MINERAL POTENTIAL ASSESSMENT REPORT

1. INTRODUCTION

1.1 Background Information

1.1.1 TerraConsult Limited was commissioned by J10 Planning Limited on behalf of Wholebake Limited to carry out an assessment of mineral potential prior to the development of a (relocated) food manufacturing industrial unit (with ancillary staff gym) at Ty’n Y Llldlart Industrial Estate in Corwen, Denbighshire. The purpose of this report is to provide information to positively address and meet the requirements of the Minerals Policy PSE15 in the Denbighshire Local Development Plan (LDP).

1.2. Development Proposals

1.1.2 Wholebake Ltd (WBL) propose to construct a new purpose built industrial unit and associated hard standing for the production and distribution of baked products in Corwen, Denbighshire. In addition, staff facilities are also proposed which include an employee wellbeing unit and habitat garden.

1.1.3 The currently proposed unit is to be a two storey portal framed building some 170m by 68m in size. External works include loading and delivery areas, staff car park, ecological and landscaping areas, and staff wellbeing facilities.

1.3. Planning Status & Requirements

1.1.4 Wholebake Ltd (WBL) is seeking planning permission for the development outlined above. This report is designed to support the application with regards to providing a statement on the potential impact of the development on a portion of the site area which has a mineral safeguarding planning designation under Policy PSE15 of the Denbighshire Local Development Plan (LDP).

1.1.5 The part of the development which infringes on the mineral safeguarding area includes the south easterly 35m portion of the main building (approximately 20% of the total length), an employee wellbeing unit (30m x 20m), car parking for 168 cars and a habitat garden. In approximated percentage terms the proportions of the minerals safeguarding area under these different land uses are as follows:

 Main building – 10%  Employee wellbeing unit – 5%  Car parking and roadways – 25%  Habitat Garden – 60%

1.1.6 A very small proportion of the safeguarding area will be under buildings (approximately 15%), whereas the majority (approximately 85%) of the area will be under habitat and

landscape areas (approximately 60%) and open air car parking with landscaping (approximately 25%).

1.5. Previous Investigations

1.5.1 A Phase 1 desk study report has been produced by Groundsolve Ltd which is supported by a ground investigation report which details the findings of the trial pitting investigation carried out in October 2016.

2. SITE LOCATION AND DESCRIPTION

2.1 Site Location

2.1.1 The site is indicated in Figure 1 below and the site location is summarised in Table 1:

The elevation is at approximately 164 mAOD with the site sloping down towards Topography south and the east in the direction of the River Dee.

2.2 Site Description and Planning Designations

2.2.1 The whole development site covers an area of approximately 4.5ha and is on an area of undeveloped land which is currently in agricultural use. The development site is bounded to the north by an old railway cutting, the east by an area of residential development and a recreation area, the south by the B5437 minor road and the west by an area of light industrial development. The site development area therefore represents a strip of land which is infilling development between the area of residential development to the east and the light industrial development to the west. Overhead power lines cross the site from north to south approximately 100m to the west of the eastern site boundary, although these are to be removed/re-routed as part of the proposed development.

2.2.2 The proposed development is illustrated on Drawing 16122 P003 which is reproduced in Figure 2 below.

2.2.3 The main part of the development is in the western area of the site and comprises a steel portal framed building which measures 170m by 68m. Approximately 80% of the footprint of this main building is situated within the western area of the site on an area of land (circa 2.6ha) which under the LDP is designated as allocated employment land (See Figure 3). The eastern portion of the development site (circa 1.9ha) falls outside the allocated employment land and within an area which is designated for mineral safeguarding under Policy PSE15 of the LDP. This development area comprises car

parking, habitat and landscaping areas, an employee wellbeing unit and the easterly end (approximately 20% of the footprint) of the main building.

2.2.4 The wording of Policy PSE 15 is copied below:

High quality resources of minerals, including limestone, sand and gravel, Gritstones, igneous and volcanic deposits will be safeguarded from development that would result in its permanent loss or hinder future extraction. Development will only be permitted where: i) it can be demonstrated that the need for the development outweighs the need to protect the mineral resource; or ii) where such development would not have a significant impact on the viability of that mineral being worked; or iii) where the mineral is extracted prior to the development.

Justification The safeguarding of an area does not indicate an acceptance of working but protects potential resources from other types of permanent development which would either sterilise them or hinder future extraction. Small scale developments may be suitably located so as to minimise impacts on the mineral reserve and its likelihood of being worked in the future. Developments that are adjacent to existing settlements are unlikely to have a significant impact because of the need to retain a buffer between mineral working and dwellings however, large scale developments could potentially sterilise mineral reserves. Where this is the case, the mineral should be removed prior to, or as part of, the development of the site. The Local Development Plan allocations are not considered to jeopardise the safeguarding of minerals due to their proximity to existing built up areas. No safeguarding areas for coal are identified on the proposals maps at the present time as there are no known primary or secondary resources in Denbighshire. Should further information become available which indicates such resources are present; the proposals maps will be amended.

2.2.5 The allocated development areas are illustrated on Proposals Map05A of the LDP and an extract showing the site area (shown as the red boundary) is provided in Figure 3 below:

3. MINERAL DEPOSIT

3.1.1 The development is predominantly on allocated employment land which is the western portion of the site which receives the main component of the built development in the form of the larger steel portal framed structure (approximately 80% of the footprint) and loading areas. These areas of the development are therefore not subject to the mineral safeguarding designation.

3.1.2 The eastern portion of the development is within the area of land which is subject to mineral safeguarding and involves limited built development in the form of a smaller portal frame structure as an employee wellbeing unit and car parking areas. The extent of the safeguarding area which is proposed to accommodate buildings is approximately 15% with the remaining 85% of the area comprising car parking, roadways and the habitat garden, which makes up approximately 60% of the land-use in this area of the site.

3.1.3 Site investigations, of the whole development site, have been carried out comprising twenty trial pits to maximum depths typically 2.3 to 3.2 m below ground level. The results are presented in GroundSolve Ltd Report Wholebake Ltd, Corwen - Proposed Industrial Unit, Geo-environmental Report of December 2016 and this should be referred to for the full details of the ground conditions summarised in this section of this report.

3.1.4 Within the area of land which is subject to mineral safeguarding the site investigation comprised seven trial pits (TP08, TP13 to TP17 and TP19) plus three window sample boreholes (WS05 to WS07). The ground conditions can be summarised as follows:

0.20 to 0.40 m thick: Topsoil. 0.20 to 0.45 m thick: Subsoil Combined thickness of topsoil and subsoil 0.50 to 0.80 m Locally present 1.0 m thick: Gravelly SILT, locally slightly sandy or sandy. Up to 4.8 m penetrated: Potential mineral deposit.

3.1.5 The potential mineral deposit is a mixed fluvioglacial mineral source typically comprising silty SAND and GRAVEL with a limited proportion of cobbles and boulders. The mineral deposit is variable, which is to be expected for a fluvioglacial mineral source and is locally clayey or very silty and varied from being a gravelly SAND to a sandy GRAVEL with almost no fines present. This is a mixed source and would require washing and grading to produce a commercially viable product.

3.1.6 Particle size distribution test on the sands and gravel recorded them to be generally well graded fine to coarse sand and fine to coarse gravel. Uniformity coefficients were between 8.6 and 15.1. A summary of the results is presented below:

4. IMPACT OF DEVELOPMENT ON MINERALS SAFEGUARDING

4.1.1 The total area within the development site which is subject to minerals safeguarding represents a relatively small area of potential minerals and measures at its longest dimensions approximately 100m x 175m and is an area of land which is bounded by areas of existing residential and light industrial development to the east and west a railway cutting to the north and a minor B-road to the south. The total area of the safeguarding area is largely within a 100m distance of the neighbouring residential area and therefore could not be worked.

4.1.2 Denbigshire’s LDP includes Policy PSE16 which relates to buffer zones from mineral extraction and provides guidance of 100m for sand and gravel extraction. Taking this minimum standoff into account this reduces the area of mineral, under the safeguarding policy, within the eastern area of the development site from circa 1.9ha to circa 0.2ha (Figure 4).

4.1.3 Notwithstanding that it is not possible to access these minerals without having an access road through the residential buffer zone clearly such a small area of potential minerals is uneconomic to work due to the estimated yield being very small (i.e. circa 4,000 to 6,000 tonnes) and would also present numerous practical and logistical issues in physically working the materials due to the small and narrow footprint, lack of available land for necessary ancillary development including aggregate washing plant, site offices, weighbridge and topsoil and overburden stockpiles.

4.1.4 It is considered unlikely that the minerals within this area could be economically worked due to:

 the need to maintain a buffer strip/stand-off from residential development, the road and the railway cutting to prevent disturbance and in the case of the road and railway cutting stability issues due to undermining/removal of support;  Room required to store the overburden in a bund (the topsoil and gravelly silt with a typical combined thickness of up to 0.65 m).  The likely need to wash and grade the minerals to make them commercially viable means there is not considered to be sufficient space on site to establish the necessary washing and grading plant and associated silt lagoons without further reducing the mineral working area.

4.1.5 The proposed development is programmed to be operational by the second quarter of 2018. Aside from the fact that it is not practically or logistically possible to work the minerals within the safeguarding area it is also not feasible to remove the minerals prior to development. It should be noted that in order to form the proposed development it is proposed that there will be an earthworks cut-fill operation on the site. In the very small area of minerals safeguarding area outside of 100m buffer from residential area to the east platform, the proposed development will require the ground to be lowered by between 0.5 to 1.0 m with the excavated ground being incorporated into areas of required fill. This means that the quantity of minerals which could be yielded is likely to be even smaller than circa 4,000 to 6,000 tonnes indicated in Para 4.1.3 unless the unsustainable situation occurs with mineral being exported then suitable fill material being re-imported onto the site in order to complete the development.

4.1.6 The proposed development is predominantly an above ground development with minimal foundations and underground excavation and the larger part of the minerals safeguarding area (circa 60%) is to be developed as a habitat garden and landscape area. Therefore the development will not remove excessive volumes of mineral which would largely remain in place beneath the developed and landscape areas after the cut-fill exercise has been carried out. In this regard the minerals are not sterilized from future extraction if, at some point in the future when the proposed development has ceased to operate and structures are removed, they are considered to be a commercially viable source and planning policy at that time allows (i.e. no conflict with current policy PSE16).

5. CONCLUSION

5.1.1 In summary it is not considered that the minerals within the development site represent a large enough volume to make their extraction economically viable. Nor is it considered that they have direct connectivity with a potentially extractable wider mineral reserve which could have improved the commercial viability of their extraction.

5.1.2 The proposed development is infilling a narrow gap between two existing areas of development and is predominantly within an area which is allocated as employment land. The smaller portion of the site which is located within the minerals safeguarding area includes limited built development with the greater proportion of this development area falling under the habitat garden and landscape areas.

5.1.3 It is not considered that the proposed development permanently sterilizes or degrades the mineral reserve as the scale of development is considered to be small, the nature of the development does not involve excessive groundworks or excavation, the development use within the safeguarded area is largely habitat areas and landscaping and the scale of the potential mineral reserve is considered to be inaccessible, logistically unworkable and not of sufficient scale to make it commercially viable.

5.1.4 Therefore the mineral reserve on site is not practically workable or commercially viable. In addition, the proposed development would not result in loss or sterilisation of the mineral reserve. The greater sterilising effect on the mineral reserve is actually from LDP policy PSE16 which prevents the minerals adjacent to the residential area (i.e. circa 90% of the safeguarded area) from being worked.
