NEW DELHI: Even as the legal battle between the National Pharmaceutical Pricing Authority (NPPA) and Pharma companies is on, develop- ments in the industry took a new turn. The De- partment of Pharmaceuticals under the Minis- try of Chemical and Fertilisers has clarified that after careful consideration in consultation with the Ministry of Law and Justice it had decided to convey to the courts that the guidelines dated May 29 this year are to be withdrawn. The clarification came as a booster dose to pharma companies which were up in arms with the regulator. The industry interprets the clari- fication as curtailment of power of the NPPA from a prospective date. However, the Govern- ment says that the July 22 order of NPPA needs to be seen in the above context. Vindicated pharma camp “The Govern- goes into jubilation mode ment has neither On P4 withdrawn the powers delegated to NPPA on May 30, 2013 nor NPPA has been directed to withdraw the orders dated July 10, 2014,” the department said in a statement. The department’s response to the Courts about the powers of the National Pharmaceutical Pric- ing Authority’s (NPPA) to fix the prices of non-es- sential medications, has come as a pleasant sur- prise for the pharma industry which was striving hard for an amicable settlement of the dispute arising out of the price control order. The recent clarification of the Department of Pharmaceuticals was against NPPA’s decision to cap prices of more than 100 drugs. The deci- sion had evoked protests from several pharma- ceutical groups, which even took recourse to legal action against the regulator. The NPPA had even withdrawn a controversial guideline it had invoked to cut prices of drugs outside of a gov- ernment-drawn list of essential medicines after receiving directions from the department. referred to by lesser mortals as ‘bed bugs’. Ranbir is not alone to face such a hopeless situa- tion at the AIIMS. “If the doors of government hos- pitals are shut on poor patients at the time of emer- gency, where they would go,” blurts out a patient in distress. Ramswarup from Saharanpur (UP) had a hard time wriggling through the hospital’s unfriendly administrative set-up. He requires neurological evaluation. “We’ve been coming here for the last three days, but have yet to get a bed despite having date. We have lost all hope,” says Ramswarup. YK Gupta, 50, former employee with DTMT, died after being turned away from AIIMS on the same excuse – non-availability of bed. A type 2 diabetes patient, Gupta was rushed to AIIMS as his condition deteriorated following an at- tack of pneumonia. His relatives tried to persuade officials to admit him in the hospital citing non- availability of beds. In desperation his family had to take him to Safdarjung Hospital, stone’s throw from AIIMS. But, time ran out for him and he died. Expressing regret over the death, Dr Amit Gupta, spokesman of the AIIMS, offered condolences to the bereaved family and promised inquiry into the matter. He denied involvement of any employee in the misappropriation but conceded that if a VIP pa- tient or a patient with VIP recommendation comes to the hospital for admission, the hospital cannot deny him a bed. Contradicting the spokesman, AIIMS Medical Superintendent Dr DK Sharma denied any misap- propriation. Drawing a comparison between a hotel and a hospital, he said, “Unlike hotel where a chair can be vacated if the customer overstays, in a hos- pital, ailing occupant of a bed cannot be evicted to accommodate new patient.” However, he assured that if any wrongdoing comes to light, he will look into the matter and en- sure disciplinary action against whosoever is found guilty. People come here from far off places in the hope of treatment. While sometimes they deny admis- sion outright, at others keep procrastinating on their applications. If the hospital is not meant for the underprivileged, why don’t they say so in so many words? These are the common refrains heard in the AIIMS. Let spirit of Diwali prevail Diwali is here! The Festival of Lights brings in its wake all the goodies of life. Family get-together, camaraderie in the air, cheerful adults and fun- loving children, all this is reflective of the festive spirit. The festival is, in fact, a celebration of life. Enjoy the occasion while greeting each other and exchanging pleasantries with gifts amid sumptu- ous dinners with choicest delicacies and delecta- ble mouthwatering sweets. But, ensure that the celebrations are not marred by overzealousness.
