority, MPDO through letter dated 19.09.2019 requested for leave of absence due to ill health and deputed the Typist, O/o the MPDO to attend the hearing. The Public Information Officer submitted that through letter dated 11.04.2018 the appellant was permitted for inspection of records on any of the three dates i.e., from 19.04.2018 to 21.04.2018 but the appellant did not avail the opportunity. Heard the Public Information Officer and perused the records. The Commission directs the PIO to once again call the appellant for inspection of records on a mutually convenient date and thereafter furnish required information to him. The Public Information Officer shall comply with the above directions within two weeks from the date of receipt of this order and submit compliance report to the Commission. With the above direction, the appeal is closed.
