Chair Columbus thanked the municipal partners for their financial support and noted a number of milestones in 2020 including the closing of the lease-to-own agreement with Port Burwell Marina, the hydro and water upgrades occurring at the campground areas and the three current floodplain mapping projects currently underway.

The Chair thanked staff, volunteers, the Vice-Chair and Members for the hard work in 2019 and continued success in 2020.

AUDIT AND FINANCE COMMITTEE

The Chair called upon Dave Beres, Chair of the Audit and Finance Committee to present the committee report.

After introducing Ashley Didone, Audit Partner of MNP, Chair Beres stated that the Audit and Finance Committee met February 19, 2020 and received and reviewed the financial statements in detail. MNP issued a clean opinion of the Authority’s 2019 financial reports and found that the financial statements fairly presented the Authority’s position.

2019 COMMITTEE REPORTS

a) 2019 ANNUAL REPORT

The GM presented the 2019 annual report and highlighted the many projects, events and achievements of LPRCA over the past year. Shoreline and riverine mapping data were updated, over 80,000 trees were planted, 14 wetland restoration projects were completed, and staff worked with the watershed municipal emergency management partners through 12 flood events.

The GM thanked staff, the board, municipal partners, and the various community partners for their participation and efforts in helping LPRCA improve the environment for those living within the LPRCA watershed.

b) BACKUS MUSEUM COMMITTEE

Chair Betty Chanyi introduced and thanked the Backus Museum Committee for their work and provided a few highlights of the past year including the new Vic Gibbons Gallery and the “At Home at Backus” exhibit about the Backus family immigrating to Canada. The Summer Theatre – Pirates of Long Point event was well attended and the 2-day War of 1812 is always a visitor-favourite event. The Chair made note of the events of 2020 including the new Summer Theatre – The Witches of Long Point and the return of the Masquerade Ball.

Chair Chanyi thanked the staff and board for their support of the museum and heritage program and invited everyone to attend the many events this summer.

c) LEE BROWN MARSH MANAGEMENT COMMITTEE

Chair Tom Haskett reviewed the activities conducted at the Lee Brown Waterfowl Management Area and of the Lee Brown Marsh Management Committee. The committee is very proud to have taken the lead in managing the invasive plant phragmites that is damaging Ontario’s wetlands and beaches and continues to support the Long Point Phragmites Action Alliance. The controlled waterfowl hunting program went very well and was fully booked in 2019. The winner of the Leighton and Betty Brown Scholarship, Zach Peck, was introduced and congratulated for obtaining summer employment in Manitoba with Delta Waterfowl this summer.

NEW BUSINESS a) VEHICLE TENDERS

As per the approved 2020 budget, one new ½ ton 2WD pick-up truck and one new ½ ton 4x4 pick-up were tendered to replace two fleet trucks. Tender documents were forwarded to ten dealers. Of the five bids received for the 2WD truck, and the 4 bids received for the 4x4 truck, staff recommended the lowest bidders for both tenders.

STEWARDSHIP AWARD PRESENTATION

LPRCA encourages everyone to help enhance and protect the watershed and supports private land stewardship. The Conservation Stewardship award was created to recognize those individuals who have acted to enhance and protect the watershed as well as their own properties. The third annual LPRCA Conservation Stewardship Award, presented by Vice-Chair John Scholten, was awarded to Stephen and Katie Hotchkiss for their commitment to positive environmental actions contributing to a more sustainable and healthier watershed.

The Hotchkisses have partnered with LPRCA and the Alternative Land Use Services (ALUS) Elgin to establish more than 40 acres of habitat; they have created four wetlands, 20 acres of forest, and more than 16 acres of pollinator habitat. They regularly share their time and insight with others in the community and have participated in events such as the ALUS Elgin Pollinator Awareness Workshop, ALUS Elgin Planting Days, ALUS Seed Sourcing Workshop and ALUS Elgin Annual Environmental Stewardship Tour.

Mr. and Mrs. Hotchkiss felt honoured to receive this award and to be part of the community as the Carolinian Zone is very unique and important to them. They also felt the need to set an example for other businesses and showcase that it is possible to provide an environmentally beneficial pathway towards a sustainable and economically positive business model.

Dr. Frank Seglenieks, Water Resources Engineer, National Hydrological Service of Canada within Environment and Climate Change Canada was introduced by Chair Columbus. Dr. Seglenieks works out of Burlington, Ontario, pursuing his research interests in hydrological modelling and historical water level data of the Great Lakes. He was also the coordinator of the University of Waterloo Weather Station, a role he continues now on a volunteer basis

Lake Erie Water Levels: Where are they now and where are they going in the future, a look into the status of the lake whose shore we call home.

In his presentation, Dr. Seglenieks pointed out the various factors required to keep the lake level in balance; the inflows versus the outflows. There is no actual control of inflows and outflows on , and the persistent wet weather conditions across the Great Lakes basin has been the major contributing factor to the continuous high Lake Erie water levels since 2017.

The future of Lake Erie water level depends primarily on the amount of water going into the system. Outflows from all the Great Lakes are at or near record highs and are predicted to remain so for several months. Based on his modelling and research, Dr. Seglenieks said the great lakes have tended to lock into patterns that last between 10 to 15 years of either very low water levels or very high waters levels. We are currently at three years of record highs but it cannot be assumed that the record highs will continue for the next several years. For instance, if there are average weather conditions for the next several months, the models predict that the Lake Erie water level will reach record highs in the next couple of months but the summer months would be lower than 2019.

In conclusion, Dr. Seglenieks said that regulation has a limited role. Nature will do what it wants and we have to adapt through resilient measures for both flooding and drought.

The Chair thanked Dr. Seglenieks for his presentation and then adjourned the meeting at 3:05pm.

Jeff Yurek, Minister of the Environment, Conservation and Parks, forwarded a directive to the 36 Conservation Authorities on March 26 outlining the necessary steps required to enable the electronic meetings.

The regular Board of Directors meeting on May 6, 2020 at 6:30 pm will be held via Zoom.

I am very pleased to advise you that our government has released Protecting People and Property: Ontario’s Flooding Strategy.

The safety of the public and the protection of our communities is our number one priority. The flooding that impacted extensive areas of the province in the spring of 2019 was a reminder that communities all around Ontario are vulnerable to these frequent, naturally occurring events. We know that we can’t prevent flooding—we can only become more resilient when it occurs.

Ontario’s Flooding Strategy introduces a series of new and enhanced actions that will reduce flood risks and make our province better prepared for flooding events, better equipped to respond to them, and more capable of recovering from them quickly. We have been working across government to strengthen our approach to flooding in the province. This will ensure that our actions are well-coordinated and as effective as possible in protecting people and property.

The Strategy has been developed after public consultations and also draws on the expert advice of Doug McNeil, Ontario’s Special Advisor on Flooding, whose counsel our government sought following the 2019 floods.

Increasing resiliency to flooding is a shared responsibility. All levels of government, Indigenous communities, conservation authorities, landowners, the agricultural community, industry and non-government organizations all have a role to play.

Application# LPRCA-3/20 Concession 14, Lot 24, 41 Townline Road, Haldimand - Townsend • The proposed work – to construct a stormwater outlet; • Satisfactory engineered design drawings and report were submitted in support of this application; • The application is within the river or stream valley and it will not negatively affect slope stability; • The application is within the riverine flooding hazard and it will not negatively affect flood flows.

Application# LPRCA-4/20 Plan 206, Lot 33, 33 Erie Boulevard, Norfolk – South Walsingham • The proposed work - shoreline protection repair – place stone immediately lake ward of an existing shoreline protection structure; • A satisfactory site plan and construction details were submitted in support of this application; • This proposal is not in accordance with the currently approved Shoreline Management Plan. However, as per the July 5, 2017 Board Resolution #A- 173/17, the emergency repair of existing shoreline protection and the extension of shoreline protection to fill gaps between protected lots are supported.

The hydrologic function of the wetland will not be negatively impacted by this development.

Application# LPRCA-6/20 Plan 190, Lot 128, 13 Walmsley Street, Norfolk - Charlotteville • The proposed work – to construct a 31 m2 single storey detached garage; • There is no opportunity for conversion into habitable space in the future; • The application is within the Lake Erie shoreline flooding hazard and this proposal should not negatively affect the control of flooding.

Application# LPRCA-8/20 Plan 251, Lot 36, 121 Hastings Drive, Norfolk – South Walsingham • The proposed work - shoreline protection repair- reposition fallen rock onto the existing structure, place posts adjacent to existing structure and place additional rock/concrete to match adjacent lands to the west; • This proposal is not in accordance with the currently approved Shoreline Management Plan. However, as per the July 5, 2017 Board Resolution #A-173/17, the emergency repair of existing shoreline protection and the extension of shoreline protection to fill gaps between protected lots are supported.

Application# LPRCA-11/20 Concession 9/10, Lot 14, Best Line, Mun. of Bayham Concession 8, Lot 16, Sandytown Road., Mun. of Bayham Concession 1, Lot 14, Lakeshore Line, Mun. of Bayham • The proposed work – the maintenance and repair of public infrastructure; • Remove the existing culvert (2 locations) and replace with a new culvert same size or larger. • Repair eroded area around precast bridge structure; • Satisfactory design details were submitted in support of this application. All work will be carried out as per the OPSS PROV 421 – Pipe Culvert Installation in Open Ditch; • The applications are within the riverine flooding and erosion hazard and it should not negatively affect the control of flooding and erosion.

Application# LPRCA-12/20 Concession 1, Lot 5, 18 Winger Bay Lane, Haldimand - Rainham • The proposed work – shoreline protection repair – replace damaged blocks in the existing vertical block wall and conduct minor site grading; • A satisfactory design sketch was submitted in support of this application; • The application is within the Lake Erie shoreline flooding and erosion hazard and this proposal will not negatively affect the control of flooding and erosion.

Application # LPRCA-88/20 Concession 8, Lot 28, Bayham-Norfolk Boundary Road, Elgin – Bayham • The proposed work – to remove an existing concrete single span bridge over Little Otter Creek and replace with three 3.6 m (12’) diameter corrugated steel culverts; • An engineered design was submitted in support of the application, • The application is an alteration to a watercourse, • A peer review has been completed of the proposal, • The proposal does not the meet relevant LPRCA Policies for the Administration of Ontario Regulation 178/06, specifically, 9.1.2 c) crossing structure avoid the Riverine Erosion Hazard in order to accommodate natural watercourse movement, wherever possible, 9.1.2 f) where unavoidable, intrusions on significant natural features or hydrologic or ecological functions are minimized and it can be demonstrated that best management practices including site and infrastructure design and appropriate remedial measures will adequately restore and enhance features and functions. 9.1.2 h) maintenance requirements are minimized. • Culverts are at risk for debris jams that reduce the crossing conveyance and therefore requiring regular maintenance to maintain conveyance. The uncertainty of the culvert lifespans could lead to the lifecycle and replacement costs being higher for culverts than bridges. LPRCA staff have advised municipal staff to consider alternative approaches; however, they wish to continue with this project, and • Notwithstanding the proposal failing to meeting above sections of policy, impacts to flooding and erosion will be limited to the area immediately surrounding the crossing.

BACKGROUND

The past 2 months have been challenging with the evolving situation regarding the COVID-19. We continue to monitor the information provided by our local health units, the Government of Ontario and the Government of Canada to ensure the health and safety of our employees. Currently all LPRCA property and buildings are closed for public use.

Difficult decisions had to be made to reduce our staff levels and defer hiring seasonal staff. We have staff working from home, at the administrative office and at the workshop. Measures have been put in place to ensure that the workplaces are safe for staff. The joint health and safety committee are holding weekly conference calls to review issues relating to COVID-19.

The scheduled opening of the campgrounds of May 1st has been delayed. Staff are working on contingency plans to cover varying scenarios to evaluate the feasibility of operating the campgrounds on a shortened timeline. Online reservations for overnight camping have been suspended and refunds started in April. In March we did confirm the staff for the parks excluding the students and they are on hold until we have an opening date. We have interest for 22 new seasonal campsites.

We are offering the tree planting program, however, due to the availability of stock we will be at 60% of the original plan.

The Flood Forecast and Warning duties are continuing with the duty officers working from home. There was a significant flood event on Monday April 14th.

The Riverine Flood Hazard Mapping project and the Lake Erie Shoreline Mapping project in Norfolk County have been completed as of March 31, 2020. Presentations from the consultations will be arranged for a Board Meeting at a later date. Agenda Page 38

It was confirmed that WECI funding is available this year and we submitted applications for the two Dam Safety Reviews (Deer Creek and Norwich Dams) and the Deer Creek Wing Walls and Control Chamber Repairs.

Planning staff are working from home and continue to receive and process permits. In 2020, there were 84 permit applications received. In April, there were 17 applications received. There have been 34 Planning Act applications reviewed and the comments provided in 2020.

Forestry staff has completed marking three forest tracts and are preparing tender documents. Field work is being completed for prescriptions that will be completed for the 2021 operating plan.

The workshop staff has been maintaining equipment and vehicles. Spring cleanup in the campgrounds is ongoing in preparation of grass cutting. We have increased security patrols for the campgrounds and other Conservation Areas and focusing on known areas for visitors.

Accounting and administrative staff have been working from home and rotating into the office to ensure the finance and accounting functions are completed.

We have been able to continue operations with modifications as we navigate the pandemic and workplace safety is paramount during this time as we contribute to limiting the spread of COVID

Re: Ecological Survey Quotes – 2020 Survey Season (J Maxwell)

Background

On an annual basis, LPRCA conducts ecological inventories on properties where forest management activities will be undertaken. A qualified ecologist is contracted to complete the necessary field work to ensure any protected species or their habitat is not impacted as defined by the Endangered Species Act. Surveys are conducted in the spring, summer and fall to ensure all vegetative communities are sampled. This year a

Agenda Page 43 total of four properties; Harris Floyd Tract (Block #2), Sackrider Tract, Parrott Tract and Nemeth Tract with a total of 285.00 acres/115.33 hectares will be surveyed. The scope of the project will be limited to only those species that are protected by legislation, or species that may potentially be designated under the Act within the next one to two years.

Requests for quotes were prepared and emailed to seven consultants that specialize in Ecological Surveys

Background

Through LPRCA’s Watershed Services – Healthy Watershed Department, staff undertake a variety of restoration activities including landscape restoration, native groundcover establishment, and tree planting. To help fulfill our goals, we contract out the tree planting activities. The following tenders were received for 2020:

Budget Implication

The tree planting sites covered under this tender are funded by Forests Ontario’s 50 Million Program, the OPG/Forest Corridor Project, ALUS Projects and user pay for the Private Land Tree Planting Program. It is within LPRCA’s budget to plant 24,480 trees.

Background

The agricultural lands at Backus Heritage Conservation Area are located immediately west of the entrance road leading into the park and north of South Walsingham Concession Road 2. The fields are rented on a three-year term and the last contract was with Juhasz Farms c/o Gary Juhasz, at a rate of $270.75 per acre, per year plus HST.

Tender Results

Request for Tender for the land rental was completed once soil samples were completed which was delayed due to weather conditions and the farmer’s ability to take the crops off. Staff advertised the agricultural lands for rent in mid-March, 2020 and the results of the tendering process are listed below:

FORESTRY PRESCRIPTIONS

Re: Forest Management Prescription/Operating Plans

Background

On an annual basis, staff prepares prescriptions/operating plans for each individual tract that will receive some form of silvicultural treatment. The plan outlines current stand conditions, the silvicultural treatment that will be applied and identifies the goals LPRCA aims to achieve.

The Swick King (Block #1) is 100.00 ac/40.47 ha, Devos 94.12 ac/38.91 ha and the Tarcza/Hird/Roberts (Block #2) 43.00 ac/17.40 ha of operable area.

These plans incorporate all collected data from forestry field crews, ecological concerns and past management activities. This plan was prepared in-house by LPRCA forestry staff, and reviewed and approved by an external consultant. Following board approval the forested tracts will be marked and tendered for 2020 revenue.

Budget Implication

All revenues derived from forest management operations are credited to the forestry section of the budget. The overall revenue target for 2020 for forestry is $300,000.

Exotic/Invasive species control by approved methods, to help protect natural heritage features. Short Term: Reduce basal area on site to ±20.11 m2 /Ha from current 28.11 m2 /Ha. Remove high risk, poor quality and over mature stems from the stand to maintain the health and vigor of the regeneration and residual stems. Single tree selection will be the silvicultural method to obtain these goals. Currently Soft Maple comprises 60% and Red Oak 10%, of the stand. Black Gum, Black Cherry, Black Oak, White Pine, White Oak, Poplar, Tulip, Swamp White Oak, Sassafras, White Elm, Yellow Birch, American Beech, White Birch, and Ash species comprise the remaining 30% of the stand. During prism cruising large amounts of new Gypsy Moth egg masses were noticed on a variety of different tree species throughout the property. Gypsy moth egg masses will be monitored during marking operations. Target all merchantable Ash species for removal. E.A.B. is well established in the stand, and surrounding municipalities. All dead/dying Ash Species, excluding Black Ash will be salvaged. All Black Ash will be retained for protection and flagged in blue flagging tape. In December 2018 the Committee on the Status of Endangered Wildlife in Canada (COSEWIC) has listed Black Ash (Fraxinus Nigra) as Threatened. The loss of Black Ash will remove an important source of wood for commercial and traditional uses such as furniture, flooring, snowshoes and baskets. Target Beech stems infected with Beech Bark Disease. Agenda Page 52 Site and Topography Notes: The Swick King Tract is approximately a 200.00 Acre (80.93 ha) property in Charlotteville Township. Only the 100 Acres (40.47 Ha) section (Block #1) on the west side of the Swick King Tract was surveyed. The northern boundary of the Swick-King Tract runs along St. Johns Road with the Hanson Earl Danylevitch Tract to the north. The easterly boundary borders onto private forested land to the south east and agricultural land to the north east. The west boundary borders the Charlotteville West Quarter line with the Smith Tract to the west. The topography is relatively flat to rolling with small 2-3 rises in elevation. The soil is fresh and is mainly sand throughout the tract. The property lies on the Norfolk Sand Plains and is part of the Big Creek watershed.

Ecological Report and Findings: A private consultant was retained by the Authority in 2019 to conduct field work. Field data collected for the Swick-King (Block #1) Tract is attached and all of the Provincially Rare Vascular Plants and Provincially Rare Vegetation types that were identified will be protected. Two hundred and thirteen (213) vascular plants were recorded, Blue flagging ribbon will be placed on these species and vegetation types and Modified Management will be implemented in these Areas of Concern as recommended in best management guidelines. As of December 2018 the committee on the Status of Endangered Wildlife in Canada (COSEWIC) has listed Black Ash (Fraxinus Nigra) as threatened. A copy of the ecological inventory has been forwarded to the Ministry of Environment, Conservation and Agenda Page 53 Parks S.A.R. ecologist for consideration and comment, as it relates to management around or in proximity to species of concern.

Stand Prescription: Treatment Instructions: Target UGS and poor quality stems for removal. Remove AGS only to reduce Ba to desired level and maintain spacing were necessary. Landings already exist on site from previous forest management operations. Existing skid trails will be utilized for timber extraction and are well established. Where necessary due to the presence of species of concern, skid trails will be re-located to other acceptable locations. Treat all size classes according to the breakdown in the prescription, removing all trees exhibiting signs of infectious diseases/insects. Remove stems in state of decline and/or standing dead merchantable stems where not required for IRM targets. Dead standing stems posing a safety threat to crews will be marked for felling. Mark all merchantable salvageable stems on the ground or tipped. All high risk, large size class stems to be re-assessed by tree markers during marking operations.

This section of woodlot will be managed as a sawlog production woodlot. Certified marking crews will need to evaluate Ba distribution frequently to ensure targets are met. Commercial timber to be marked clearly with three dots at D.B.H. and stump level using orange paint. Mark bumper trees on main skid routes. All measurements to be Ontario Log Rule Form Class ‘79. All non-commercial material to be marked with a slash of orange paint on two sides at D.B.H. as well as ground level. Authority winter work crews have carried out vine control prior to harvest.

Agenda Page 56 I.R.M. Instructions: Maintain species diversity throughout the stand to benefit all forms of fauna during all seasons. Retain recommended number of cavity (10/Ha) and mast (10/Ha) trees of different species to ensure annual mast production, nesting, roosting and escape opportunities. Identify and protect significant wildlife habitat. Mark low areas in a manner that will facilitate easy removal of marked timber to minimize damage. Candidate cavity and mast trees will be identified with either blue flagging ribbon or paint. All stick nests if encountered to be identified with blue flagging ribbon as A.O.C. and appropriate boundaries established for protection. Ensure all habitat guidelines contained within the Endangered Species Act are met or exceeded. Recommendations contained within the new management guidelines for forest birds in Southern Ontario will also be implemented by tree markers. Special Instructions: All machinery to be used in this timber extraction activity will be previously cleaned to help prevent the spread of invasive/exotic non-desirable species. All cutting and skidding crews will be instructed to use the recommended careful logging procedures as per the new Silvicultural Guide to Managing Southern Ontario Forests. Careful logging around advanced growth will be implemented in all areas. All other considerations will be outlined in the standard Long Point Region Conservation Authority “Agreement for the Sale of Standing Timber”. Operations will only be undertaken during dry or frozen ground conditions to minimize impacts on the forest floor. All A.O.C.’s to be marked with blue flagging ribbon or blue paint. Non-Treed wetland areas that are unique to this area will be avoided by all mechanical timber removal equipment. Once timber marking operations are complete, the Ministry of Environment, Conservation and Parks S.A.R. division will be invited to assess the marking plan and provide any further comments prior to tendering the timber sale. If the S.A.R. Biologist is not immediately available the Ministry of Environment, Conservation and Parks - SAR has the option to appoint another qualified Ministry of Environment, Conservation and Parks staff person for site inspections. LPRCA Property Other Uses: The Swick-King (Block #1) tract is one of a vast network of forest tracts owned and managed by L.P.R.C.A. A wide range of permitted land uses are enjoyed by the public during the various seasons. Activities include hunting, nature viewing, and gathering of nuts/seeds/edible mushrooms (with written permission), X-country skiing, and nature trails. In order to eliminate user conflicts during timber harvesting activities, this tract will be posted restricting public use until operations are completed. Follow Up Recommendations: Monitor stand on an annual basis for blow down and signs of further insect/disease presence. Monitor regeneration to determine if desirable species are regenerating. If not, follow up treatments will be required such as manual removal with a brush saw, or approved herbicide application to remove competition or non-desirable species. (Invasive/Exotic Species) All areas of High Conservation Values will be inspected and assessed after commercial timber operations are completed to ensure that there has been no impact to the site. Follow-up inspections will be completed every three years or sooner if required. If necessary, a qualified consultant that manages invasive/exotic species will be contacted for control of these species.

Ecological Report and Findings: A private consultant was retained by the Authority in previous years to conduct field work. Field data collected for the Devos Tract is attached and all of the Provincially Rare Vascular Plants and Provincially Rare Vegetation types that were identified will be protected. Blue flagging ribbon will be placed on these species and vegetation types and Modified Management will be implemented in these Areas of Concern as recommended in best management guidelines. As of December 2018 the committee on the Status of Endangered Wildlife in Canada (COSEWIC) has listed Black Ash (Fraxinus Nigra) as threatened. Treatment Instructions:

Target UGS and poor quality stems for removal. Remove AGS only to reduce Ba to desired level and maintain spacing were necessary. Landings already exist on site from previous forest management operations. Existing skid trails will be utilized for timber extraction and are well established. Where necessary due to the presence of species of concern, skid trails will be re-located to other acceptable locations. Treat all size classes according to the breakdown in the prescription, removing all trees exhibiting signs of infectious diseases/insects excluding Black Ash. Remove stems in state of decline and/or standing dead merchantable stems where not required for IRM targets. Dead standing stems posing a safety threat to crews will be marked for felling. Mark all merchantable salvageable stems on the ground or tipped. All high risk, large size class stems to be re-assessed by tree markers during marking operations. This section of woodlot will be managed as a sawlog production woodlot. Certified marking crews will need to evaluate Ba distribution frequently to ensure targets are met. Commercial timber to be marked clearly with three dots at D.B.H. and stump level using orange paint. Trees containing reduced volume will be marked clearly with three dots at D.B.H. and stump level using orange paint and a visible “X” stating there has been a reduction in volume. Mark bumper trees on main skid routes. All measurements to be Ontario Log Rule Form Class ‘79. All non-commercial material to be marked with a slash of orange paint on two sides at D.B.H. as well as ground level. Authority winter work crews have carried out vine control prior to harvest.

Agenda Page 72 I.R.M. Instructions: Maintain species diversity throughout the stand to benefit all forms of fauna during all seasons. Retain recommended number of cavity (10/Ha) and mast (10/Ha) trees of different species to ensure annual mast production, nesting, roosting and escape opportunities. Identify and protect significant wildlife habitat. Mark low areas in a manner that will facilitate easy removal of marked timber to minimize damage. Candidate cavity and mast trees will be identified with either blue flagging ribbon or paint. All stick nests if encountered to be identified with blue flagging ribbon as A.O.C. and appropriate boundaries established for protection. Ensure all habitat guidelines contained within the Endangered Species Act are met or exceeded. All species at risk encountered during marking will be flagged/painted in blue for protection and GPS’ed. Recommendations contained within the management guidelines for forest birds in Southern Ontario will also be implemented by tree markers.

Special Instructions: All machinery to be used in this timber extraction activity will be previously cleaned to help prevent the spread of invasive/exotic non-desirable species. All cutting and skidding crews will be instructed to use the recommended careful logging procedures as per the new Silvicultural Guide to Managing Southern Ontario Forests. Careful logging around advanced growth will be implemented in all areas. All other considerations will be outlined in the standard Long Point Region Conservation Authority “Agreement for the Sale of Standing Timber”. Operations will only be undertaken during dry or frozen ground conditions to minimize impacts on the forest floor. No harvesting will take place from March 31st – August 1st to protect birds and habitat during breeding season. All A.O.C.’s to be marked with blue flagging ribbon or blue paint.

LPRCA Property Other Uses: The Devos Tract is one of a vast network of forest tracts owned and managed by L.P.R.C.A. A wide range of permitted land uses are enjoyed by the public during the various seasons. Activities include hunting, nature viewing, and gathering of nuts/seeds/edible mushrooms (with written permission), X- country skiing, and nature trails. In order to eliminate user conflicts during timber harvesting activities, this tract will be posted restricting public use until operations are completed.

Follow Up Recommendations: Monitor stand on an annual basis for blow down and signs of further insect/disease presence. Monitor regeneration to determine if desirable species are regenerating. If not, follow up treatments will be required such as manual removal with a brush saw, or approved herbicide application to remove competition or non-desirable species. (Invasive/Exotic Species) If necessary, a qualified consultant that specializing in management of invasive/exotic species will be contacted for control of these species. Monitor sprouting regeneration of American Beech to determine its presence is not hampering regeneration of other native hardwood species.

Content: The prescription will consist of detailed guidelines to be followed by the certified tree marking crew, detailed/surrounding area mapping, location of prism plots, Species at Risk mapping, stand analysis and property history to guide markers to obtain a good understanding of the property.

Objectives:

Long Term: Un-even aged stand with potential to obtain 90% quality growing stock. Currently 87% within the operating area. Maintain native species diversity currently located on all sites within the woodlot. This woodlot will be managed as a sawlog production woodlot, promoting high quality forest products for future consideration by employing good forestry practices, while maintaining all I.R.M. objectives. Exotic/Invasive species control by approved methods, to help protect natural heritage features. Hill’s Oak will be monitored on a regular basis to assess how the harvesting has affected potential regeneration developing and existing stems. The goal is to promote oak regeneration by removing understory and creating small patches allowing for sufficient light levels.

Short Term: Reduce basal area on site to ±20.00 m2 /Ha from current 26.33 m2 /Ha. Remove high risk, poor quality and over mature stems from the stand to maintain the health and vigor of the regeneration and residual stems. The property is over mature and in need of forest management, last recorded harvest was over 30 years ago. Single tree selection will be the main silvicultural method to obtain these goals for the majority of the stand excluding the area containing Hill’s Oak; the marking crew will be doing a Shelterwood with small patch removal to help promote Agenda Page 81 regeneration while retaining Oak species. Where possible undesirable species will be removed to open areas up creating needed light to promote oak regeneration. Currently Soft Maple comprises 70% and Hill’s Oak 10%, of the stand. White Ash, Green Ash, White Elm, Black Cherry, Poplar, White Oak, White Spruce, Yellow Birch, Red Oak, Bur Oak and Black Oak comprise the remaining 20% of the stand. Select crop trees that display genetically superior qualities for seed production and future harvests and mark competitors for removal to promote regeneration efforts.

Site and Topography Notes: The Hird/Tarcza/Roberts Tract is approximately a 100.00 Acre (40.46 ha) property in Windham Township about one kilometer west of the hamlet of Vanessa on Norfolk County Road #19. Only the 43.00 Acres (17.40 Ha) section (Block #2) on the east side of the Tarcza- Roberts-Hird Tract was surveyed. Stems containing Hill’s Oak run north south on the east portion of the property. The property is bordered by private woodlands to the east, north and south, with County Road #19 running along the northern boundary and Serles Tract located to the north. Private cleared agricultural lands are present to the west. The topography is relatively flat to rolling with small 2-3 rises in elevation. The soil is fresh to moist and is mainly sand throughout the tract. The property lies on the Norfolk Sand Plains and is part of the Big Creek watershed.

Mark merchantable salvageable stems on the ground or tipped but leave low grade logs as the benefits will out way the revenue. The downed logs provide shelter and denning sites for mammals, birds, amphibians and reptiles such as salamanders and snakes. Woody debris contributes to the overall ecosystem of the forest and the wildlife therein. During prism cruising large amounts of new Gypsy Moth egg masses were noticed on a variety of different tree species throughout the property. Gypsy moth egg masses will be monitored during marking operations. Oak wilt could potentially be a concern on the forested tract containing oak species, the tract will be monitored by marking crew for any signs throughout the tract, it has not be reported in Ontario but all markers will be aware of the signs and symptoms of oak wilt. Target all merchantable Ash species for removal, excluding Black Ash. E.A.B. is well established in the stand, and surrounding municipalities. All dead/dying Ash Species, excluding Black Ash will be salvaged. All Black Ash will be retained for protection and flagged in blue flagging tape. In December 2018 the Committee on the Status of Endangered

Agenda Page 86 Wildlife in Canada (COSEWIC) has listed Black Ash (Fraxinus Nigra) as Threatened. Black ash trees will be noted and mapped for any potential recovery efforts or to support future indigenous needs. Target Beech stems infected with Beech Bark Disease. This section of woodlot will be managed as a sawlog production woodlot. Certified marking crews will need to evaluate Ba distribution frequently to ensure targets are met. Commercial timber to be marked clearly with three dots at D.B.H. and stump level using yellow paint. Trees containing reduced volume will be marked clearly with three dots at D.B.H. and stump level using yellow paint and a visible “X” stating there has been a reduction in volume. Mark bumper trees on main skid routes. All measurements to be Ontario Log Rule Form Class ‘79. Previous commercial timber harvesting operations were conducted to encourage the regeneration of Hill’s Oak. These harvesting activities which included removing undesirable species which created opens to create more light to promote regeneration while retaining Hill’s Oaks. These measures were very successful, which is indicating by the current number of Hill’s Oak stems in all size classes.

FORESTRY TENDER

Re: Timber Tender LP-327-20 Harris-Floyd Tract – Block #1 (J Maxwell)

Background

As part of the ongoing forestry program of the .LPRCA, staff prepared and the Board of Directors approved a prescription/operating plan for the Harris-Floyd Tract – Block #1. The Harris-Floyd Tract (Block 1) is 50 acres and is located on the 5th Concession of Houghton Township.

The marking in the field with forestry staff was completed and tenders were prepared and mailed to various sawmills and timber buyers.

Results of the tendering process are as follows: a) Harris-Floyd Tract – Block #1 1) Townsend Lumber Inc. $73,250.00 2) Springwater Mills $56,000.00 3) Leonard Pilkey $80,175.00

The bid submitted by Leonard Pilkey was within the expected bid range and LPRCA has successfully dealt with this watershed-based company previously.

Budget Implication

Funds are to be applied towards the 2020 Forestry Operations Budget that has an anticipated $300,000 in revenues. To date, $80,375.00 has been generated which includes the Harris-Floyd Tract – Block #1.

Recommendation

THAT the LPRCA Board of Directors receives the 1st Quarter 2020 Budget Performance Report as at March 31st, 2020 as information.

Background

The Q1 financial report provides a summary of the budget vs actual comparison for revenues and expenditures for LPRCA as of March 31st, 2020. The consolidated statement of operations is attached as Appendix 1 accompanied with the departmental budget vs actual results. The capital projects are summarized in Appendix 2.

The Board approved the 2020 Operating and Capital Budgets on January 8, 2020. The Operating Budget in the amount of $4,441,340 and the Capital Budget was approved in the amount of $963,450.

Discussion

The Q1 operating revenues totaled $833,754 with expenditures of $839,519. Revenues represented 18.7% of the annual budget and expenditures 18.9% with a deficit of $5,765 for the period.

Revenues are up $123,359 or 18% for the same period year over year as a result of the following items: externally funded grant projects that were completed in the amount of $106,278 and donations for the display revitalization at Backus Heritage of $29,100. Expenditures are up $85,834 or 11% for the same period year over year as a result of professional services related to the externally funded grant projects in the amount of $123,327.

Excluding these items which are not included in the 2020 budget revenues and expenses are in-line with 2019. The 2020 deficit of $5,765 for the period is less that of 2019 in the amount of $48,290.

Analysis

The Government of Ontario declared a provincial emergency on March 17, 2020 due to the COVID-19 pandemic. Following the emergency declaration LPRCA put in place a hiring freeze and restricted all non- essential purchasing until further notice. On Saturday April 25th, 2020 the Ontario Government announced the closure of Ontario’s provincial parks and conservation reserves till May 31, 2020.

Compensation expenses account for 65.8% or $2,922,869 of LPRCA’s 2020 Budget. For the period ending March 31 LPRCA typically has 32 employees on staff (contract, part-time and full-time) and at the end of the period we had 28 staff. As a result of the closure of campgrounds/non-essential services staffing has further been reduced to 25 staff by the third week of April. Forward looking the reduction in staffing will Agenda Page 95

reduce compensations costs by $286,670 for the 2020 fiscal. There are four seasonal staff positions that have been postponed that work outside of the campgrounds and this reduction in compensation expenditures results in $129,290. In total the actions taken to date could potentially reduce compensation expense up to $415,960 for fiscal 2020.

The restriction of purchasing to only necessary materials, supplies and services has resulted in a drastic reduction in the number of invoices being processed in the latter half of March and throughout April. In the first three months of 2020 there has been $44,000 or 11.5% of budget incurred for staff related expenses and materials and supplies. Given the seasonality of LPRCA’s non-profit driven departments these line items are projected to be approximately 70% or down $115,000. The purchased services budget line is forecasted to remain on budget as these services are mainly fixed such as rent, insurance, audit, legal, and cleaning services.

Budget Implications:

The profit from the operation of campgrounds and the forestry program are used to offset the municipal levy for mandated services and programs. These two programs were budgeted to contribute $355,572 in fiscal 2020. In addition we projected there is $347,899 of fixed costs required to support the profit driven programs. In the worst-case scenario if campgrounds and forestry program generate zero revenue the forecasted 2020 deficit would be approximately $703,347. Staff will continue to monitor the timber markets to ensure LPRCA receives fair and full value for timber tenders awarded.

The actions taken to date will reduce operating expenditures by $530,960. In the worst-case scenario this would result in an annual operating deficit of $172,511 or 3.88% of budget.

Staff will continue to monitor the directives of the Government of Ontario and local public health units. As staff receives greater information regarding the impacts of the current emergency on the organization’s financial operations, we may have to take further action to reduce the potential of running a deficit.

BACKGROUND

As noted in the LPRCA Flood Contingency Plan, LPRCA is responsible for operating a flood forecasting and warning system in collaboration with the Ontario Ministry of Natural Resources and Forestry (MNRF). This system includes monitoring weather conditions and forecasts, forecasting flood potential, issuing bulletins and communicating updates to municipalities. Through this flood warning system, municipalities can take the necessary actions to ensure the welfare of residents and minimize property damage due to flooding. Since early May 2019, LPRCA has had a standing Shoreline Conditions Statement - Flood Outlook or Flood Watch in effect for the Lake Erie shoreline due to the high static lake levels being experienced. Daily updates have also been provided since then to municipal emergency management coordinators in affected municipalities. Moderate to strong southwest and west winds ranging from 40-50 km/h with gusts exceeding 60 km/hr were forecast for Thursday, April 9th and Wednesday, April 10th. The Ministry of Natural Resources and Forestry (MNRF) forecast predicted Lake Erie to rise 0.15 metres to 175.28 metres and 0.39 metres to 175.50 metres in the Long Point and Port Colborne areas, respectively. In advance of the event, LPRCA staff notified emergency coordinators of the forecast conditions and issued a flood watch on April 8th to the public, media and emergency coordinators. Forecast levels met the criteria for notifying Haldimand County residents

and businesses within LPRCA’s watershed that flooding could reach Lake Erie Flood Zone 1. Predominate west winds from this event caused Lake Erie water levels to be elevated between the afternoon of Thursday, April 9th and into the early evening of April 10th. Water levels reached 175.32 metres in Long Point and 175.45 metres in Port Colborne (see Figure 1: April Lake Erie Levels). These numbers do not include the impact of wave uprush. No significant damage or impacts from flooding were noted from this event. The forecast for significant winds continued early into the next week with 65-75 km/h southwest winds with gusts up to 100 km/h over Lake Erie for Monday, April 13th. The MNRF forecast predicted Lake Erie to rise 0.43 metres to 175.51 metres and 0.98 metres to 176.06 metres in the Long Point and Port Colborne areas, respectively. Peak levels were expected to occur between late Monday afternoon and into the evening. Wave heights were forecast to reach up to 2 metres along the shoreline. LPRCA staff notified emergency management coordinators of the event in their daily update and issued a flood warning on April 12th to the public, media and emergency coordinators. Forecast levels met the criteria for notifying Haldimand County residents and businesses within LPRCA’s watershed that flooding could reach Lake Erie Flood Zone 3. As forecasted, water levels peaked during the afternoon and evening across the LPRCA shoreline on April 13th. Recorded gauged water levels ultimately reached 175.84 metres in Port Dover and 175.99 metres in Port Colborne (Figure 1: April Lake Erie Levels). Comparative numbers for October. 27th, 2019 were 175.77 metres and 176.01 metres respectively; and for Oct. 31st, 2019 were 175.92 metres and 176.41 metres, respectively. Anecdotal reports for the April 13th event, indicate the depth of flooding over the Causeway Road exceeded the October 27th and 31st events and was the most significant since the 1980s. Lake levels remained elevated following the event and a Flood Watch was issued on April 14th.

Figure 1: April Lake Erie Levels Levels of Lake Erie continue to be above its long-term average for this time of year and is setting records for its monthly mean level. At the beginning of April, the National Hydrological Services Great Lakes Water Levels Information Memorandum reported: • Lake Erie’s level was 86 cm above average, the highest March mean level on record and 10 cm above the previous record high of 1987. • Lake Erie rose 22 cm in March, on average it rises by 16 cm in March. • At the beginning of April, Lake Erie’s level was the highest on record. It was 90 cm above average, 33 cm higher than last year, and 12 cm above the previous record-high beginning-of-April level set in 1985.

Water supplies over the last three months were generally above average throughout the Great Lakes and Lake Erie’s static water level continues to set records with a daily average level of approximately 175.0 m. Assuming average water supply conditions, Lake Erie static levels are expected to remain well above average and continue to increase into May (Figure 2: Lake Erie Monthly Mean Levels). There is the potential for record high monthly mean levels to be set for the months of April and May.

Due to the high level of Lake Erie and forecast, there continues to be a heightened risk of flooding from lake surges and wave uprush, and wave-driven erosion along the shoreline. On April 17th, an updated Shoreline Conditions Statement was issued to the media, public and emergency coordinators advising of the potential for flooding.

LPRCA flood forecasting and warning staff continue to provide flood forecasting and warning services during the COVID-19 situation. Staff are equipped to work and communicate remotely. LPRCA vehicles are available to flood forecast and warning staff with the necessary hygienic and cleaning protocols in place to address COVID-19 concerns. These protocols are in place for the routine inspection, operation and maintenance of water control structures.

BUDGET IMPLICATION

Staff time associated with monitoring weather conditions, forecasting flood potential, issuing flood messages, providing technical assistance during and around flood events, and liaising with municipal staff, media and the public.
