Como proyecto de Sunshine Press, es una organización de medios de comunicación sin fines de lucro, cuyo fin es comunicar información y noticias importantes al público, ofreciendo una forma innovadora, segura y anónima de compartir información a las fuentes que deseen hacerlo. Su funcionamiento es posible gracias al trabajo de cientos de voluntarios alrededor del mundo, también se encarga de adaptar y desarrollar tecnologías para su propio funcionamiento. En cuanto a quienes la conforman, tenemos que decir que sus fundadores son una mezcla de disidentes de Asia, periodistas, matemáticos y tecnólogos procedentes de Estados Unidos, Taiwán, Europa, Australia y Sudáfrica. WikiLeaks se ha ido moviendo hacia un modelo más tradicional de publicación y, contrario de lo que pudiéramos pensar, por el uso del término “Wiki”, no admite comentarios ni ediciones de los usuarios. Además, se identifica como un movimiento mundial encargado de publicar filtraciones, cuyos costos resultan altos para los regímenes políticos intervencionistas que basan su poder en la conspiración y el miedo; para su funcionamiento utiliza una versión modificada del software de MediaWiki. Sus orígenes se remontan a diciembre de 2006, fecha en la que fue oficialmente registrada, y su objetivo es servir como plataforma para dar a conocer documentos confidenciales garantizando el anonimato de la fuente, lo cual es posible gracias a la creación de un software libre capaz de borrar cualquier indicio que pudiera identificar el origen de la fuente. El equipo está conformado por un pequeño grupo de especialistas informáticos y la financiación proviene de Wau Holland Stiftung3, que se encarga de recibir donaciones procedentes de Europa a WikiLeaks.4 WikiLeaks asegura que es capaz de publicar material auténtico a la par de las “historias” que se publican en los medios tradicionales, con la esperanza de que la audiencia identifique quién dice la verdad. A pesar de todo, mantiene sus principios básicos: La defensa de la libertad de expresión y de la transparencia institucional, así como la mejora en el conocimiento común de la historia. La organización está compuesta, además del cuerpo de trabajo constituido por voluntarios, por un Consejo Asesor, una Junta Consultiva y Julian Assange, quien se identifica como Editor en Jefe de WikiLeaks. Adicionalmente, cuentan con un grupo de abogados procedentes de diversas partes del mundo, los cuales se encuentran comprometidos con los valores y objetivos de la organización. Algunos miembros del Consejo Asesor: Phillip Adams.- Locutor australiano de la emisora “Radio National” (de Australia), director de cine, autor y arqueólogo. Wang Dan.- Activista por la libertad y democracia en China y líder del Movimiento Democrático. Fue uno de los líderes estudiantiles más visibles en las Protestas de la Plaza de Tian'anmen5. Algunos miembros de la Junta Consultiva: Ben Laurie.- Ingeniero de software, diseñador de protocolo y criptógrafo. Es director fundador de Apache Software Foundation, miembro del equipo núcleo de OpenSSL, del Grupo Shmoo, director del Open Rights Group y director de seguridad en el Bunker Secure Hosting, además fideicomisario y miembro fundador del comité de FreeBMD. Francisco "Chico" Whitaker Ferreira.- Arquitecto brasileño, político y activista social. Es miembro fundador de la organización no gubernamental Transparência Brasil y miembro del World Future Council.6 En cuanto a los métodos utilizados, según lo declarado a los medios, después de recibir la información, periodistas evalúan y verifican el material, para posteriormente redactar la noticia con el fin de mostrar su importancia a la sociedad, 5 Edward R. La organización publica material de importancia ética, política e histórica; protegiendo la identidad de las fuentes, manteniendo un camino abierto para la revelación de las injusticias ocultas o censuradas. En lo que respecta a su funcionamiento, utiliza métodos avanzados de encriptación para proteger la estructura. Usa el esquema conocido como 256 bit AESi, similar a la que utilizan bancos y algunas agencias militares y de inteligencia. Su principal herramienta de anonimato en comunicaciones es Torii. WikiLeaks señala que no almacena ningún dato acerca del origen de la información cargada, la zona honoraria, el navegador ni de la fecha de entrega, utiliza una forma clásica de anonimato (vía Tor7). Las primeras publicaciones, que aparecieron en enero de 2007, consistían en una serie de reportes sobre el ex mandatario de Kenia, Daniel ArapMoi, y un fraude de mil 500 millones de euros. En noviembre del mismo año, WikiLeaks reveló el manual de procedimiento militar del Campamento Delta (una base en Guantánamo), eran más de 700 fichas de presos ingresados entre 2002 y 2009, y en las que se evidenciaban violaciones a los Derechos Humanos. El manual también señala que funcionarios de Arabia Saudita, China y Rusia acudían a Guantánamo con el fin de interrogar a los presos, y que se mantenían encarceladas personas inocentes.8 La siguiente filtración ocurrió en septiembre de 2008, y se acusaba a la entonces gobernadora de Alaska, Sarah Palin, de utilizar una cuenta de correo electrónico personal para realizar negocios oficiales, faltando a la obligación de reportarlos en registros públicos.9 En enero de 2010, se dio a conocer la que quizá es la filtración más importante en la historia de WikiLeaks. I would like to first introduce myself and tell you a little Bit about myself. I am from Allendale, NJ and I am currently majoring in Accounting and Finance. First off, I have been involved with the Fairfield University Model United Nations Team since my freshman year when I was a co-chair on the Disarmament and International Security committee. My sophomore year, I had the privilege of Being Co- Secretary General for FUMUN and although it was a very time consuming event, it was truly one of the most rewarding experiences I have had at Fairfield. Last year I was the Co-Chair for the Fukushima National Disaster Committee along with Alli Scheetz, who filled in as chair for the committee as I was unaBle to attend the conference. Aside from my chairing this committee, I am currently FUMUN’s Vice- President. In addition to my involvement in the Model UN, I am a Tour Ambassador Manager, and a Beta Alpha Psi member. I love the outdoors and enjoy skiing, running, and golfing. I am from Allendale, NJ and I am currently majoring in Accounting and Finance. Reviewing the psychiatric report of the psychologist Dr. Kiesewetter (Forensic Psychiatrist of the Court of Zurich), various clarifications from my part are required and particularly related to what the prosecutor accuses me in her indictment titled "Threats etc" of 19 January 2011. Leuenberger, I refer to the conclusion of Chief Justice P. Marti, dating 20 February 2013 that there is currently no reason to perform additional investigations related to the response of Dr. Kiesewetter. Due to the response from Dr. Kiesewetter I have noticed more inconsistencies and facts regarding the untrue statement that "[My] mother should have stated that my grandfather committed suicide" in Dr. Kiesewetter’s lengthy report. Dr. Kiesewetter’s response of 18 February 2013 reiterated my claim "to have access to all original documents of the police in order to identify their author." It is to be clarified and made known who is the author and the source of the defamatory statement that "[my] grandfather committed suicide" and by whom and on what occasion my mother was questioned when she presumably should have made that statement. 1.     Another Europe Given the recent focus on the challenges to representative democracy, and the search for new institutions and procedures that can help to channel increasing participation, this book offers empirical insights on alternative conceptions of democracy and the actors that promote them. With a focus on the conceptions and practices of democracy within contempo- rary social movements in Europe, this volume contributes to the debate on the dif- ferent dimensions of democracy, especially on representation and participation. The book explores the transnational dimension of democracy and addresses a relevant, and little analysed aspect of Europeanization: the Europeanization of social move- ments. From a methodological point of view, the research innovates by covering a group of individuals traditionally neglected in previous studies: social movement activists. Estate planning practitioners should familiarize themselves with a new offshore amnesty program that the IRS announced on 2/8/2011. The IRS has coined the new program, the 2011 Offshore Voluntary Disclosure Initiative (OVDI). 1 Taxpayers seeking legal advice regarding the prospect of making a voluntary disclosure to the IRS under the 2011 OVDI are probably kicking themselves for not coming forward under the 2009 Offshore Voluntary Disclosure Program (OVDP). The terms of the 2011 initiative are similar to those of the 2009 program except that the cost of participating is higher, and the new program appears to be more rigid. Required payments The 2011 OVDI requires taxpayers to pay: (1) A miscellaneous penalty of 25% on the highest aggregate account balance covering the 2003 to 2010 time period. (2) Back taxes, interest, and accuracy/delinquency-related penalties for the tax years ending 2003 through 2010. Taxpayers must satisfy all of the terms of the 2011 OVDI by 8/31/2011. Introduction In June 1967, Secretary of Defense Robert McNamara commissioned a 7,000-page, 47 volume study on the United States’ path to war in Vietnam (Rudenstine 27). Its authors—a group of staff from the Defense Department, the State Department, the military, think tanks, and universities—gave it the staid title “Report of the Office of the Secretary of Defense Vietnam Task Force" (Rudenstine 26). In 1971, Daniel Ellsberg, an employee of the RAND Corporation and a co-author of the study, began making secret copies of it. In March of that year, Ellsberg sent a copy to Neil Sheehan, a reporter at The New York Times. The dramatic series of events that followed would make the documents famous and give them a new name: the Pentagon Papers. It would also raise legal questions that even today remain unanswered. Those questions arose on June 15, 1971, two days after the Times began publishing articles based on Ellsberg’s documents. That day, the Nixon Administration sought an injunction in federal court, hoping to block the Times from printing further stories. On June 26, lawyers argued New York Times Co. v. United States before the Supreme Court. The case raised a fundamental question. Under what circumstances can the government order a prior restraint—an action prohibiting speech before it has occurred? Does such a concept violate the First Amendment’s protection of free speech and a free press? The Administration argued that publication of the Pentagon Papers, because they were top secret, posed grave harm to national security.
