Los Angeles Welcome to the current issue of Pro Bono News. In this issue, we recap our 2nd Annual Pro Bono and Community Service New York Award winners and highlight our global pro bono and Orange County community involvement projects.

San Francisco The recent announcement of the firm being ranked 10th on The American Lawyer’s A-List of the 20 most successful law firms is in part due to the success of our pro bono programs. Across the world, Paul Hastings maintains a reputation for providing Tokyo exemplary pro bono service and community support, and we are pleased to receive the 2010 Pro Bono Service Award from Washington, D.C. the Legal Aid Foundation of Los Angeles for our efforts.

Resources Here are just a few examples of our recent pro bono work: In Asia, our lawyers support a diverse group of organizations, Office Contacts: including The Nature Conservancy, the Natural Resources Pro Bono & Defense Council, and the Paul Hastings Hope Elementary Community School. In Europe, our partners and staff sponsor a reading Committee program for students who live in an ethnically diverse community. In North America, lawyer teams in different offices have obtained asylum for immigrants and their families who risk death or personal injury if they return to their native countries. The firm will receive the 2010 Pro Bono Service Award from the Legal Aid Foundation of Los Angeles in November.

At Paul Hastings, we provide thousands of hours of pro bono and community service to countless individuals and organizations with the objective of making a difference in the lives of those who could not otherwise afford our services. Our pro bono and community commitments are consistent with the

Atlanta PRO BONO AND COMMUNITY SERVICE AWARD WINNERS ANNOUNCED Beijing The Pro Bono and Community Committee is pleased to Chicago announce the winners of the 2nd ANNUAL PAUL HASTINGS PRO BONO AND COMMUNITY SERVICE AWARDS. Hong Kong Established in 2009, the Pro Bono & Community Service London Awards honor lawyers and community organizations who contribute significant time to help others. Last year, our Los Angeles lawyers recorded nearly 95,000 hours of pro bono and New York community service, a 32% increase in total hours from 2008. These results support our global promise to serve those in Orange County need, and we proudly acknowledge the lawyers who embody the firm’s commitment to pro bono and community service. Thank you for your hard work and dedication and for being leaders at Paul Hastings and in your communities. Shanghai Robert Hastings Award Tokyo K. LESLI LIGORNER, Shanghai The Hastings Award is an honor given to a Paul Hastings Washington, partner who demonstrates sustained leadership in community D.C. and pro bono service. Lesli’s pro bono service includes supporting the Children of China Pediatric Foundation and Resources The Nature Conservancy, and the firm is particularly grateful Office Contacts: for her dedication to the Paul Hastings Hope Elementary Pro Bono & School (Jiangxi, China) and their students. Community Pro Bono Office of the Year Committee LOS ANGELES This award is given to the office with the highest pro bono participation rate based on the number of full-time lawyers. The Los Angeles office completed nearly 23,000 total pro bono hours and achieved a 100% participation rate; implemented an innovative pro bono initiative, PB5, to expand the office’s pro bono commitment; and was named Law Firm of the Year by Public Counsel.

Community Service Office of the Year SAN DIEGO

This award is given to the office recording the highest number of community service hours. In 2009, the San Diego office recorded close to 5,000 community service hours and volunteered with several organizations, including the Emilio Nares Foundation and Project SALUTE. Partners in the San Diego office are also active community leaders, serving on the boards of the American Inns of Court, La Jolla Music Society, and the San Diego Volunteer Lawyers Program.

Pro Bono & Community Lawyer of the Year STEVE TURANCHIK, Los Angeles

This award is given to the lawyer recording the most pro bono and community hours for the year. Steve played an active role in the Los Angeles office’s pro bono activities and donated his time to several community organizations.

Pro Bono & Community Coordinator of the Year BRIAN MORAN, New York This award is given to the lawyer who demonstrates exemplary pro bono leadership for the year. As the pro bono and community coordinator for the New York office, Brian significantly increased the pro bono participation rate among lawyers, leading to a 100% participation rate within the New York litigation practice.

Pro Bono & Community Coordinator of the Year

DARCY WHITE, Atlanta This award is given to the most outstanding pro bono coordinator of the year based on measure of service. Along with fellow pro bono coordinators Todd Duffield and Adrienne Smith, Darcy continues to grow the firm’s relationship with organizations such as the Atlanta Volunteer Lawyers Foundation and Pro Bono Partnership of Atlanta. In addition to her role as pro bono coordinator, Darcy recorded more than 118 pro bono hours in 2009.

Pro Bono & Community Strategic Initiative Award AMERICAN CIVIL LIBERTIES UNION OF SOUTHERN (ACLU/SC) This award is given to a pro bono client who benefitted from the firm’s pro bono service. In April 2009, Paul Hastings, in conjunction with the ACLU/SC, and the National Immigration

Law Center, filed a class action complaint against the Department of Homeland Security and the U.S. Immigration and Customs Enforcement (ICE) which asserted that the conditions at the B-18 immigration processing center were unsanitary, unsafe, and unconstitutional. The firm commends the B-18 team, including Nick Begakis, Tollie Besson, Jamie Broder, Eleanor Mercado, Morgan Pietz, and Steve Turanchik for donating 1,940 hours to this case and ensuring the fair and equitable treatment of more than 30,000 annual detainees.

Pro Bono Advocate of the Year STEVE KINNAIRD and Team for Padilla v. Kentucky

This award was created to honor a lawyer or team of lawyers for exemplary legal work on a distinguished pro bono project. Steve Kinnaird argued an appeal in the U.S. Supreme Court on behalf of a legal permanent resident who was at risk of deportation to Honduras due to erroneous legal advice from his lawyer. The Court issued a judgment (7-2) in favor of the firm’s pro bono client. Our winning team included D. Scott Carlton, Adam Cherensky, Chris Dugan, Steve Kinnaird, Alexander Lyon, Neal Mollen, Mitch Mosvick, Leeann Rosnick,

Elizabeth Stevens, Peter Stone, Igor Timofeyev, and law students from the University of Pennsylvania.

Pro Bono Organization of the Year KIDS IN NEED OF DEFENSE (KIND) This award is given to the most outstanding pro bono organization collaborating with the firm each year. Paul Hastings is proud to support KIND in “ensuring that unaccompanied migrant children in the are treated fairly and that their rights are protected and respected.” Paul Hastings lawyers handled more than 20

KIND cases in 2009, and continue to serve this organization.

Atlanta LAWYERS PLAY LEAD ROLES IN SERVICE JURIS DAY Beijing On June 26th, approximately 400 volunteers, including lawyers Chicago and staff from Paul Hastings, corporate legal departments, local courthouses, and other law firms participated in Service Hong Kong Juris Day. The volunteers transformed an overgrown, 7-acre abandoned tract into the Kirkwood Urban Forest and planted London trees and cleared debris in the DeKalb Memorial County Park, directly south of the Kirkwood Urban Forest as parts of their Los Angeles service projects. Liz Arnett, Adrienne Smith, and Darcy White served on the Steering Committee, and Darcy served as a New York committee co-chair. The event was featured in Fulton County Orange County Daily Report and other media.

Chicago The Beijing and Shanghai offices continue to work on a variety of employment matters for The Nature Conservancy Hong Kong and Natural Resources Defense Council (NRDC), as well as employment and corporate matters for International Bridges London to Justice.

Atlanta PARTNER HELPS CHILDREN WITH SERIOUS MEDICAL Beijing OR DISABLING CONDITIONS

Chicago Thaddeus “Thad” J. Malik serves on the board of, and serves as counsel to, the Elmhurst Children’s Assistance Foundation Hong Kong (ECAF), a Chicago area organization that provides financial assistance to families with children who have been diagnosed London with a serious medical or disabling condition. ECAF supports payment for medical bills, therapy services, medical Los Angeles equipment, costs associated with adapting cars and homes for specialized children’s medical equipment, and other New York healthcare expenses. In addition to ECAF, Thad serves on the Orange County board of the First Tee of Chicago, a community organization “dedicated to teaching life skills and character education San Francisco through the game of golf,” and the Illinois Professional Golfers Association Foundation. Shanghai VAWA AND IEP VICTORIES Tokyo On August 27, the Department of Homeland Security granted Washington, Hilla Uribe's pro bono client an I-360 visa due to cruel D.C. treatment that she had suffered at the hands of her lawful permanent resident husband. This is Hilla Uribe's second Resources Violence Against Women Act (VAWA) victory.

Office Contacts: Holly Snow recently successfully negotiated Individualized Pro Bono & Education Programs (IEP) for two Chicago Public Schools Community students. As a result, one student was able to attend tuition Committee free summer school and the other student was successfully transferred to a safer public high school of his choice.

Resources As part of the Tower Hamlets Education Business Partnership, members of the London office have participated in a reading Office Contacts: partnership with John Scurr Primary School in the borough of Pro Bono & Tower Hamlets. Many of the pupils at the School speak Community English as an additional language and most have little one-to- Committee one reading time with adults.

Volunteers were paired with another member of the London office, and each Paul Hastings pair formed a “reading partnership” with a pupil in their final year of primary school (10 and 11 year olds). Members of the London office then spent one lunchtime each week visiting the school to assist the children with their reading and comprehension.

During the course of the partnership, volunteers worked with students on designing book covers as part of a borough-wide World Book Day competition. Karina Bielkowicz’s reading partner was named one of the twenty winners out of 171 entries from twenty-five schools.

Other highlights included two visits by the School to the London office, during which the children participated in office

tours and quizzes and invitations to attend external musical performances by the School. At the end of the school year, Phil Feder, office chair, presented the pupils with certificates of participation.

Emma Osbaldeston coordinated the initiative which has been supported by approximately 20 lawyers and staff over the course of the year. Following its success to date and the sense of achievement of both pupils and volunteers, the London office plans to continue the partnership with the School into the next academic year.

As a result of the relationship developed through the reading

partnership, the Paul Hastings Creative Services department also worked with the School to develop their new logo (pictured below). This logo is based on the winning entry of one of the children who participated in the School’s competition to find a new design and will appear on new school uniforms and be used generally by the School.

Atlanta COMMUNITY INVOLVMENT TWENTY TEN INITIATIVE Beijing The Los Angeles office is proud to announce the Chicago implementation of the Community Involvement Twenty Ten Initiative (“CITTI”) to direct strategically its community Hong Kong involvement efforts.

London CITTI has three primary goals:

Los Angeles Align our community involvement efforts with the Top 25 clients, of the Los Angeles office and local offices of New York our PH 50 Clients;

Orange County Strengthen our Lawyers’ connections to Southern California by (a) working towards greater involvement San Francisco with targeted civic institutions and social service organizations; and (b) recognizing and rewarding the Shanghai involvement of Associates and Partners; and Tokyo Improve tracking and increasing publicity of the firm’s Washington, commitment to community involvement. D.C. These goals will maximize the potential of community Resources development at Paul Hastings as a professional development opportunity for Associates, a business development instrument Office Contacts: for the firm, and most significantly, a proactive and sustaining Pro Bono & contribution to Southern California. Community Committee CITTI's launch in the summer of 2010 has already resulted in the collaboration of Partners and Associates across practice areas, the strengthening of relationships with various clients, and the appointment of lawyers to the Board of Directors for various community organizations in Los Angeles.

HELPING ONE OF OUR OWN

In 2008, Marco Ferreira was involved in a near fatal motorcycle accident. Marco, who was wearing a helmet, and some of the doctors who saved his life wanted to start a nonprofit to help others who have had traumatic injuries. Led

by the efforts of Donna Melby and Cheryl Lu, Giveback, Inc. was created to help traumatic brain injury recoverers and survivors to realize their untapped potential to lead productive lives.

“Cheryl, what can I say but thank you for all the work you have done,” writes Marco in an email. “When I was in a coma and basically dead, I knew that one reason to live is that there are wonderful people out there. Somebody who helps others not because it will benefit her, but just because they are good people is wonderful. This world would be a different

OFFICE RECEIVES PLATINUM AWARD AND TOP VOLUNTEER PRIZE

Los Angeles Office Chair Elena Baca volunteers to shuck corn at the LA Regional Bank

Paul Hastings received two prestigious awards from the Los Angeles Regional County Foodbank’s “Food from the Bar”

Food Drive:

Volunteer of the Campaign; and Platinum Level Partner

We won the Volunteer of the Campaign award by producing the highest number of volunteers at the Foodbank’s offices. Our volunteers shucked corn, sorted oranges, stacked crates, unloaded palettes, loaded bags of food for the hungry, and demonstrated the firm’s commitment to volunteerism.

The Platinum Partner Level status was achieved by raising more than $16,500 in cash contributions, donating 349 pounds of food, and staffing the most volunteer shifts in the campaign.

William Sullivan, co-chair of “Food from the Bar,” led a very successful campaign for food, volunteers and monetary donations. Under Bill’s leadership, 62 Southern California law

firms participated in the drive, more than double the previous year. The food drive raised more than $285,000 in donations and garnered 1,600 hours of service to assist the Foodbank, now in its 37th year and annual distributor of approximately 54 million pounds of food for the hungry in Los Angeles County.

OFFICE SCORES ASYLUM CASE VICTORIES

Somali Refugees Last year, Paul Hastings agreed to represent four young Somali men who escaped violence and paid smugglers to travel to the United States, where they approached

immigration authorities and requested asylum.

The Paul Hastings teams have included Jennifer Baldocchi, Sandra Benjamin, Gina Cook, Ryan Crain, Nicole Herter, Kelly Hsu, Sign Kadouh, Lisa Tran, Steve Turanchik, and Juliana Vallier. They have completed two trials, called “merits hearings” in immigration parlance. Both resulted in complete victories for our clients, with the court finding that the Somalis had a well-founded fear of persecution due to their membership in a particular social group and their political opinions.

The teams left no stone unturned, writing briefs in support

of the asylum applications, interviewing witnesses, obtaining expert and percipient witness declarations from individuals as far away as Saudi Arabia, and preparing for trial. The Immigration Judges repeatedly have commended the Paul Hastings lawyers for their work. One judge said that the application and the supporting documents were some of the best he had seen in his twenty years as an Immigration Judge.

The asylum trials have been dramatic, emotional experiences. At one, our client described the brutality that he and his family endured due to their clan membership. Next, the trial team called an uncle to the stand, who had traveled from

Minnesota to testify. Years ago, the uncle had escaped from Somalia, and he had not seen our client since he was a small child. Their reunion occurred during trial, when the uncle entered the courtroom. The courtroom fell silent, as both men were overcome with emotion. The judge, who appeared visibly moved, asked the uncle to approach and greet his nephew. They embraced in tears, and the team knew the case was won. The second trial was equally gripping as our client described how his neighborhood became a war zone, where

any opposition to the local militia would lead to certain death. After his father was killed, he became outspoken against the militia and barely escaped from Somalia alive.

Our remaining two Somali clients are awaiting their trial dates. Preparation for the trials continues, and the teams are cautiously optimistic. The U.S. asylum laws were designed to protect refugees from the very type of persecution our Somali clients have experienced. The firm and our lawyers are thankful for the opportunity to make a real difference in the lives of four individuals.

LGBT Victim in Zimbabwe

Although Zimbabwe’s Robert Mugabe is most well known for his brutal political regime and his violent suppression of political opponents, his attitude toward homosexuality is equally oppressive.

Because of the legal and cultural prohibitions on homosexuality in Zimbabwe, individuals who are known or believed to engage in homosexual activities are socially ostracized, persecuted, threatened with violence, or subject to actual attack. It is even common for families to disown homosexual relatives or commit them to psychiatric institutions in order to avoid social disgrace.

In 2009, Paul Hastings agreed to represent a 24-year-old Zimbabwean man who was openly bisexual and who had ties

to Zimbabwe’s political opposition party. The client’s father and brothers had been kidnapped and tortured by Mugabe’s supporters, and his family had been threatened because of its active opposition to Mugabe’s policies. The client also had witnessed violence against homosexuals and had learned firsthand of the police’s unwillingness to stop such violence. The client feared that if he returned to Zimbabwe, he would be attacked for both his political views and his homosexuality.

Colombian Political Target In another matter before an Asylum Officer, early in 2010, Paul Hastings agreed to represent a 32-year-old Colombian man who was persecuted by the leftist guerrilla group Fuerzas Armadas Revolucionaries de Colombia (FARC) for his ties to the Colombian military and police. FARC is a Marxist-Leninist

revolutionary guerrilla organization based in Colombia which is involved in ongoing Colombian armed conflict. FARC engages in serious abuses against civilians and non-civilians and is frequently involved in massacres, killings, threats, and kidnappings. FARC considers itself at war with the Colombian government and military and often displaces or kills civilians suspected of supporting the Colombian government or military.

Colombia. One of the client’s brothers and the client’s uncle

were murdered by FARC for their affiliation with the Colombian government. The client, his father, and his brothers all received threats from FARC and were under surveillance by FARC.

Due to the work of the Paul Hastings team, Vilma Bottger, Jennifer Hildebrandt, and Patty Rhoads, the Asylum Office granted asylum to the client based on the political opinion that FARC imputed to him. The client is now able to work and live in the United States and is looking forward to applying for citizenship.

Atlanta TAX ASSOCIATES ASSIST NONPROFIT Beijing Megan Genovese and Erika Mayshar have been providing Chicago corporate and tax advice to Beach City Service League (BCSL), a philanthropic organization of high school boys and Hong Kong their mothers. BCSL creates and supports charitable projects, develops community leadership skills in participants, and London foster mother-teenage son relationships. With Erika and Megan’s restructuring advice, BCSL has expanded from The Los Angeles Newport Mesa Chapter (est. 2007) and The Greater Orange Chapter (est. 2009) to a national organization, facilitating the New York tax exemption of several separate chapters. Orange County In addition, BCSL has grown from two classes of forty-three San Francisco boys and their mothers to more than 200 mothers and their sons. The organization has supported a variety of community Shanghai organizations, including a beach clean-up effort, the American Cancer Society, Environmental Nature Center, Tokyo Second Harvest Food Bank, Someone Cares Soup Kitchen, and the Special Olympics, among others, contributing Washington, approximately 3,800 hours of community service. D.C. SETTLEMENT FOR LOW-INCOME MOTHER Resources Ryan Fawaz represented a pro bono client referred by Office Contacts: community development group MIKA, on which fellow lawyer Pro Bono & James Herriot serves as a Board member. Our client rode her Community bicycle into an unmarked trench on a public street near her Committee home, causing her to fall and fracture her arm. One surgery and multiple weeks of physical therapy later, she still could not return to work or care for her small children. Both the construction firm and the city denied liability and refused to help her in any way.

Ryan drafted and filed the complaint against both entities and proceeded with discovery. After Ryan was able to secure inspection reports and photographs of the accident scene, defendants were willing to negotiate a settlement. Ryan, with the help and supervision of Glenn Dassoff, was able to secure a monetary settlement that covered all past and future medical expenses, and was significantly larger than the

original claim rejected by the city before Ryan took on the case.

EMPLOYMENT LAWYERS RESOLVE WRONGFUL DEATH LAWSUIT

At the request of the Orange County Public Law Center, lawyers Joe Anderson, Jim Carter, and Brig Cheney, along with paralegal Manel Wijemanne, defended a Hispanic mother of four children in connection with a tragic lawsuit. The young mother had accidentally run over and killed another tenant’s unsupervised two-year old son in his or her apartment complex’s parking lot. In the resulting wrongful death lawsuit, the Paul Hastings lawyers assumed her defense and that of her husband, who was alleged to have negligently entrusted

the vehicle to his wife (who does not possess a California driver’s license). Through aggressive discovery, Jim, Joe, and Brig were able to convince plaintiffs’ counsel, and their own clients, that the clients were not at fault. A dismissal with prejudice was secured for a waiver of costs, and the grateful clients feel a huge burden has been lifted.

ASYLUM VICTORY STREAK CONTINUES

Our Washington, D.C. office’s streak of asylum victories continues: Lianne Labossiere and Robert Winter have won asylum for a 21-year old gay man from El Salvador. The client had been subjected to escalating gang violence as a teenager and came to the U.S. at age 16 to escape persecution. Robert

and Lianne persuaded the immigration officer that the client has a well-founded fear of future persecution on account of his sexual orientation if he were to return to his country. Although the client did not apply for asylum within the one-year deadline, Robert and Lianne argued that was because of his difficult coming-out process. Having overcome his fear of rejection by his family, and a strong cultural stigma against homosexuality, the client had only recently embraced his sexual orientation and, realizing the risk he faced in returning

to El Salvador as a gay man, promptly sought legal assistance to apply for asylum. The immigration service accepted the argument that the “changed circumstances” exception to the one-year rule applied and granted asylum.

BACK-TO-SCHOOL FUNDRAISER FOR NEW LIBRARY AT GARFIELD ELEMENTRY

The Washington, D.C. office raised more than $1,000 to purchase new books and supplies for Garfield Elementary, the firm's newly adopted D.C. Public School in a Southeast neighborhood. Through the combination of a “Jeans Day” fundraiser, a book drive, and a building-wide bake sale, the office raised enough money to purchase 18 boxes of new books, art supplies, and educational activities for Garfield’s

LAWYER RECOGNIZED FOR PRO BONO SERVICE

Our Washington, D.C. office continues to receive great praise from our pro bono clients; this time for Candice Castaneda’s work with the Eastern Shore Land Conservancy (ESLC). A non- profit organization in Maryland, ESLC requested Paul Hastings assist them in gaining a better understanding of their lobbying limits and obligations under U.S. Treasury Regulations and

Maryland law. ESLC’s mission is to preserve and sustain the communities of the Eastern Shore of Maryland (and the lands and waters that connect them) by promoting sound land use planning. As part of these efforts, ESLC is active in attempting to influence land use plans and zoning board actions, and it interacts with the Maryland legislature and executive branch. ESLC requested guidance on (i) what forms of advocacy are not lobbying, (ii) when research is considered a lobbying expenditure, and (iii) whether attempting to influence zoning board actions is lobbying. In response to our memorandum, ESLC wrote, “Your research will help us do our work more

effectively and with more confidence.”

LAWYERS SUPPORT HIGH PROFILE PRO BONO INVESTIGATION

Members of the Washington, D.C. office recently concluded a high-profile, internal investigation into allegations of racial and sexual orientation discrimination made by a current executive of a well-known, national charitable organization. Our lawyers conducted interviews and an investigation and completed a rather robust report of the issues that was presented to the board of the organization. The organization’s board thanked the firm for our guidance and pro bono counsel.
