SYFY WIRE’s Fan Favorite Cosplay Contest (the “Contest”) Official Rules NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. This Contest is being held in connection with the October 2020 Metaverse event scheduled to take place online from October 8 through October 11, 2020 (the “Event”). 1. CONTEST PERIOD: The Contest begins at 12:00 AM (ET) on September 28, 2020 and ends at 11:59 PM (ET) on October 6, 2020 (the “Contest Period”). 2. HOW TO ENTER: Each person who (i) enters the Contest; and (ii) meets the eligibility requirements as described in the “Eligibility” section herein shall be referred to as a “Participant”. During the Contest Period, eligible Participants may enter in the Contest by (A) posting their original photo of their original cosplay to their personal Instagram page (each such photo, an “Entry”); (B) tagging both @newyorkcomiccon and @syfywire in their Entry and including the Contest hashtag, #FanFaveCosplayContest; and (C) following @syfywire on Instagram from Participant’s personal Instagram account. Limit one Entry per Participant. Multiple Entries from the same Participant are not permitted. Entries by the same Participant in excess of the limits stated herein will be disqualified. Each Entry must meet the criteria described in the “Criteria” section below, as determined by the Judges. Any Entries (or any related elements or materials thereto) which do not meet the Criteria shall be rejected from the Contest as ineligible and such Participant shall be disqualified. Each Participant may enter the Contest as an individual or as part of a group, however multiple Entries from the same Participant are not permitted. For the sake of clarity, a Participant may either participate as an individual OR as part of a group, but no Participant may participate in the Contest more than once. Group Entries are limited to a maximum of three (3) individuals. Entering or attempting to enter the Competition multiple times through (i) the use of any robotic or automated devices to submit Entries; (ii) with the use of duplicate email accounts and/or Instagram accounts, or (iii) the use of multiple email accounts and/or Instagram accounts for a single individual, are prohibited and will be deemed void and disqualified. All Entries must be received during the Contest Period. Eastern Time shall control for all purposes of this Contest. Sponsor's clock shall be the official timekeeper for the Contest. Entries will not be acknowledged or returned. Incomplete Entries will be considered invalid and ineligible to win. Sponsor is not responsible for lost, misdirected, illegible, mistranscribed or late Entries. Proof of sending or mailing of mail-in Entries will not be deemed to be proof of receipt by Sponsor. Any Entry containing material that is violent, pornographic or otherwise obscene, illegal, or racially or morally offensive, as determined by Sponsor in its sole discretion, will be rejected as ineligible. No Entry should violate the community guidelines or standards of Instagram. In the event of a dispute over the identity of a Participant, an Entry will be deemed submitted by the authorized account holder of the email address associated with the email account and/or Instagram account from which the Entry was submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to the account by the applicable online service provider or organization. 3. CRITERIA AND JUDGING: All Entries (and any related elements and materials thereto) must meet the following criteria (collectively, the “Criteria): - must be Participant’s original work; - shall not include any content, elements or materials which belong to any third party, unless Participant has permission from the rightful owner or is otherwise legally entitled to use such content, elements or materials; - does not contain any nudity or material that is violent, pornographic or otherwise obscene, illegal, or racially or morally offensive, each as determined by Sponsor in its sole discretion; - must comply with all laws including, but not limited to, those concerning copyright, plagiarism, trademark, defamation and invasion of privacy; and - must comply with the “Terms of Submission” described herein. The Contest shall be overseen by four total judges, expected to be two (2) employees of Sponsor and two (2) employees of Universal Television Networks, Blastr Productions LLC, and/or NBCUniversal Media, LLC(collectively “SYFY”) each as selected by Sponsor(each, a “Judge” and collectively the “Judges”). The Judges shall decide the winners based on the quality and craftsmanship of each Participant’s Entry, as determined by each individual Judge’s judgment. 4. WINNER SELECTION AND PRIZES: Upon the completion of the Contest Period, the Judges shall select up to eight (8) total finalists (each, a “Finalist”) based on the Criteria at the conclusion of the Contest Period from all eligible Participants. The Finalist selection will be conducted by the Judges and by Sponsor, whose decisions are final and binding on all matters relating to this Contest. The Finalists will be chosen by majority vote of the Judges as determined by the Criteria. Following the Contest Period, beginning on October 8, 2020 and continuing through October 13, 2020 (the “Fan Voting Period”) Sponsor and SYFY shall each run the Finalist’s Entries on their official Instagram pages in three rounds of competitive voting between Finalist’s Entries. Visitors to such Instagram pages will be permitted to vote for an Entry via the “Instagram Stories” functionality (each, a “Vote”) with each individual being permitted to vote one time. In order to advance to the next round, the Finalist must collect the most Votes; failure to collect the most Votes results in such Finalist’s elimination from the Contest. Soliciting Votes or the entry (and/or attempted entry) of Votes by a Finalist through the use of any robotic or automated devices or other system (mechanical or otherwise) which improperly submits Votes in the Contest is strictly prohibited and will result in all such Votes being deemed void and any such Finalist being disqualified. Votes will not be acknowledged or returned. Incomplete Votes will be considered invalid. Upon the completion of the Fan Voting Period and the three rounds of voting, Sponsor shall review the total eligible Votes received and determine which Finalist received the most Votes. A total of one (1) winner will be selected by Sponsor and shall be determined by assessing which Finalist submitted the Entry which received the most votes from the voting public. In the event of a tie, the Sponsor will select the winner in a random drawing occurring from all eligible Finalists who are tied for the Prize. Sponsor’s decisions are final and binding on all matters relating to this Contest. Winners need not be present to win. Odds of winning are dependent upon the total number of eligible Entries received. Sponsor will attempt to notify the potential winner on or about October 15, 2020. The winner will be awarded the following prizes (each, a “Prize” and, collectively, the “Prizes”): • Two (2) 4-day badges to New York Comic Con 2021 (an estimated retail value of $400.00); • A travel stipend of One Thousand US Dollars ($1,000.00), to be provided in the form of an American Express® Gift Card or similar delivery mechanism, to be determined in Sponsor’s sole discretion; • Two (2) Tickets to a Talent Meet & Greet during New York Comic Con 2021 (an estimated retail value of $200.00); • Two (2) Front Row Seats at a Select Panel during New York Comic Con 2021 (an estimated retail value of $0); and • Two (2) Front Row Seats at the New York Comic Con 2021 “Championships of Cosplay” event (an estimated retail value of $0). The potential winner must claim their Prize immediately at the end of the Competition. After claiming the Prize, the potential winner will receive instructions on redeeming their Prize. Sponsor reserves the right, in its sole discretion, to not select a winner if an insufficient number of eligible, complete, appropriate or generally qualified Entries are received. Each Participant acknowledges that there are hazards and risks incidental to the Prizes and by accepting any Prize, a Participant freely and voluntarily assumes any and all risks of loss, property damage, injury or damage to persons, or death which are incidental to such Prize. Further, each Participant acknowledges that there is an inherent risk of exposure to communicable disease, including COVID-19, in any public place where people are present, and, by accepting the Prize, a Participant freely and voluntarily assumes any and all risks related to such exposure and agrees to follow all health and safety instructions which may be issued by local governmental authorities and/or by Sponsor in connection with such Prize. Each finalist and potential winner (and each of winner’s guest(s), as applicable) may be required, in Sponsor’s discretion, to execute and return an Affidavit of Eligibility, a Release of Liability, a Publicity Release, required payment information or tax forms, and/or proof of identification and eligibility (collectively, the “Winner Forms”), each as requested by Sponsor. If a Participant fails or refuses to sign and return all of the Winner Forms provided by Sponsor within ten (10) days (or a shorter time if required by exigencies) after receiving them, the Participant may be disqualified resulting in forfeiture of the Prize, and Sponsor reserves the right, but not the obligation, to select an alternate winner. Prizes do not include any travel expenses, personal expenses, or any other costs not specifically described in these Official Rules as included in the Prize and will be the responsibility of the winner. All expenses on receipt and use of Prizes and any applicable taxes on the Prizes are the sole responsibility of the winner.
