First Appellate Authority (U/RTI Act, 2005) The Joint Collector, O/o the District Collector, Suryapet District. Order Sri. Kanagala Janardhan Rao, Nalgonda District has filed an appeal dated 13-11-2015 which was received by this Commission on 17-11-2015 for not getting the information sought by him from the PIO / the Revenue Divisional Officer, Nalgonda District and the First Appellate Authority / the Joint Collector, O/o the District Collector, Nalgonda District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application u/s 6(1) of the RTI Act, 2005 dated 23-05-2015 before the PIO requesting to furnish the below information: The PIO / Town Planning Officer, O/o the Municipal Commissioner, Kodad Municipal Corporation through letter no: G1/267/2015 dated 07-03-2015 informed to the PIO / Mandal Praja Parishad, Kodad that the information sought is available with them only. Stating that the PIO did not furnish the information, he filed 1st appeal dated 06-07-2015 before the First Appellate Authority requesting to furnish the information sought. The First Appellate Authority / District Pachayath Officer, Nalgonda District through letter no: 2515/2015/B6 dated; 27-07-2015 transferred the applications to the PIO / Manager, Kodad Municipal Corporation, Suryapet District and to the First Appellate Authority / O/o the Municipal Commissioner, Kodad Municipal Corporation, Suryapet District with a request to furnish the information directly to the appellant. Stating that he did get any information, he preferred this appeal before this Commission requesting to arrange to furnish the information sought. The case is called on 10-05-2018. The appellant Sri. K. Janardhan Rao is present and stated that the PIO did not furnish the information for all the points sought by him. The PIO / Sri. TL. Ramesh Kumar, Town Planning Officer, O/o the Municipal Commissioner, Kodad Municipal Corporation, Suryapet District was present and stated that through letter no: G1/267/2015 dated 07-03-2015 the PIO / Mandal Praja Parishad, Kodad, Suryapet District was informed that the information sought is available with them only. The First Appellate Authority / District Pachayath Officer, Nalgonda District through letter no: 2515/2015/B6 dated; 27-07-2015 transferred the applications to the PIO / Manager, Kodad Municipal Corporation, Suryapet District and the First Appellate Authority / O/o the Municipal Commissioner, Kodad Municipal Corporation, Suryapet District with a request to furnish the information directly to the appellant. The 6(1) application dated 23-05-2015 was originally filed before the District Revenue Officer, Collectorate, Nalgonda District and 1st appeal dated 06-07-2015 was filed before the Joint Collector, Nalgonda District by the appellant. The Collector, Nalgonda District through letter dated 08-06-2015 transferred the application to the District Panchayath Officer, Nalgonda District who in turn transferred the said application dated 27-07-2015 to the PIO / Manager, Kodad Municipal Corporation, Suryapet District. The Town Planning Officer, O/o the Municipal Commissioner, Kodad Municipal Corporation, Suryapet District through affidavit stated that as the information sought was not available, the MPDO, Kodad was asked to take necessary action. The 6(1) application dated 23-05-2015 filed under RTI Act is verified. In the said application the appellant requested the Collector, Nalgonda District to furnish the information which was collected from the Extension Officer, Kodad, Suryapet District relating to 300 yards land of Sy. No: 1043/A, 1043/A2, 1043/E1 & 1043/A4 and whether the said 300 yds was given to Rebba Hanumayamma and is it been registered on the name of Rebba Hanumayamma. The Revenue Divisional Officer, Kodad through letter no: F/44/2018 dated 09-01-2018 requested the Commission to give 1 month time to furnish the information sought by the appellant. Hence in view of the facts submitted by the Revenue Divisional Officer, the Revenue Divisional Officer, Kodad, Suryapet District and the PIO / O/o the Municipal Commissioner, Kodad Municipal Corporation, Suryapet District are directed to furnish the information to the appellant sought through application dated 23-05-2015 with 30 days of receipt of this order under intimation to this Commission.
