    1 EXTENDING THE TERM: Should the UK recording industry have new obligations as well as new rights if the copyright term for sound recordings is extended? Ben Challis, LLB MA MA(law) FRSA Barrister-at-law In this article Ben looks at the current moves by the UK’s recording industry to push for a Europe wide extension in the term of copyright for sound recordings - from fifty years to ninety five years. But Ben asks if this is the time for a complete overhaul in the way copyrights are owned and suggests that any change in term should only be made with additional provisions to protect both the customers and the creators of recorded music. Front page news in the UK trade magazine Music Week on the 4 th March 2006 was the headline ‘Timefor Action’ launching a major campaign under the „Extend The Term!‟ banner, calling on the UK Government to take action over extending the term of copyright for sound recordings. Currently the term of copyright protection for original literary, dramatic, musical and artistic works along with Films is seventy (70) years from the death of the author or last surviving author pursuant to the provisions of the Copyright Designs and Patents Act 1988s12 and s13B. However S13A of the same Act provides that the copyright in sound recordings in the UK lasts for only fifty (50) years from the end of the calendar year in which the recording is made or released. And this is what is agitating the British Phonographic Industry as its members being to see some very valuable copyrights (such as early sound recordings from Elvis Presley and Cliff Richard) enter the public domain.

These contracts depict not only the exclusive nature o f the professional service(s) restraint of musical artists, but also the exclusive control over the copyright in the musical work(s). They illustrate the operation of two distinct forms of exclusivity which are unique to the practices of the music industry. Both types of restraint are significant because they usually operate over a number of years, and are influential in the shaping of musical careers. This thesis considers the principles, policies and practices which influence the iuterpretation of fair terms in these contracts. The function of specific contractual terms and their roles within the operation of the agreement will be examined.

Radio jocks usually referred to non-hit singles as “stiffs” (as in, dead), so the idea of Stiff Records was to release artists who couldn’t attract a mainstream audience (at least, at the time. Several were later very successful). Early releases were “pub rock” artists, but this quickly evolved into punk rock. Rivera left to form Radar Records in 1977 and took several artists with him. Up to 1978, Stiff had released primarily singles and a few albums released outside the US. That year Stiff signed a deal with CBS to distribute their product in the US (the deal lasted to 1982). This put the label on the map here. In 1984, Robinson sold Stiff Records to Island Records in England, who entered into a short distribution deal with MCA for US releases. This incarnation of Stiff was not very successful, and Island wanted to dump the label. Robinson regained control of Stiff as an independent label in 1986, but immediately fell into a cash flow crisis and went bankrupt. ZTT Records bought it out of liquidation in 1987, where it remained dormant until 2006. That year, ZTT resurrected the imprint by signing new artists and reissuing old material.
