Unhcr-Richtlinien Zur Feststellung Des Internationalen Schutzbedarfs Afghanischer Asylsuchender UNHCR-RICHTLINIEN ZUR FESTSTELLUNG DES INTERNATIONALEN SCHUTZBEDARFS AFGHANISCHER ASYLSUCHENDER Der Hohe Flüchtlingskommissar der Vereinten Nationen (UNHCR) 30. August 2018 HCR/EG/AFG/18/02 VORBEMERKUNG Die UNHCR-Richtlinien werden vom Büro des Hohen Flüchtlingskommissars herausgegeben, um Entscheidungsträger wie Regierungen, nichtstaatliche Beratungsstellen sowie UNHCR-Mitarbeiter dabei zu unterstützen, die internationalen Schutzbedürfnisse von Asylsuchenden zu beurteilen. Die Richtlinien helfen bei der rechtlichen Auslegung der Kriterien der Flüchtlingseigenschaft durch die Einschätzung der sozialen, politischen, wirtschaftlichen und humanitären Bedingungen sowie der Sicherheits- und Menschenrechtslage im betreffenden Herkunftsland. Die entsprechenden internationalen Schutzbedürfnisse werden detailliert analysiert. Zudem werden Empfehlungen dahingehend abgegeben, wie die in Frage stehenden Anträge in Übereinstimmung mit den relevanten Prinzipien und Kriterien des Flüchtlingsrechts – insbesondere der UNHCR-Satzung, des Abkommens von 1951 über die Rechtsstellung der Flüchtlinge und dem dazugehörigen Protokoll von 1967 sowie relevanten regionalen Instrumenten wie beispielsweise der Erklärung von Cartagena über Flüchtlinge von 1984, der OAU-Konvention von 1969 zur Regelung der besonderen Aspekte der Flüchtlingsprobleme in Afrika und der EU-Qualifikationsrichtlinie – entschieden werden sollten. Die Empfehlungen können sich gegebenenfalls auch auf komplementäre oder subsidiäre Schutzformen beziehen. UNHCR veröffentlicht diese Richtlinien im Rahmen seiner ihm gemäß Artikel 8 der Satzung in Verbindung mit Artikel 35 der Genfer Flüchtlingskonvention und Artikel II des dazugehörigen Protokolls von 1967 übertragenen Zuständigkeit, die korrekte Auslegung und Anwendung der oben genannten Flüchtlingskriterien zu fördern, und auf Grundlage der langjährigen Expertise in Angelegenheiten, die im Zusammenhang mit der Schutzberechtigung und der Bestimmung des Flüchtlingsstatus stehen. Es wird erwartet, dass die in dieser Richtlinie enthaltenen Positionen und Leitlinien bei der Entscheidung über Asylanträge von den Behörden und Gerichten sorgfältig berücksichtigt werden. Die Richtlinien basieren auf detaillierten Recherchen, Berichten von Länderbüros des globalen UNHCR-Netzwerkes, Informationen von unabhängigen Länderexperten und -wissenschaftlern sowie anderen Quellen, die gründlich auf ihre Zuverlässigkeit überprüft wurden. As of early 16 May, assessment results are available for two districts: Burka district (232 affected families) and Dahana-i-Ghuri (68 affected families). Assessment and distribution procedures: ANDMA, the Afghan National Disaster Management Committee, is the designated body within the Government to address natural disasters. In this capacity, ANDMA Baghlan provides secretarial support to the Provincial Disaster Management Committee (PDMC). The PDMC assigns joint assessment teams and approves assessment reports. Based on it ANDMA prepares an official government relief request which is then forwarded to UN agencies and NGOs for assistance. The relief request should include beneficiary lists. Normally, beneficiary lists are drawn up during assessments.

Supported by the United States Institute of Peace (USIP) as part of its broader program of study on the intersection of political, economic, and conflict dynamics in Afghanistan, the report is based on some 250 interviews with Afghan and Western officials, tribal leaders, villagers, Afghan National Security Force and militia commanders, and insurgent commanders and fighters, conducted primarily between 2011 and 2014. The growing instability of the province does not bode well for the oncoming elections, and forecasts future problems for the government and the international forces in the area. With a total of 118 candidates (including 12 women) for just 8 seats in the Wolesi Jirga – only Kabul and Laghman have a similarly high proportion of contenders – Baghlan inhabitants could be easily mistaken for a population of election enthusiasts. However, these high numbers seem to reflect more the fault lines splitting local communities and political groups, which prevented the most basics accords between candidates to take place (*). Looking at past elections, high numbers of candidates are not a new development for Baghlan. In the parliamentary elections of 2005 there were 106, and the number of participants to last year’s provincial council elections is even more striking, reaching 193 candidates for the 15 seats body. Baghlan has been characterized for decades by a high number of different factions struggling to control this rich region’s economic assets and communication links and this is also reflected in the electoral competition. Baghlan is a rich province, with a flourishing agriculture blessed by the water resources of the Baghlan-Kunduz river system and by proximity and good road connections to markets like Kabul and Mazar-e Sharif.

According to press reports, the following provinces were affected last week: Nangarhar (eastern Afghanistan), Paktika, Paktia, Ghazni (south-eastern Afghanistan), Helmand, Kandahar, Zabul, Uruzgan (southern Afghanistan), Kunduz, Baghlan (north-eastern Afghanistan), Farah (western Afghanistan), Faryab (northern Afghanistan), Logar and Kabul (central Afghanistan). Suicide bombings and attacks On 13 March 2017, a minibus hit a roadside bomb in the 10th police district of the capital Kabul, killing one woman and wounding at least 29 persons who were employees of a telecommunications company. In Nangarhar (eastern Afghanistan) three children were killed when a booby trap exploded. In the 8th police district of Kabul, unknown gunmen shot dead two police officers. In Obe district of Herat province (western Afghanistan), members of the Taliban amputated the hand and foot of a young man who had reportedly committed a robbery. On 16 March 2017, ISIS militants beheaded three tribal elders in Sayyad district of Sar-i-Pul province (in northern Afghanistan). In Samangan (northern Afghanistan), an important Taliban Commander and an explosives expert of the Jundullah militia were arrested. On 17 March 2017, two Afghan troop were killed in a suicide bombing in Khost (south-eastern Afghanistan), wounding at least 29 persons, including civilians. In Nangarhar, one person was killed in a suicide bombing in front of a mosque.

    OFS REPORT TO CONGRESS FRONT MATTER OPERATION FREEDOM’S SENTINEL LEAD INSPECTOR GENERAL REPORT TO THE UNITED STATES CONGRESS APRIL 1, 2021–JUNE 30, 2021 FRONT MATTER ABOUT THIS REPORT A 2013 amendment to the Inspector General Act established the Lead Inspector General (Lead IG) framework for oversight of overseas contingency operations and requires that the Lead IG submit quarterly reports to Congress on each active operation. The Chair of the Council of Inspectors General for Integrity and Efficiency designated the DoD Inspector General (IG) as the Lead IG for Operation Freedom’s Sentinel (OFS). The DoS IG is the Associate IG for the operation. The USAID IG participates in oversight of the operation. The Offices of Inspector General (OIG) of the DoD, the DoS, and USAID are referred to in this report as the Lead IG agencies. Other partner agencies also contribute to oversight of OFS. The Lead IG agencies collectively carry out the Lead IG statutory responsibilities to: • Develop a joint strategic plan to conduct comprehensive oversight of the operation. • Ensure independent and effective oversight of programs and operations of the U.S. Government in support of the operation through either joint or individual audits, inspections, investigations, and evaluations. • Report quarterly to Congress and the public on the operation and activities of the Lead IG agencies. METHODOLOGY To produce this quarterly report, the Lead IG agencies submit requests for information to the DoD, the DoS, USAID, and other Federal agencies about OFS and related programs. The Lead IG agencies also gather data and information from other sources, including official documents, congressional testimony, policy research organizations, press conferences, think tanks, and media reports.

For CAT A the multipurpose cash grant the amount can cover fuel (7kg/day) for 4 months. For families residing in tents and open air an additional amount for (blankets (3)/ household, tarpaulins (2) / household, Bukhari (1) / household (90$ in total)) will be distributed. UNICEF is the main provider of NFIs in Baghlan and will only be distributing hygiene kits. Blankets are therefore essential items to be included in the project. CAT B beneficiaries will be given a multipurpose cash grant for repairs and winterization of their shelters (150 $/household – BoQ annexed).
