Pursuant to Governor Cuomo’s Executive Order 202.8, which bans large meetings due to the coronavirus (COVID-19), and Executive Order 202.1, which suspends the Open Meetings Law, the meeting will be held electronically instead of a public meeting open for the public to attend in person. Members of the public may listen and view the meeting live on Verizon channel 34 and Spectrum channel 1303, and via livestream on the Town website. AGENDA 1. Call to Order 2. Feeney, Chairman & Town Planning Board FROM: Kenneth Kovalchik, AICP, Town Planner Date: July 22, 2020 SUBJ: Final Environmental Impact Statement – Rapp Road Residential/Western Avenue Mixed Use Redevelopment Projects DECISION ONLY OF ACCEPTING AS COMPLETE THE FINAL ENVIRONMENTAL IMPACT STATEMENT _______________________________________________________________________________ BACKGROUND The Planning Board held the public hearing on the Draft Environmental Impact Statement on May 13, 2020. Pursuant to 6 CRR-NY 617.9.a.5 the lead agency must prepare or cause to be prepared, and must file a Final Environmental Impact Statement (FEIS) within 45 calendar days after the close of the public hearing. At the July 8, 2020 Planning Board meeting the Board extended the deadline for preparing and filing the FEIS for up to an additional 45 days (August 24, 2020), allowed pursuant to 6 CRR-NY 617.9.a.5.ii.a. Town staff were involved in the preparation of the FEIS and reviewed and edited a number of drafts prior to consideration of acceptance as complete by the Planning Board. NEXT STEPS If the Planning Board accepts the FEIS as complete the next steps in the EIS process will include the following: 1. Pursuant to 6 CRR-NY 617.11.a – Prior to a lead agency’s decision on an action that has been subject of a final EIS, if shall afford agencies and the public a reasonable time period (not less than 10 calendar days) in which to consider the final EIS before issuing its written findings statement. 2. Pursuant to 6 CRR-NY 617.11.b – In the case of an action involving an applicant, the lead agency’s filing of a written findings statement and decision on whether or not to fund or approve an action must be made within 30 calendar days after the filing of the final EIS. 3. Pursuant to 6 CRR-NY 617.11.c – No involved agency may make a final decision to undertake, fund, approve or disapprove an action that has been the subject of a final EIS, until the time period provided in subdivision (a) of this section has passed and the agency has made a written findings statement. Findings and a decision may be made simultaneously.
