COMPATIBILITY DETERMINATION USE: Recreational Boating REFUGE NAME: Southwest Arizona National Wildlife Refuge Complex (comprised of Cibola, Imperial, and Kofa National Wildlife Refuges [NWR, refuge or refuges]). Kofa National Wildlife Refuge is not included in this use. There are no aquatic areas suitable for boating on Kofa NWR. ESTABLISHING AND ACQUISITION AUTHORITIES: Cibola NWR Public Land Order 3442, August 21, 1964; established the 16,627-acre Cibola NWR. Public Law No: 109-127, December 7, 2005; transferred 140.32 acres near Walter’s Camp from the U.S. Fish and Wildlife Service (Service) to the Bureau of Land Management (BLM). Between 1964 and 2006, lands were added to the refuge by various means including transfer from other federal agencies, lease, purchase, and donation bringing the total refuge acreage to its current 18,444.67 acres. Imperial NWR Executive Order 8685, Feb. 14, 1941; established the 51,090-acre Imperial NWR. Public Land Order 2630, 1962; revoked Bureau of Reclamation withdrawals in California as part of the Colorado River Storage Project. Public Land Order 3032, 1963 (28 FR 3695) (in part); transferred 3,911 acres in California from the Service to the BLM. Public Land Order 4367, 1968 (33 FR 3228) (in part); transferred 17617.23 acres in California and Arizona from the Service to the BLM. Public Law 100-696, 1988 (102 Stat. 4595) (in part); transferred land in Arizona from the Service to the State of Arizona. Public Land Order 7045, 1994 (59 FR 24947)(in part); transferred 3.75 acres of public land including lands from the Service to the State of Arizona to open land for mineral leasing and surface entry and mining (following Santa Rita Legislation). -

2019 WWA WAKESURF EVENT RULES GENERAL INFORMATION FOR ALL ATHLETES Scope of These Rules- These Rules set forth herein governs the conduct and organization of the 2019 World Wake Association Events. ("WWA” will be used as abbreviations for the rest of the rules.) These rules will be final unless specific changes, addendums and/or exceptions are distributed. It is the responsibility of each Athlete, event organizer and official to be familiar with all WWA rules. Competition Times- All riders must be on site and ready to compete 30 minutes before posted start time for the event. The WWA and/or event organizer reserves the right to change/alter schedule at any time.WWA recommends that riders be on site for at least one hour before the scheduled start of their division. Athlete and Officials Conduct: Personal Appearances - Athletes and officials shall agree to make appearances arranged for media and local sponsors. Dress Code - Athletes and officials shall abide by the WWA dress codes at designated WWA functions. Riders agree that the Organizers have the right to control or prohibit advertising material used, worn, or displayed by the rider on site during the contest. Unsportsmanlike Conduct - Any Athlete or official whose conduct is deemed unsportsmanlike, or who may cause discredit to the WWA, sponsors, or that person's home country federation, either on or off the contest site during the period of time of the contest may be fined and/or disqualified, as determined by the WWA Chief Judge. Unsportsmanlike conduct includes, but is not limited to: use of vulgar language in public, public tantrums, not riding to the fullest potential, failure to attend designated functions or events, consuming alcoholic beverages during competition, competing under false pretenses, such as not having a WWA membership, concealing significant injuries or health problems. -

Overview of USS Constitution Re-builds & Restorations USS Constitution has undergone numerous “re-builds”, “re-fits”, “over hauls”, or “restorations” throughout her more than 218-year career. As early as 1801, she received repairs after her first sortie to the Caribbean during the Quasi-War with France. In 1803, six years after her launch, she was hove-down in Boston at May’s Wharf to have her underwater copper sheathing replaced prior to sailing to the Mediterranean as Commodore Edward Preble’s flagship in the Barbary War. In 1819, Isaac Hull, who had served aboard USS Constitution as a young lieutenant during the Quasi-War and then as her first War of 1812 captain, wrote to Stephen Decatur: “…[Constitution had received] a thorough repair…about eight years after she was built – every beam in her was new, and all the ceilings under the orlops were found rotten, and her plank outside from the water’s edge to the Gunwale were taken off and new put on.”1 Storms, battle, and accidents all contributed to the general deterioration of the ship, alongside the natural decay of her wooden structure, hemp rigging, and flax sails. The damage that she received after her War of 1812 battles with HMS Guerriere and HMS Java, to her masts and yards, rigging and sails, and her hull was repaired in the Charlestown Navy Yard. Details of the repair work can be found in RG 217, “4th Auditor’s Settled Accounts, National Archives”. Constitution’s overhaul of 1820-1821, just prior to her return to the Mediterranean, saw the Charlestown Navy Yard carpenters digging shot out of her hull, remnants left over from her dramatic 1815 battle against HMS Cyane and HMS Levant. -

500 Years of Maritime History By the mid-sixteenth century King Philip of Spain felt an acute need to establish a coastal stronghold in the territory he claimed as “La Florida," a vast expanse including not only present-day Florida but most of the continent. The Atlantic coast of present-day Florida was strategically important for its proximity to Spanish shipping routes which followed the Gulf Stream and annually funneled the treasures of Philip's New Above: Traditional Spanish New World shipping routes. World empire back to Spain. The two biggest threats to this transfer of wealth were pirate attacks and shipwrecks. A military outpost on the Florida coast could suppress piracy while at the same time serve as a base for staging rescue and salvage operations for the increasing number of ships cast away on Florida's dangerous shoals. With these maritime goals in mind, the King charged Don Pedro Menéndez de Avilés with the task of establishing a foothold on Florida's Atlantic coast. Before leaving Spain, word reached the Spanish court that a group of French protestants had set up a fledgling colony in the region, and Menéndez' mission was altered to include the utter destruction of the French enterprise, which represented not only heresy but a direct threat to Spain's North American hegemony. The French Huguenots, led by René de Laudonnière, had by 1563 established Fort Caroline at the bank of the River of May (present-day St. Johns River at Jacksonville, north of St. Augustine). Early in 1565, France's King Charles sent Jean Ribault to re-supply and assume command of the Fort. -

CASE COMMENT IF IT LOOKS LIKE A VESSEL: THE SUPREME COURT’S “REASONABLE OBSERVER” TEST FOR VESSEL STATUS Lozman v. City of Riviera Beach, 133 S. Ct. 735 (2013) David R. Maass∗ What is a vessel? In maritime law, important rights and duties turn on whether something is a vessel. For example, the owner of a vessel can limit his liability for damages caused by the vessel under the Limitation of Shipowners’ Liability Act,1 and an injured seaman who is a member of the crew of a vessel can claim remedies under the Jones Act.2 Under the general maritime law, a vendor who repairs or supplies a vessel may acquire a maritime lien over the vessel.3 In these and other areas, vessel status plays a crucial role in setting the limits of admiralty jurisdiction. Clear boundaries are important because with admiralty jurisdiction comes the application of substantive maritime law—the specialized body of statutory and judge-made law that governs maritime commerce and navigation.4 The Dictionary Act5 defines “vessel” for purposes of federal law. Per the statute, “[t]he word ‘vessel’ includes every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on water.”6 The statute’s language sweeps broadly, and courts have, at times, interpreted the statute to apply even to unusual structures that were never meant for maritime transport. “No doubt the three men in a tub would also fit within our definition,” one court acknowledged, “and one probably could make a convincing case for Jonah inside the whale.”7 At other times, however, courts have focused on the structure’s purpose, excluding structures that were not designed for maritime transport.8 In Stewart v. -
