The Cities Act [sections 2 and 39] ______

Incorporation of The city of martensville 1 Section 39 of The Cities Act provides as follows: (1) The minister may, by order, incorporate a town that is incorporated or continued pursuant to The Municipalities Act as a city pursuant to this Act if: (a) the town has a popul ation of 5,000 or more; and (b) the council of the town requests the change in status. (d) notification from a CFIA inspector indicating that poultry that has arrived at a processing plant does not meet federal or provincial government standards; (e) failure to comply with board mandated on farm food safety or animal welfare programs. PROCESS FOR CHANGING PROCESSORS ORDER 44/09. The Chicken Farmers of Saskatchewan Board, pursuant to the provisions of the Saskatchewan Chicken Marketing Plan, 1978 and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 Registered producers who plan to switch from the current processor to which they market their chickens to a different licensed Saskatchewan processing plant, or to anywhere other than with a licensed Saskatchewan processing plant, must provide: (a) notice to both processors in question and the CFS board no less than three (3) production cycles in advance of the anticipated switch (Production cycles shall be defined as the established production cycle set out by the Chicken Farmers of Canada); (b) notice of three (3) production cycles in advance means the producer will continue to market their chicken to their current processor for three (3) production cycles (inclusive) after notice is given; (c) a producer would not be required to provide the three (3) production cycle notice if both affected processing companies indicate, in writing, that the said registered producer will be switching processors and both processors agree to an earlier switch date. This notice must be provided to the CFS board. 2 All transfers that take place must respect the three cycle time frame listed above, if the transferred base quota is being produced in the same production unit. If the base quota is not being produced in the same production unit (as listed on the transfer forms), the three cycle time frame would not be required. 3 Marketing in violation of this order may result in the suspension of a producer’s license. 4 Order 13/00 – Out of Province Marketing shall be hereby fully revoked. Animal Care Program ORDER NO.45/09 – The Chicken Farmers of Saskatchewan Board, pursuant to the provisions of the Saskatchewan Chicken Marketing Plan, 1978 and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 That it is in the best interest of the Saskatchewan chicken industry to adopt the Animal Care Program (ACP) for the purposes of verifying animal welfare and adapting to changing consumer demands. 2 Effective January 1, 2010, the CFS will begin auditing farms under the ACP using the same schedule established under the On Farm Food Safety Program (OFFSAP) for registered producers. 3 Registered producers will be required to comply with all ACP guidelines with the exception of the stocking density requirement by December 31, 2010. 4 Registered producers will be required to adhere to the stocking density requirements by September 1, 2013. This will be to allow producers who currently do not adhere to the ACP stocking density guidelines to build or acquire new facilities, or reduce their base quota holdings. 5 In the event that a producer does not meet the ACP guidelines, excluding stocking density guidelines, by December 31, 2010 or the stocking density guidelines by September 1, 2013, the Board shall have the discretion to impose one or more of the following sanctions, namely: (a) providing the producer with additional time to comply with certification under certain terms and conditions; (b) reducing production allocation in such manner as the Board deems appropriate; (c) suspending a registered producer’s license; (d) refusing to renew a producer’s license; or (e) imposing such other sanctions as may be required or taking such action as may be required to ensure that producers are ACP certified. 6 The Board may establish guidelines that can be used for the enforcement, administration and application of the ACP program. Order No. 45/09 is made pursuant to section 3 and clause 14(r) of the Saskatchewan Chicken Marketing Plan, 1978 and section 12 of The Agri-Food Act, 2004, and shall be effective on, from and after the 3rd day of September, 2009. THE BROILER HATCHING EGG MARKETING PLAN REGULATIONS — BASE QUOTA LEASING ORDER NO. 48/09. The Saskatchewan Broiler Hatching Egg Producers’ Marketing Board, pursuant to the provisions of The Broiler Hatching Egg Marketing Plan Regulations and the The Agri-Food Act, 2004 hereby determines and orders as follows: 1 A registered producer may, subject to Board approval, lease out all or part of base quota held under license to: (a) another registered producer; or (b) a person who is not a registered producer. 2 A person who is not a registered producer who wishes to lease base quota from a registered producer must apply annually to the Board for a lessee license on a form provided by the Board. The Board shall issue an annual lessee license upon receipt of the lessee’s annual application form, provided that the lessee is in compliance with the Plan and Board Orders. Such licenses will expire on December 31st of each year. The Board may charge a $10.00 annual lessee license fee. 3 A registered producer wishing to lease out base quota must apply to the Board in writing on a form provided by the Board stating: (a) the production period (s) the lease will be in effect; (b) the amount of base quota to be leased in each production period the lease is in effect; (c) the proposed lessee’s name and address and a description of the production site where the broiler hatching eggs will be produced; (d) the proposed lessee’s endorsement of the lease application; and (e) any further information the Board may require for the purpose of determining if the lease conforms to the Plan and Board Orders. 4 A registered producer’s application to lease out base quota must be received at the Board office no more than 60 days after the end of the proposed lease period. The implementation of this deadline shall be retroactive for the 2008 production year and all subsequent production periods going forward. 5 For a lease application to be approved by the Board: (a) the registered producer applying to lease out quota must be in full compliance with all requirements of the Plan and Board Orders, including having no overdue fees, levies, penalties or charges payable to the Board; (b) the registered producer or other person applying to produce and market quota under lease must be in full compliance with all requirements of the Plan and Board Orders, including having no overdue fees, levies, penalties or charges payable to the Board; (c) approval of the lease must not result in contravention of any provision of the Plan or Board Orders by any registered producer or person party to the lease; (d) any hatchery whose egg supply will be affected by the proposed lease must be advised by the registered producer of the producer’s intention to lease out quota; and (e) the lease period must not exceed three calendar year production periods. 6 The Board may attach terms and conditions to a quota lease approval where such terms and conditions are in the Board’s opinion necessary to ensure all requirements of the Plan and Board Orders will be met. 7 Unless specifically exempted by the Board, persons producing and marketing broiler hatching eggs pursuant to a lease are subject to all requirements of the Plan and Board Orders in the same manner as registered producers; however, producing and marketing pursuant to a lease does not grant person any voting rights or voting privileges under the Plan. 8 Subject to clause 9 of this Order, the registered producer who leases out base quota and the person who is the quota lessee are jointly and severally liable for: (a) all operating fees, levies, over-marketing penalties, and charges assessed by the Board; and (b) any judgement obtained through the courts respecting payment of any fees, levies, over-marketing penalties and charges assessed by the Board. 9 A registered producer who leases out quota shall not be responsible for paying the over-marketing penalties assessed on hatching eggs produced and marketed pursuant to the lease if the quota lessee is a registered producer; in this situation, the quota lessee will be responsible for paying the over-marketing penalties. 1942 THE SASKATCHEWAN GAZETTE, September 18, 2009

10 The registered producer who leases out base quota and the quota lessee are jointly responsible for reducing the quantity of broiler hatching eggs produced and marketed pursuant to the base quota under lease in the event the Board finds it necessary to reduce quota allocation during the period the lease is in effect. If a lease terminates prior to a required reduction being put into effect, the reduction will be the responsibility of: (a) the registered producer leasing out the quota if the lessee is not a registered producer; and (b) the quota lessee if the lessee is a registered producer. 11 The Board may rescind a lessee’s license if either the registered producer leasing out the quota or the quota lessee fail to comply with the Plan, Board Orders or any term or condition attached to a lease approval by the Board. 12 Board Order 44/07, Base Quota Leasing, is hereby fully revoked. 13 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the council. Order No. 48/09 is made pursuant to clause 8(1)(r) and subsection 21.4(1) of The Broiler Hatching Egg Marketing Plan Regulations and shall be effective upon the date of this Order.
