DEWAR Abstract: This article argues that the lines separating different modes of thought on the centre-left of the political spectrum—liberalism, social democracy, and socialism, broadly speaking—are permeable, and that they share many features in common. The example of Tom Kent illustrates the argument. A leading adviser to Lester B. Pearson and the Liberal Party from the late 1950s to the early 1970s, Kent argued for expanding social security in a way that had a number of affinities with social democracy. In his paper for the Study Conference on National Problems in 1960, where he set out his philosophy of social security, and in his actions as an adviser to the Pearson government, he supported social assis- tance, universal contributory pensions, and national, comprehensive medical insurance. In close asso- ciation with his philosophy, he also believed that political parties were instruments of policy-making. Thank you very much to the honourable members of the Senate Standing Committee on Official Languages (the “Committee”) for inviting me to testify and submit a brief as part of the study of the official languages reform proposal entitled French and English: Towards a Substantive Equality of Official Languages in Canada (“the reform proposal”). A) The reform proposal includes ambitious and essential measures 2. First, I would like to congratulate the Minister of Economic Development and Official Languages for her leadership and vision. It is, in my opinion, the most ambitious official languages reform proposal since the enactment of the Constitution Act, 1982 (“CA1982”)1 and the Canadian Charter of Rights and Freedoms (“Charter”),2 which enshrined the main provisions of the Official Languages Act (“OLA”)3 of 1969 in the Canadian Constitution. The last reform of the OLA was in 1988 and it is past time to modernize it to adapt it to Canada’s linguistic realities and challenges in the 21st century. 3. The Charter and the OLA proclaim that “English and French are the official languages of Canada and have equality of status and equal rights and privileges as to their use in all institutions of the Parliament and government of Canada.”4 In reality, however, as reported by Statistics Canada,5 English is dominant everywhere, while French is declining, including in Quebec. -

Using a qualitative assessment of the events leading up to election day and data from an online vote compass gathered during the campaign period, it argues that the popularity of the incumbent Premier, Brad Wall, was the decisive factor explaining the Saskatchewan Party’s success. Parliament of Canada.—The Parliament of the Dominion Of
574 ADMINISTRATION Parliament of Canada.—The Parliament of the Dominion of Canada consists of the Senate with 96 members and of the House of Commons with 235 members, senators being appointed for life by the Governor-General and members of the House of Commons being elected by the people. The ordinary legal limit of duration for each parliament is five years; but by Act of the Imperial Parliament (6-7 Geo. V., c. 19), passed June 1, 1916, and intituled an Act to amend the British North America Act, 1867, the duration of the 12th Parliament of Canada was extended until October 7, 1917. The 12th Parliament was dissolved by proclamation of the Governor General on October 6, 1917; and the 13th Parliament of Canada was elected on December 17, 1917. A Redistribution Act passed after each census readjusts the number of representatives in the House of Commons in accordance with rules laid down in Section 51 of the British North America Act, 1867, of the Imperial Parliament (30-31 Vict., c. 3). These rules provide that the province of Quebec shall always have the fixed number of 65 members, and that there shall be assigned to each of the other provinces such a number of members as will bear the same proportion to the number of its popu lation (ascertained by the census) as the number 65 bears to the population of Quebec. However, by an amendment to the British North America Act passed in 1915, (5-6 Geo. V., c. 45), it was enacted that "notwithstanding anything in the said Act, a province shall always be entitled to a number of members in the House of Commons not less than the number of senators representing such province." As a consequence of this amendment the representation of Prince Edward Island has remained at 4 members. -

ELLIOTT• This paper highlights constitutional dilemmas posed by the Canadian constitution in matters of resource regulation., marketing and taxation., with particular em phasis on Saskatchewan. The background to and impact of the CIGOL case is examined, including a discussion of the issues of direct tazation and the trade and commerce power. Ancillary matters such as recovery of payments under invalid laws and techniques of interim relief also receive scndiny. Similar problems in the potash and uranium industries are analyzed. I. INTRODUCTION The dilemmas posed by constitutional limitations on the powers of provincial governments and the federal government are not confined to oil and gas, but include all resources. Oil and gas are merely part of a larger question. Furthermore, the problems vary from region to region and province to province, and the approaches and solutions vary with the political philosophy of governments of the day. The struggle is not new and will not go away even in the event of constitutional change. Corporations, whether private or publicly owned, will always be faced with the discipline of the bottom line and governments with the real or fancied "need" of politicians and tax gatherers. The words "fair", "reasonable," "just' and "unconstitu tional" will continue to be heard. One should not expect any so-called solutions to be more than a te.mporary lull before another storm. In a huge country divided by regions, and governed by a federal system with divided constitutional powers, the possibilities of disagreement are endless. II. HISTORY Sections 91 and 92 of the British North America Act 1 give rise to most of the jurisdictional questions. -
