In 2004 – also vor 10 Jahren – lag der Umsatz der weltweiten Musikwirt- schaft bei 20 Milliarden US$. Online-Musikshops gab es in sechs EU Staaten, darunter auch Österreich, und das digitale Musikangebot umfasste rund eine Million Titel. In 2014 sind mehr als 400 Musikshops online, über 200 davon in der EU. Das jederzeit, von jedem Ort und mit verschiedenen Devices verfüg- bare Angebot liegt aktuell bei 43 Millionen Musiktiteln – und das in allen 28 EU-Staaten. Musik ist eine wesentliche treibende Kraft für die Entwicklung des Digitalmarktes. Hausaufgaben gemacht, könnte man sagen - aber der Jahresumsatz der Musikwirtschaft betrug in 2014 nur mehr 15 Milliarden US$, also fünf Milliar- den US$ weniger als vor 10 Jahren. Im selben Zeitraum sind die Werbeumsätze und Unternehmenswerte von YouTube und ähnlichen Diensten explodiert. Nach eigenen Angaben hat YouTube monatlich mehr als eine Milliarde Unique User und gilt als eine der populärsten Plattformen für den Konsum von Musik. Auch in Österreich geben laut einer GfK-Studie zwei Drittel aller musikinteressierten Internet-User an, dass sie Musik über YouTube beziehen – deutlich mehr als über iTunes, Ama- zon, Spotify, Deezer & Co. Wirtschaftlich führt das zu folgender Verzerrung: Die neuen Streaming- Plattformen, wie etwa Spotify, haben weltweit 40 Millionen zahlende Premium- Abonnenten und weitere hundert Millionen User ihrer werbefinanzierten „Freemium“-Angebote.

    The Identifi cation of Customary International Law by Austrian Courts August Reinisch and Peter Bachmayer* I. Introduction Customary international law, that venerable bedrock of inter-state law, has received increased attention recently. After the International Law Associ- ation (ILA),1 the International Law Commission (ILC) included the topic ‘Formation and evidence of customary international law’ in its programme of work,2 and subsequently decided to focus on the question of the ‘Identi- fi cation of customary international law’.3 The following contribution aims at analysing how domestic courts in Austria have addressed this issue of identifying custom. Article 38 of the Statute of the International Court of Justice (ICJ) refers to customary international law as ‘evidence of a general practice accepted as law’ and lists it as one of the main sources of international law. Custom is formed by two essential elements: (1) a consistent practice of states as indicated by a state’s external behavior towards other states as well as by internal acts like domestic legislation, government memoranda or judicial decisions if they relate to the international fi eld; and (2) the belief that such a practice has a legally binding effect upon the state (opinio iuris). * August Reinisch is Professor of International and European Law at the University of Vienna and Vice-Dean of the Law School of the University of Vienna.
