    13/10/2002 BN retains Gaya with huge increase in majority Joniston Bangkuai KOTA KINABALU, Sat. - Barisan Nasional tonight retained the Gaya parliamentary seat with almost a three-fold increase in majority despite a low voter turnout of 44.73 per cent, believed to the lowest ever in Malaysia's by-election history. Liew Teck Chan collected 15,639 votes to win by a 11,923 vote majority compared with the 4,117 majority obtained by Datuk Yong Teck Lee when he won the seat for the BN in the 1999 general election. DAP's Dr Hiew King Cheu secured 3,716 votes while Christina Liew Chin Jin of Parti Keadilan Nasional lost her deposit when she received 2,613 votes. There were 132 spoilt votes. The result was announced by returning officer Alijus Sipil after 9pm at the Maksak Hall in Likas. Election Commission secretary Datuk Wan Ahmad Wan Omar described the turnout as among the lowest ever recorded in the country's by-election history. "The voters could have moved to other areas. I believe that is the main reason," he said. Gaya, which covers the Likas and Inanam State constituencies, has 49,427 registered voters, including 76 postal voters. Despite the fine weather, voters, especially those in urban areas, shunned the 21 polling centres which closed at 5pm. With the DAP and Keadilan unable to reach a compromise over a single opposition candidate, it is believed that many had stayed away from the ballot boxes since the result was a foregone conclusion. To coax more voters to the balloting centres, the BN provided transport, with cars and four-wheel drive vehicles decorated with party flags and stickers making several trips.

    SUBMISSION OF THE MALAYSIAN BAR COUNCIL 1. On 28 April 2006 the Government of Malaysia (“GOM”) submitted an aide-memoire (“AM”) to the Secretariat of the United Nations detailing GOM’s voluntary pledges and commitments in respect of its candidature to the Human Rights Council. 2. The Bar Council of Malaysia, the regulator of the legal profession in Peninsular Malaysia and which represents currently about 12,600 practising advocates and solicitors, hereby makes its submission to the Human Rights Council. The state of human rights in Malaysia today is different than under the previous administration. We have assessed the state of human rights in Malaysia vis-à- vis GOM’s voluntary pledges and commitments. 3. Universal Declaration of Human Rights (“UDHR”)/International Human Rights Treaties, Laws and Norms (GOM’s statement in para. 2 of the AM). 3.1 UDHR. There has been no real attempt to understand and interpret the Federal Constitution in light of GOM’s stated commitment to the UDHR. The Malaysian courts have taken the clear positioni that the UDHR is merely a statement or declaration which is not legally-binding on GOM. GOM has stated on numerous occasions that UDHR would only be given effect insofar as it is not inconsistent with the Federal Constitution. This is one possible reason for GOM’s apparent reluctance to-date to accede to and ratify the International Covenant on Civil and Political Rights (“ICCPR”) and International Covenant on Economic, Social and Cultural Rights (“ICESCR”), and their respective optional protocols. 3.2 Women. GOM acceded to the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) in 1995 with reservations (see Appendix A).

    MALAYSIA IN 2002 Political Consolidation amid Change? N. Ganesan Abstract In 2002, the Malaysian government underwent significant political consolidation. Despite Prime Minister Mahathir Mohamad’s sudden announcement in June of his resignation, he will remain in office until October 2003, after which Deputy Prime Minister Abdullah Badawi will replace him as prime minister. The government’s political consolidation derived partly from its war on terrorism, which allowed it to marginalize the mainstream opposition. Additionally, opposition parties themselves are in disarray. Economically, the country performed well, and unorthodox measures introduced after the Asian financial crisis have begun to pay off. In foreign affairs, Malaysia achieved good accommodation with the U.S. but suffered from hiccups in its bilateral relations with regional neighbors. In 2002, the United Malays National Organization (UMNO)-led Barisan Nasional (BN, National Front) government underwent significant political consolidation. It benefited from weaknesses in the politi- cal opposition and capitalized on the war against terrorism internally and ex- ternally. Prime Minister Mahathir Mohamad’s sudden announcement in June of his resignation was followed shortly after by an announcement that he would remain in office until October 2003, when Malaysia will host the Or- ganization of Islamic Conference (OIC) meeting. Additionally, Mahathir anointed his deputy, Abdullah Ahmad Badawi, as his choice for the next prime minister. Of the opposition political parties, Parti Islam Se-Malaysia (PAS, Pan Malaysian Islamic Party) suffered from the death of its leader Fadzil Noor, also in June, and Parti KeADILan (National Justice Party) suf- N.     SABAH TO FACE SNAP ELECTIONS Asrin Utong Programme Executive, IMAN Research The botched dissolution of the state legislative assembly led by Parti Warisan Sabah is by now inevitable. Following the press conference on 30th July, Shafie Apdal, the Chief Minister of Sabah, who is also the President of Warisan, announced that the dissolution of state legislative assembly has been granted by Tuan Yang Terutama (TYT) Tun Juhar Mahiruddin, the state Governor.1 The Election Commission (EC) in its statement to the media also acknowledged receiving official announcement from Sabah State Legislative Assembly. According to the EC, elections shall be held within 60 days from the date of the dissolution.2 The dissolution of the state assembly was a tit-for-tat move by Shafie Apdal, following a declaration by Musa Aman that he has the number to form a government. According to the latter, 33 state assemblymen from 60 state constituencies in Sabah are with him.3 The post-14th General Election saw Barisan Nasional and Parti Warisan Sabah (Pakatan Harapan’s coalition) each obtained 29 of the State Legislative Assembly seats, while the other two seats were won by Parti Solidariti Rakyat Sabah (STAR) which sided with BN Sabah spearheaded by Musa Aman, with 31 seats. The United Pasokmomogun Kadazandusun Murut Organization which is now called the United Progressive Kinabalu Organisation (UPKO) after rebranding itself recently, has decided to leave the Barisan Nasional pact. Despite that decision, four UPKO assemblymen still showing their support for Musa Aman as the Chief Minister. A day after the General Election concluded, six Barisan Nasional assemblymen quit the party and joined Warisan and supported Shafie Apdal as the Chief Minister on 12th May 2018.

Tidak kurang juga pengibar bendera putih yang diganggu oleh pihak penguatkuasa dan diugut untuk tidak diberikan bantun oleh kerajaan, MP, Adun atau agensi seperti Jabatan Kebajikan Masyarakat (JKM). Inisiatif bendera putih kini telah diluaskan kepada aplikasi mudahalih yang dinamakan Sambal SOS. Aplikasi tersebut menolong golongan yang memerlukan dengan menyediakan lokasi ‘foodbank’ dan juga lokasi dimana bendera putih dikibarkan bagi memudahkan proses menjejaki mereka untuk menghantar bantuan yang diperlukan. Perlu diingat, bendera putih bukanlah menandakan rakyat sudah mengalah, namun merupakan tekad mereka untuk meneruskan kehidupan seharian.
