DIRECTORATE-GENERAL FOR EXTERNAL POLICIES POLICY DEPARTMENT IN-DEPTH ANALYSIS EU relations with Armenia and Azerbaijan ABSTRACT The EU is currently reshaping its relationship with Armenia and Azerbaijan through new agreements for which the negotiations ended (Armenia) or started (Azerbaijan) in February 2017. After Yerevan’s decision to join the EAEU (thereby renouncing to sign an AA/DCFTA), the initialling of the CEPA provides a new impetus to EU-Armenia relations. It highlights Armenia’s lingering interest in developing closer ties with the EU and provides a vivid illustration of the EU’s readiness to respond to EaP countries’ specific needs and circumstances. The CEPA is also a clear indication that the EU has not engaged in a zero- sum game with Russia and is willing to exploit any opportunity to further its links with EaP countries. The launch of negotiations on a new EU-Azerbaijan agreement – in spite of serious political and human rights problems in the country – results from several intertwined factors, including the EU’s energy security needs and Baku’s increasing bargaining power. At this stage, Azerbaijan is interested only in forms of cooperation that are not challenging the political status quo. However, the decline in both world oil prices and domestic oil production in this country is creating bargaining opportunities for the EU in what promises to be a difficult negotiation. Procedure 1. On 1 June 2018, the motion for a resolution on “Political prisoners in Azerbaijan” (Doc. 14538) was referred to the Committee on Legal Affairs and Human Rights for report.2 I was appointed rapporteur by the Committee at its meeting in Strasbourg on 26 June 2018. 1.2. Issues at stake 2. The issue of political prisoners in Azerbaijan has been of concern to the Council of Europe since the time of the country’s accession. Following the 2001 examination of cases by the independent experts of the Secretary General (SG/Inf(2001)34, discussed below), the Parliamentary Assembly, in its Resolution 1272 (2002) on political prisoners in Azerbaijan, reiterated that no-one may be imprisoned for political reasons in a Council of Europe member state. In its Resolution 1359 (2004), the Assembly “formally ask[ed] the government of Azerbaijan for the immediate release on humanitarian grounds of political prisoners whose state of health is very critical, prisoners whose trials were illegal, prisoners having been political activists or eminent members of past governments, and members of their families, friends or persons who were linked to them … [and] the remaining political prisoners already identified on the experts' list.” In 2005, the Assembly adopted Resolution 1457 and Recommendation 1711, recalling its previous resolutions and, inter alia, calling on the Committee of Ministers to join it in adopting a joint position on the issue of political prisoners in Azerbaijan. -

The energy reserves and production potential of the Caspian The issue of Caspian energy development has been dominated by four factors. The first is uncertain oil prices. These pose a challenge both to oilfield devel- opers and to the promoters of pipelines. The boom prices of 2000, coupled with supply shortages within the Organization of the Petroleum Exporting Countries (OPEC), have made development of the resources of the Caspian area very attractive. By contrast, when oil prices hovered around the $10 per barrel level in late 1998 and early 1999, the price downturn threatened not only the viability of some of the more grandiose pipeline projects to carry Caspian oil to the outside world, but also the economics of basic oilfield exploration in the region. While there will be some fly-by-night operators who endeavour to secure swift returns in an era of high prices, the major energy developers, as well as the majority of smaller investors, will continue to predicate total production costs (including carriage to market) not exceeding $10–12 a barrel. The second is the geology and geography of the area. The importance of its geology was highlighted when two of the first four international consortia formed to look for oil in blocks off Azerbaijan where no wells had previously been drilled pulled out in the wake of poor results.1 The geography of the area involves the complex problem of export pipeline development and the chicken- and-egg question whether lack of pipelines is holding back oil and gas pro- duction or vice versa. -

Cut off and blockaded from the rest of Azerbaijan as a result of the conflict with Armenia, their traditional economic structure and markets destroyed by the collapse of the former Soviet Union, their physical and social infrastructure hampered by a decade or more of lack of maintenance and rehabilitation funding, NAR’s present status is worse than much of the rest of the country and its prospects for the future require imagination and innovative thinking. This report deals with the challenges of NAR today and what peoples’ priorities are for the future. -

TO THE PRESIDENT OF THE AZERBAIJAN REPUBLIC Mr. HEYDAR ALIYEV* Dear Heydar Aliyevich, According to the exchange of views on the issues of strengthening the ceasefire regime, which took place in Baku, I am sending to you, as it was agreed, the proposals of the Minsk Conference co- chairmen. The proposals of the mediator on strengthening the ceasefire in the Nagorno Karabakh conflict On behalf of the Co-chairmanship of the OSCE Minsk Conference (hereinafter – the Mediator), with the purpose of strengthening the ceasefire regime established in the conflict region since May 12, 1994 and creating more favourable conditions for the progress of the peace process, we jointly suggest that the conflicting sides (hereinafter – the Sides) should assume the following obligations: 1. In the event of incidents threatening the ceasefire, to immediately inform the other Side (and in a copy – the Mediator) in written form by facsimile or by the PM line with an exact specification of the place, time and character of the incident and its consequences. The other Side is informed that measures are being taken for non-admission of reciprocal actions which could lead to the aggravation of the incident. Accordingly, the other Side is expected to take appropriate measures immediately. If possible, proposals about taking urgent measures to overcome this incident as quickly as possible and restore the status quo ante are also reported. 2. Upon receiving such a notification from the other Side, to immediately check the facts and give a written response not later than within 6 hours (in a copy – to the Mediator). -

£AZERBAIJAN @Hostages in the context of the Karabakh conflict - an update Introduction Hostage-taking has been an intractable problem since the beginning of the conflict over Karabakh - an area of Azerbaijan populated mainly by ethnic Armenians. Over 20,000 people are estimated to have died in this conflict which has spread beyond Karabakh, now under the overall control of ethnic Armenian forces, to other areas of Azerbaijan which they have occupied. Hundreds of people, many unarmed civilians, have been held as hostages by all sides to the conflict. These hostages have been held by private individuals, with the knowledge and/or complicity of the authorities. They have also been held by the authorities themselves, who in some cases are reported to have detained people and then distributed them as hostages to private families who have members held as hostages by the other side. There have been many reports of torture and ill-treatment in detention. The self-perpetuating cycle of taking hostages to exchange for those held by the other side has been exacerbated by the activity of intermediaries, who have brokered hostage distribution to families, or their exchange, for money. Even corpses are traded. Humanitarian law forbids hostage-taking under any circumstances. Amnesty International has persistently appealed to all parties to the conflict to ensure that no one is detained as a hostage, or otherwise held solely on the grounds of their ethnic origin. The organization strongly believes that all human rights violations are to be deplored and that in no circumstances can abuses perpetrated by one party be used as justification for abuses carried out by another. -

Chapel Hill 2016 Approved by: Erica Johnson Michael Morgan Chad Bryant © 2016 Benjamin Midas ALL RIGHTS RESERVED ii ABSTRACT Benjamin Midas: Nationalist Rhetoric and Public Legitimacy in Ilham Aliyev’s Azerbaijan (Under the Direction of Erica Johnson) This thesis explores the question of why nondemocratic leaders use nationalist rhetoric in ways very similar to democratic leaders through a case study of Azerbaijan. I argue that Azerbaijan’s president Ilham Aliyev uses nationalist rhetoric in order to build public legitimacy for his regime. Despite not needing to build a base of support for legitimate elections, Aliyev needs to legitimate his regime in the eyes of his citizens. To do so he uses nationalist themes in his speeches that resonate with Azerbaijani population to develop popular support. These themes come from applying theories of nationalism to the context of Azerbaijan. I will show the nationalist themes Aliyev utilizes in his speeches and how the use of those themes changes in response to events in Azerbaijan.
