UNIVERSITY CHALLENGE SERIES 24 (2017) CONTESTANT APPLICATION FORM

PLEASE READ THIS APPLICATION FORM, INCLUDING THE TERMS AND CONDITIONS, VERY CAREFULLY BEFORE COMPLETING AND SIGNING.

1. You are applying to be considered as a contestant in the programme entitled “UNIVERSITY CHALLENGE SERIES 24” (the “Programme”, “University Challenge”) which ITV Studios Limited (“we”, “us”, “our”) intends but does not undertake to produce for initial transmission by the BBC (the “Broadcaster”).

2. The Programme is a quiz programme in which two teams of university students compete against each other in answering general knowledge questions on a wide range of subjects.

3. Please fill out this entire application form (the “Application Form”) legibly using dark-coloured ink. You must fill out the entire Application Form. Do not leave any question unanswered. If any question is not applicable to you, please write “N/A” in the space provided. If you run out of space answering any question, please use the back of the form and reference the question(s) accordingly.

4. Each team member and the reserve member is required to read, complete and sign an Application Form on an individual basis.

5. The Application Test should be completed by all four team members and the reserve member collectively and returned together with the completed Application Forms.

6. Please note that Application Forms must not be returned by email, as they require your signatures.

7. Return the completed Application Forms and recent photographs for each team member and the reserve member, plus the Application Test, as a collective submission in the FREEPOST envelope provided to be received by Wednesday 23 November 2016. NO OTHER ADDRESS IS REQUIRED – YOU DO NOT NEED TO ADD ANY OTHER ADDRESS DETAILS. We reserve the right to extend the closing date at our sole discretion.

8. Please can all team captains seek permission from their team members (including the reserve) to obtain their telephone and email details for future reference in connection with their application.

9. ALL TEAM MEMBERS, INCLUDING THE RESERVE TEAM MEMBER, MUST KEEP A COPY OF THEIR RESPECTIVE APPLICATION FORM (AS COMPLETED BY THE INDIVIDUAL TEAM MEMBER) FOR FUTURE REFERENCE.

ACCURACY OF INFORMATION PROVIDED

1. You undertake that the information you give in this Application Form is correct, that you accept the terms and conditions of entry as set out at the end of this Application Form (the “Terms and Conditions”) and that you meet each of the Eligibility Requirements as detailed below.

2. If any of the information you provide in this Application Form changes after you submit the Application Form, you agree to inform us promptly of any such change.

3. You acknowledge and agree that, if we select you to appear in the Programme and you have given false information in this Application Form, or fail to abide with the Eligibility Requirements, or the Terms and Conditions, or any of our other reasonable instructions or directions, we shall be entitled to terminate your participation in the Programme

RECORDING DATES AT DOCK10, MEDIACITYUK, SALFORD, M50 2HQ (OR SUCH OTHER LOCATION(S) AS WE MAY SPECIFY).

The following dates are subject to change. Any changes will be communicated to team members, including the reserve member, all of whom will be required to confirm their eligibility to participate on any revised dates.

1st Round Your team (including reserve member) will be required for one or possibly two days out of the four day period from Friday 24 February 2017 to Monday 27 February 2017.

2nd Round Your team (including reserve member) will be required to be available throughout the three day period from Friday 24 March 2017 to Sunday 26 March 2017.

3rd Round Your team (including reserve member) will be required to be available throughout the three day period from Friday 28 April 2017 to Sunday 30 April 2017.

PROGRAMME ELIGIBILITY REQUIREMENTS

These are the Eligibility Requirements for University Challenge Series 24 (2017):

1. A team consists of four team members and one reserve member, subject to Eligibility Requirement 10 below.

2. Team members and the reserve member must not have appeared in the televised version of University Challenge for any university or university college on any previous occasion.

3. University Challenge is a competition for teams of students. For the purposes of University Challenge, we are defining a “student” as a person:

(a) who has enrolled with a university or university college; and

(b) who is following a recognised course of study at that university or university college; and

(c) whose final award in respect of that course of study has not yet been communicated by that university or university college.

4. Team members and the reserve member must be available to attend all the recordings of University Challenge on the dates notified to them by the University Challenge producer.

5. At the time of completing the Application Forms, and throughout all recording all team members and the reserve member must be students at the UK university or university college which is named on their Application Form and which will be named on the desk at which they sit to compete in the studio recordings of University Challenge.

6. Both undergraduate and postgraduate students are eligible to participate in University Challenge, subject to following a course of study at level 6 or above within the Framework for Higher Education Qualifications as at August 2015, encompassing:

(a) Bachelor’s Degree;

(b) Graduate Certificate;

(d) Master’s Degree;

(e) Postgraduate Certificate;

(f) Postgraduate Diploma;

(g) Doctorate,

7. Students on both full-time and part-time courses are eligible to participate in University Challenge.

8. If an overseas student is studying at a UK university or university college as part of their course, they will be eligible to participate in University Challenge, but only if they are studying at that UK institution for the whole period of recording.

9. Students who are undertaking a sabbatical, whether paid or unpaid, are not eligible to participate in University Challenge if the period during which they undertake their sabbatical coincides with any of the recording dates for University Challenge.

10. All team members and the reserve member must be students at the UK university or university college which is named on their Application Form for each separate recording in which they appear during the series of University Challenge.

If a team member ceases to be a student (as defined in Eligibility Requirement 3 above) prior to or during the recordings of the programme, they must inform the University Challenge producer immediately when they cease to be eligible to take part.

If a team member becomes ineligible to participate prior to the commencement of recording, they may be replaced by an eligible reserve member who must be part of the initial team selection process.

If a team member becomes ineligible after the recording has commenced then the team may have to withdraw from the competition. Only in exceptional circumstances will the University Challenge producer consider a reserve member replacing a team member who is no longer eligible. Please note the University Challenge producer’s decision is final in this regard.

11. Once the Application Forms have been submitted, if prior to or during the recording of University Challenge a team member or the reserve member transfers from one university or university college to another, they must inform the University Challenge producer at the first opportunity. They will cease to be eligible to play for the institution under whose name they have applied or competed up to that point, and will not be eligible to play for the institution to which they transfer. This rule applies to transfers from one university to another. It also applies to transfers from one college to another within a collegiate university system.

12. If a reserve member takes over from a team member they do so for the full duration of the recordings in which the team participates and the replaced team member can no longer participate in any further recordings for this or any other university or university college.

13. Subject to Eligibility Requirement 9 above, being in employment as well as being a student does not preclude a team member or reserve member from entering or appearing on University Challenge provided they satisfy Eligibility Requirement 3 above. However all employment details must be provided in the relevant section of the Application Form. If, after having completed the Application Form and whilst still participating in University Challenge, a team member or the reserve member takes on employment, they must at their first opportunity inform the University Challenge producer of their change in circumstances. Provided they continue to satisfy Eligibility Requirement 3 above, they will still be eligible to participate in the programme.

14. It is the team member’s responsibility to ensure that the information given in the statement they make on screen at the beginning of each recording of University Challenge, which may include but is not confined to their name, place of birth and course of study, is accurate and reflects their status as a student at the time of each recording.

15. There is no upper or lower age limit on contestants participating in University Challenge; however, if a team member or reserve member is under the age of 16, their participation may be subject to: (i) the consent of their parent or legal guardian, and their parent or legal guardian may be required to accompany such contestant to the studio recording(s); and (ii) obtaining all necessary permissions and licences (including but not limited to permission from the local education authority).

16. ITV Studios Limited has the right at its sole discretion to add to, delete from, modify or amend these Eligibility Requirements and to select participants for University Challenge. In all circumstances concerning the interpretation and application of these Eligibility Requirements, ITV Studios Limited’s decision will be final.

(The foregoing shall be collectively referred to as the “Eligibility Requirements”)

If we later discover that you have criminal convictions you have not informed us about previously, and as a result your participation in the Programme is terminated or any prize or benefit reclaimed or withheld, you accept that reference may be made to these convictions publicly.

All team members and the reserve member are required to: (i) be available to attend at Dock10, MediaCityUK, Salford, M50 2HQ (or such other location(s) as we may specify) on the dates set out above for all three recording blocks; and (ii) actually attend at Dock10, MediaCityUK, Salford, M50 2HQ (or such other location(s) as we may specify) on the dates set out above for the 1st Round and if their team progresses to the 2nd Round, on the dates set out above for the 2nd Round and if their team progresses to the 3rd Round, on the dates set out above for the 3rd Round.

HOW INFORMATION ABOUT YOU WILL BE USED

1. Your personal data (“Personal Data”) means data which relates to you, where you can be identified directly from that data or from that data together with other information in our possession.

2. Your sensitive personal data (“Sensitive Personal Data”) means personal data consisting of information as to your a) racial or ethnic origin; b) political opinions; c) religious beliefs or other beliefs of a similar nature; d) membership (or not) of a trade union; e) physical or mental health or condition; f) sexual life; g) commission or alleged commission of any offence; h) involvement in and the outcome of proceedings for any offence committed or alleged to have been committed by you. 3. We (and third parties authorised by us such as professional advisors and/or the Broadcaster and/or other companies within the ITV PLC group of companies) will use the information which you have provided to us in this Application Form, and any information which you will provide to us elsewhere during the selection process for the Programme, (including your Personal Data and Sensitive Personal Data) to assess whether or not to select you for the Programme.

4. We may also use your information to verify your age, identity and other information as we may require and to also carry out background checks with data handling agencies, law enforcement and government agencies.

5. As part of the selection process and for any issues relating to the Programme we may share your information with the Broadcaster.

6. If you are selected as a contestant for the Programme, your information may be used in connection with the production and exploitation of the Programme.

7. We may also use your information to deal with any questions or complaints arising in relation to the Programme.

8. We (or other group companies) will only contact you about special editions of the Programme (if any) and other shows produced by us or by another company within the ITV plc group of companies if you have specifically consented under the section headed “Future Contact” below. If you do not consent to this future use of your information and you are not selected to participate in the Programme your completed Application Form and the information herein and the information which you may have provided to us

elsewhere during the selection process and/or during production of the Programme will be securely destroyed once the Programme selection process has been completed.

9. We may also at any time disclose your information to law enforcement bodies or regulatory bodies in connection with a request from that body or in relation to any alleged offence or unlawful activity or where required by law or court order.

10. At any time during the selection process and if your application is successful the period during the recording of the Programme and for a reasonable period of time after transmission of the Programme we may share your data with our professional advisors and/or the Broadcaster and/or other companies within the ITV plc group of companies.

11. You have the right of access to the information held and used by us in connection with your application for the Programme. If you decide that you no longer want us to hold, use or process all or any part of your information or you want to update your contact details please e-mail gaby.rodriguez@itv.com.

12. By completing and submitting this Application Form, you consent to the information you provide being used for the above purposes.

FUTURE CONTACT

Should you consent below, we would like to keep all the information you have provided in this Application Form and any information which you may provide to us elsewhere during the selection process and/or during production of the Programme:

(i) for use when producing special editions of, or documentaries about, the Programme (if any); and (ii) to be accessible by production team members working on other programmes produced by us or by another company within the ITV plc group of companies (the “Other Show(s)”). TERMS AND CONDITIONS

By completing and signing this Application Form you hereby agree to the following Terms and Conditions:

1. GENERAL

1.1 These Terms and Conditions relate to your application to take part in the Programme and form part of the Application Form.

1.2 Only one application per person will be considered for the Programme.

1.3 Neither we nor the Broadcaster are liable to refund any costs or expenses incurred in applying to participate in the Programme, and/or in attending any interviews (including but not limited to the costs of calls made, postage, ISP charges, telephony fees, travelling expenses, transportation, accommodation, meals, drinks, insurance, taxes and other costs) unless otherwise agreed in writing and arranged by us.

1.4 We and our subcontractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any computer network, system, server, provider, telephony system or otherwise or any postal service failures which may result in any application not being properly received.

1.5 You accept that, due to the large number of applications we receive, we cannot acknowledge receipt of Application Forms or return any Application Forms or photographs to you. We will review your application and shall decide which applications are suitable to be put forward to the next stage of the selection process. You accept and agree that contestants will be selected at our sole discretion, that such decisions shall be final and that there will be no right of appeal against any decisions taken by us on this matter.

1.6 You accept that receiving an Application Form and/or a phone call from a staff member of the Programme production team and/or attending an interview and/or attending any recording days DOES NOT automatically mean that you will be appearing on the Programme and we reserve the right at our sole discretion at any time to stand you down, even if you have been given a date to attend interviews or take part in a recording.

1.7 You agree that we may contact your university or university college to confirm your status as a current student of that university or university college.

1.8 We do not represent, undertake or warrant that we will produce or broadcast any episode of the Programme or to include any applicant’s participation in the Programme.

1.9 We cannot interview everyone or every team who applies to the Programme. If you are invited to interview, we will contact you with details of when and where it will take place.

2. YOUR OBLIGATIONS

2.1 You agree to abide by the rules and regulations of the Programme as shall be notified to you in writing or verbally. You accept that such rules and regulations may be varied by us from time to time and that our decisions in this matter are final.

2.2 You agree to attend any interview processes, recordings and any promotional activities relating to the Programme if required by us on any dates as notified to you.

2.3 If required to do so by us you agree to undertake a medical assessment, conducted by a certified practitioner.

2.4 You warrant that you comply with each of the Eligibility Requirements and, if required by us, you agree to provide us with documentary evidence as well as providing all consents and assistance in carrying out any background searches if so required by us to substantiate the information provided in this Application Form.

2.5 You warrant that nothing in this Application Form will:

2.5.1 infringe the copyright or any other right of any third party;

2.5.2 breach any contract or duty of confidence;

2.5.3 constitute a contempt of court or expose us to any civil or criminal proceedings;

2.5.4 be defamatory or blasphemous; and/or

2.5.5 otherwise be intended to bring us or any other party into disrepute.

2.6 You hereby warrant that you have truthfully and accurately completed this Application Form and acknowledge and agree that we may in our sole discretion disqualify you from any stage of the Programme interviewing and selection process or the Programme itself and/or withhold or reclaim any prize or other benefit awarded or due to be awarded to you as a result of your participation in the Programme if:

2.6.1 you supply or have supplied any untruthful, incomplete, inaccurate or misleading details and/or information or you have deceived us or the Broadcaster in any way including without limitation about your identity;

2.6.2 you fail to abide by these Terms and Conditions or the rules and regulations of the Programme;

2.6.3 you fail to abide with any of our other reasonable instructions or directions;

2.6.4 by reason of your conduct (including past conduct) you bring us or the Broadcaster into disrepute; and/or

2.6.5 you fail to meet the Eligibility Requirements.

2.7 You agree to notify us of any changes to the circumstances and/or information and/or data provided in this Application Form, including any criminal charges, investigations and/or convictions which are brought against you, during your continued participation in the Programme selection process and the Programme itself.

2.8 You agree to indemnify us and our assigns and licensees against any and all claims, losses and/or damages suffered directly or indirectly by us as a result of the breach, non-performance or non-observance by you of any of your obligations and representations under this Application Form including but not limited to any extra costs of production of the Programme.

2.9 You agree to notify us of any material fact of which you are aware that may in our reasonable opinion bring us, the Broadcaster, or the Programme into disrepute or may jeopardise or otherwise negatively impact on the Programme.

2.10 Should you be selected to take part in the Programme you agree and undertake to enter into further contracts with us including without limitation a Contestant Agreement and any rules of the Programme and you agree to abide by the terms therein.

2.11 You agree to notify us if you are employed by, or have been previously employed or engaged by, either us, the Broadcaster, or any associated group company, or if you are an immediate relative of an employee or contractor of us, or the Broadcaster, or any associated group company.

2.12 You hereby confirm that you have not entered into any commercial or other sponsorship agreements or arrangements with any person, firm or company in respect of your Application and/or appearance in the Programme and will not do so.

3. INTELLECTUAL PROPERTY RIGHTS

3.1 In the event that you are invited to attend an interview and any other subsequent stages of the Programme selection process, you agree and consent to the filming and recording of you and your voice, conversation and sounds, including any performance of any musical composition(s), during and in connection with your application for the Programme (the “Contribution”) and the use of your Contribution in connection with the Programme in whole or in part or not at all.

3.2 You irrevocably grant and assign to us by way of present assignment of present and future copyright, all rights of any nature in and to the rights, title and interest in your Contribution so as to permit the fullest use throughout the world of the Contribution or any part(s) thereof by all means and in all media in connection with the Programme or otherwise in perpetuity. For purposes of clarity, you accept that we have the right to edit, copy, adapt or translate the Contribution as we see fit.

3.3 You further agree that any photographic material(s), video material(s) and/or any other materials you have submitted as part of your application to appear as a contestant in the Programme and/or as part of your Contribution (collectively referred to as the “Submission”) may be featured in the Programme and you warrant that you have the necessary licences, rights, consents and permissions to authorise us to use your Submission in full or in part.

3.4 You grant us a worldwide, perpetual, royalty free and transferable licence (with the right to sub-license) to use, edit, record, modify, translate, distribute, make available to others, prepare derivative works of and exploit your Submission by any medium or method whether now known or later developed throughout the world for the full term of copyright and other rights and all renewable and extension thereof. You agree to provide us with details of all such licences, rights, consents and permissions relating to the Submission if we so request.

3.5 For the avoidance of doubt, you agree that we have no obligation whatsoever to return any materials (including without limitation, the Submission) which you have submitted as part of this application whether or not you are selected as a participant and that we are in no way obligated to use any such materials in connection with the Programme.

3.6 You grant us the right to use your name, voice, likeness, photographs and any biographical material and any Contribution or Submission concerning you in connection with the promotion and exploitation of the Programme and/or ancillary products/services and/or in connection with us and/or the broadcaster of the Programme, throughout the world in all media in perpetuity.

3.7 You irrevocably waive the benefits of and agree not to assert any provision of law known as "moral rights" or any similar laws of any jurisdiction in respect of any Contribution and/or Submission.

4. CONFIDENTIALITY

4.1 You shall keep confidential and shall not disclose to any third party any confidential information, photographs or other material relating to us or the Programme or anyone taking part in it which comes to your knowledge as result of your participation in the Programme. The foregoing will not include matters already in the public domain (other than by way of your breach of this clause).

4.2 You shall not disclose any information concerning this Application Form and/or the Programme or your Submission to any other person or company, whether by means of discussion, letter, press, photograph, television interviews, publication, social networking sites, “tweets” or by any other means now known or hereafter invented, without our prior written consent.

5. MEDIA ATTENTION

The Programme can attract an enormous amount of public and media interest. 6. APPLICATIONS FROM ALL FAITHS

We positively welcome members of all faiths to participate in the Programme and we treat Programme applications from all faiths equally. However, please note that the schedule for recording the Programme is drawn up and confirmed many months in advance, and has to take into consideration a large number of variables including studio availability, the availability of all members of the crew and production team, and the delivery of the Programme to the Broadcaster. In addition, there are financial constraints which make it imperative that the Programme is recorded in the most cost-effective and efficient manner possible. As several days of the week are regarded as sacred by different faiths, it is impossible to devise a schedule which would enable us to meet the logistical and financial pressures of production whilst also giving an unconditional guarantee to all contestants that, throughout all stages of the competition, no player of whatever faith would be asked to play on a day or at a time that their religious observance would preclude.

7. MISCELLANEOUS

Should there be a dispute regarding your participation in the Programme our decision on this dispute shall be final and you will have no right of appeal. You agree that we may freely assign or license our rights and interests under this Application Form and that this Application Form and any non-contractual obligations arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the law of England and Wales and each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim that arises out of or in connection with this Application Form or its subject matter
