Abstractor March 2, 2014 to April 24, 2014

Complete an Abstract for the client by or before the set due date. Time limit differed for each parcel, and a “rush” tract would come often requiring that one or several of us work more than one tract simultaneously. Completed Abstract files contained information from the Auditor regarding the current status of the landowners in reference to their necessary payments on subject property, ALL available maps depicting the property, surface title chain and mineral title chain with detailed run-sheets summarizing everything pertinent to assigned parcel, and copies of all referenced documents. A mineral ownership report describing the outcome of the researched property title by providing the client with the most accurate description of the property, a plot of that description when possible, the current mineral owner and the status of those minerals (Leased, Producing, etc..), the current surface owner and any mortgages and/or liens/judgements against them, and locations and contact information for all. Also included are the miscellaneous documents. These are the Right-of-Ways, Affidavit’s, Judgements/Liens, Leases, Agreements, Mergers, Civil or Criminal Actions, Probate/Estate files, Identity Proof/Curative, and Outsales. These items mentioned would be indexed/filed in an order preferable to the client.

Title curative, competitor well reports, genealogy and leasing. I had to ascertain what all my resources for information were that were accessible, obtainable, available and pertinent to the Bogaczyk family. Then from the information derived via public record (e.g. land title deeds, estate files, court proceedings, marriage and divorce certificates, affidavits and various other instrument types of public record), Historical Society and local Library Archives of old newspapers containing Obituaries, wedding and birth announcements, property exchanges, etc. Also utilizing the Internet; mostly Ancestry.com, greenfreelibrary.org, and the Historical/Genealogical Societies as a means to verify and possibly close any gaps of information still appearing to be in the draft heirship breakdown report. When all information provided has been pieced together, compared, evaluated, verified and authenticated; then, to build a family tree displaying their lineage as I currently know it in the form of a graph showing the lineage of the Bogaczyk family from 1898 to present based on testate and intestate succession laws for the state and year of each of the heirs’ death. The assignment was to find the heirs to Mary Bogaczyk, deceased, and to have them all sign an Oil and Gas Lease at a firm price set by the client. I was able to successfully locate and sign all 119 heirs of Mary Bogaczyk in the above stated time frame.

My daily tasks include running surface and mineral title to determine current ownership. Then running an adverse on the Grantee’s to determine leasehold status. Also, if there is a currently producing well/s on the subject premises then include all well files, and a separate chain of title to determine the interests owned under that HBP lease. Then to include all ROW’s, Easements, Probate and Civil Records, plats, surveys and every other miscellaneous instrument pertaining to that property. I also assist the Project Manager in-house with abstract review and curative if necessary.

Landman/ Crew Chief Mar. 1, 2011 to Oct. 1, 2012

To determine net revenue interests, gross working interests and over-riding royalty interests for various depths and formations on HBP Leasehold Estates and producing wells being purchased by the client. I was then promoted to Field Crew Chief over the abstracting and acquisitions project for several of the clients proposed well sites in Morgan County, OH. Which included responsibilities to train, supervise and delegate a team of up to 8 Landman all with various levels of experience, but all new to Ohio title. Made daily contact with the Project Manager and In-house Landman for the client, to discuss weekly progress and collaborate to resolve any issues that arose.

I was brought in for the purpose of running all mineral and surface title on a very large coal company for a Law Firm. The client also required daily reports to be turned in by 8:00am every morning to show current project status and estimated time to completion. Also required was a weekly report to be turned in every Thursday at noon showing collectively the overall progress during that allotted time.

The daily tasks included negotiating with landowners for location and compensation for Pipelines, Access Roads, Compressor Sites, and Storage/Work Sites. Working with Engineers and Environmentalists delineating wetlands, flagging and obtaining GPS coordinates for final pipeline routes, property boundaries, proposed well sites, access roads, storage/work sites and compressor sites. Prepared and documented a chain of title to prove current surface ownership. Completing Right of Way Grant Reports and Land Owner Worksheets used during construction to minimize error. While in the field we used Topography and Plat maps to navigate through the initial proposed pipeline routes. Then made decisions to alter said path if necessary by determining the location of the water wells, underground springs, septic systems, water run-off, wetlands, endangered animal habitats, highways, rivers and the mountainous inclines. Drafting of Right of Way Agreements, Exhibits including addenda requested by landowners, Surface Use Agreements, and Surface Damage Agreements.

Running title, curative, abstracting, and lease packages. Conducting Genealogy research to determine the rightful heirs to an estate in question. Locate Probate files regarding testate and intestate succession transfers. Research Civil and Criminal court documents for Judgements or Liens against property owners of interest.
