After more than two years of legal action and lobbying, LIGRA, along with our in-dustry allies were successful in repealing the 2016 “Free Air Law” in the Town of Hempstead. At the August 7th Town Board Meeting legislation was passed by a vote of 6 to 1 which per - mits “the use of coin-operated air compressor units for inflation of tires at gasoline service stations except that compressed air must be provided at no charge in cases of emergency.” All coin-operated units will be required to have a sticker in red stating the following: IN AN EMERGENCY UPON REQUEST, THE ATTENDANT WILL PROVIDE ACCESS TO COMPRESSED AIR AT NO CHARGE DURING BUSINESS HOURS

We will be closely monitoring the implementation of this new law in the weeks and months ahead to ensure that motorists do not try and take advantage of the emergency provision and have been assured by the Town that if abuse occurs changes to the law will be consid - ered. The critical win here for our industry is the repeal of the prohibition on the use of coin- operated compressors in the Town of Hempstead which goes all the way back to 1978. Throughout this entire process we argued vehemently that government does not have the constitutional right to force small business or any business to provide a service to the public for free that in fact costs that business money to provide.
