What Hartz Didn’t Understand about the “Liberal Tradition” Then, and Why It Matters for Understanding Law Now1 Carol Nackenoff Department of Political Science Swarthmore College [email protected] For Presentation at the University of Maryland Law School/Georgetown Law Center Schmooze, March 3-4, 2006 To what extent, and in what sense, is it meaningful to talk about the liberal tradition as a context within which constitutional deliberation takes place in the United States? There certainly are very real constraints on what most of those who don black robes and speak the language of constitutional law seem to be able to think. Justice Robert Jackson wrote that “never in its entire history can the Supreme Court be said to have for a single hour been representative of anything except the relatively conservative forces of its day."2 The Constitution establishes much tighter boundary conditions for deliberation for some legal scholars and jurists than for others, and arguments abound about whether the principles and values expressed in that document are fixed or available to later generations to interpret for themselves. CHECKS, BALANCES, AND NUCLEAR WASTE Bruce R. Huber ABSTRACT Systems of political checks and balances, so prominently featured in the U.S. Constitution, are also commonly installed in statutory and regulatory regimes. Although such systems diffuse political authority and may facilitate participation and accountability, they come with a price. If exercised, political checks—even those that appear trivial—can obstruct statutory processes and saddle a policy system with an unintended default policy outcome. Policies that are neither debated nor chosen, but that emerge as unbidden defaults, exhibit the very democratic deficits that checks and balances are intended to remedy. This is precisely the situation of nuclear waste policy in the United States. The Nuclear Waste Policy Act of 1982 established a process for siting and constructing repositories for nuclear waste. When Nevada’s Yucca Mountain emerged as a likely repository site, that state’s officials and allies exercised the numerous political and legal checks afforded by the Act and appear, at least for the time being, to have defeated the selection. But Nevada’s victory may well be the nation’s loss. In the absence of a national waste repository, nuclear power plant operators have no choice but to store spent nuclear fuel on site, where it presents a number of risks not contemplated by the 1982 legislation. This outcome was not chosen or anticipated by legislators, plant operators, state and local siting authorities, or host communities. This Article argues that lawmakers must take more realistic stock of their own institutional behaviors. Although certain corrosive incentives are intractably embedded in our constitutional system, lawmakers can and should write statutes with full awareness of the risks of relying on statutory checks and balances. -

E-mail: [email protected] With a number of controversial publications behind him and not least his book, The Tragedy of Great Power Politics, John J. Mearsheimer has firmly established himself as one of the leading contributors to the realist tradition in the study of international relations since Kenneth Waltz’s Theory of International Politics. Mearsheimer’s main innovation is his theory of ‘offensive realism’ that seeks to re-formulate Kenneth Waltz’s structural realist theory to explain from a struc- tural point of departure the sheer amount of international aggression, which may be hard to reconcile with Waltz’s more defensive realism. In this article, I focus on whether Mearsheimer succeeds in this endeavour. I argue that, despite certain weaknesses, Mearsheimer’s theoretical and empirical work represents an important addition to Waltz’s theory. Mearsheimer’s workis remarkablyclear and consistent and provides compelling answers to why, tragically, aggressive state strategies are a rational answer to life in the international system. Furthermore, Mearsheimer makes important additions to structural alliance theory and offers new important insights into the role of power and geography in world politics. Gelms As our digital environments—in their inhabitants, communities, and cultures—have evolved, harassment, unfortunately, has become the status quo on the internet (Duggan, 2014 & 2017; Jane, 2014b). Harassment is an issue that disproportionately affects women, particularly women of color (Citron, 2014; Mantilla, 2015), LGBTQIA+ women (Herring et al., 2002; Warzel, 2016), and women who engage in social justice, civil rights, and feminist discourses (Cole, 2015; Davies, 2015; Jane, 2014a). Whitney Phillips (2015) notes that it’s politically significant to pay attention to issues of online harassment because this kind of invective calls “attention to dominant cultural mores” (p. 7). Keeping our finger on the pulse of such attitudes is imperative to understand who is excluded from digital publics and how these exclusions perpetuate racism and sexism to “preserve the internet as a space free of politics and thus free of challenge to white masculine heterosexual hegemony” (Higgin, 2013, n.p.). While rhetoric and writing as a field has a long history of examining myriad exclusionary practices that occur in public discourses, we still have much work to do in understanding how online harassment, particularly that which is gendered, manifests in digital publics and to what rhetorical effect. -

Utilizing a theoretical framework that fuses together critical theory (Horkheimer, 1937; Marcuse, 1964; Marshall, 1997), Bernstein’s (1971, 1977) three message systems of education and dual concepts of classification and frame, and Collins‘ (1979, 2000, 2002) notion of the Credential Society, the study examines the ideological underpinnings of the A++ Plan’s statutory requirements, and their effects on various school constituencies, including students, teachers, and the schools themselves. -

Now a new form of news dissemination is taking place on the internet where communication between consumers and producers exists. Crowdsourced social media sites, where users elect and vote on articles and comments to represent a topic, are creating new forms of news dissemination which heavily alters media content and community discussions. This study was conducted in order to better understand how crowdsourced social media platforms affect users’ perception of environmental topics, issues, and problems. It focuses on the crowdsourced social media platform Reddit evaluating the top 100 articles within the subreddit titled r/environment. The methods used in this study include secondary data analysis, archival research of online forums, and social network analysis. Most articles analyzed discussed the topic of politics, including President Trump and his administration’s environmental policies, as well as a lack of transparency related to environmental policies in general. Many of the comments responded to these articles by discussing politics. Findings also included a perception that monetary and social capital must be present for individuals to facilitate widescale, meaningful environmental change. -

SAMUEL H. BEER, PhD, SMA ’28 (1911 – 2009) Samuel Beer entered Staunton Military Academy (SMA) in September 1927. He was a member of the boxing team and graduated as a private first class in May 1928. Following SMA, Samuel attended the University of Michigan. The following article from the 18 April 2009 New York Times by obituary writer William Grimes tells the story of Samuel Beer’s life and death: “Samuel H. Beer, a leading American expert on British government and politics who was a longtime professor of government at Harvard and who led the liberal organization Americans for Democratic Action from 1959 to 1962, died April 7 at his home in Washington. He was 97 and lived in Washington and Cambridge, Mass. “The death was confirmed by his wife, Jane K. Brooks. “For 30 years, Mr. Beer taught ‘Western Thought and Institutions,’ a legendary course that combined history, political theory and comparative government, to generations of Harvard undergraduates. In the wider world, he was known for several books on politics and government in Britain and the United States noteworthy for their timeliness and the elegance of their arguments. “In his first book, ‘The City of Reason’ (1949), he articulated a liberal political philosophy based on the ideas of Alfred North Whitehead. It was followed by ‘Treasury Control’ (1956), a study of how the British government coordinates financial and economic policy, and the highly regarded ‘British Politics in the Collectivist Age’ (1965), an inquiry into the conflict between conservative and radical impulses in postwar Britain. “In 1982, as Prime Minister Margaret Thatcher’s government gathered steam, he published ‘Britain Against Itself: The Political Contradictions of Collectivism.’ He later turned his attention to American political theory in ‘To Make a Nation: The Rediscovery of American Federalism’ (1993). -

One Rewriting the Epic of America IRA KATZNELSON “Is the traditional distinction between international relations and domes- tic politics dead?” Peter Gourevitch inquired at the start of his seminal 1978 article, “The Second Image Reversed.” His diagnosis—“perhaps”—was mo- tivated by the observation that while “we all understand that international politics and domestic structures affect each other,” the terms of trade across the domestic and international relations divide had been uneven: “reason- ing from international system to domestic structure” had been downplayed. Gourevitch’s review of the literature demonstrated that long-standing efforts by international relations scholars to trace the domestic roots of foreign pol- icy to the interplay of group interests, class dynamics, or national goals1 had not been matched by scholarship analyzing how domestic “structure itself derives from the exigencies of the international system.”2 Gourevitch counseled scholars to turn their attention to the international system as a cause as well as a consequence of domestic politics. He also cautioned that this reversal of the causal arrow must recognize that interna- tional forces exert pressures rather than determine outcomes. “The interna- tional system, be it in an economic or politico-military form, is underdeter- mining. The environment may exert strong pulls but short of actual occupation, some leeway in the response to that environment remains.”3 A decade later, Robert Putnam turned to two-level games to transcend the question as to “whether
