STATE OF DEMOCRACY, HUMAN RIGHTS This is the 2021 report of the Secretary General of the Council of Europe on the state of democracy, human rights and the rule of law in Europe. It is divided into two parts. We are concerned about the specific uses of prenatal Dexamethasone (DEX), nonconsensual medically unnecessary surgeries on infants and minors, the gross mistreatment of Pinki Pramanik, and the recent addition of intersex people under the language of “DSD” (Disorders of Sex Development) to the DSM-V. Ms. Pramanik is the Indian gold medal winning athlete who was arrested on June 14th and forced to undergo invasive gender verification testing after being accused of rape and of “being male” by her live-in partner. Following the accusations, she was suspended from her job, detained in a male ward despite her lifetime status as a woman, and an MMS (picture message) of one of her gender-verification tests, in which she is nude, went viral. Ranjit Sur, of the Association for Protection of Democratic Rights, shared on a CNN IBN Live broadcast that the “Human Rights Commission of West Bengal have already agreed that Pinki’s rights have been violated.” He went on to elaborate on her abuses: “Internationally, nationally, in school, in college, everywhere, she is treated as a woman, so so long as it is decided defensively that Pinki is male, she should be treated as a woman;” adding that, “(F)or the last twenty-one days, Pinki has been in government custody….

http://assembly.coe.int Doc. 14404 25 September 2017 Promoting the human rights of and eliminating discrimination against intersex people Report1 Committee on Equality and Non-Discrimination Rapporteur: Mr Piet De BRUYN, Belgium, Members not belonging to a Political Group Summary Intersex people are born with sex characteristics that are not exclusively either male or female. In our societies, they face human rights violations and discrimination in all fields of life. Invasive and irreversible sex-“normalising” surgery and hormonal treatments are carried out on intersex children without their free and informed consent and even though there is no medical need for such treatment. Member States should prohibit such interventions and defer treatments that seek to alter the sex characteristics of intersex children until they are able to participate in the decision. Health care should be multidisciplinary, holistic and patient-centred, and psychosocial support should be made available both to intersex people and their families. To protect the right to private life, birth registration systems should allow sufficient flexibility to accommodate the needs of intersex people, and quick, transparent and accessible legal gender recognition procedures must also be available. States should collect more data and carry out further research into these matters, and consider granting compensation to victims of past treatments. They should ensure that anti-discrimination legislation effectively protects intersex people and carry out campaigns to raise awareness among professionals and the general public as regards the situation and rights of intersex people. 1. Introduction These written comments are submitted on behalf of OII Europe (Organisation Intersex International Europe e.V.), ILGA-Europe (European Region of the International Lesbian, Gay, Bisexual, Trans and Intersex Association), and C.I.A. (Collectif intersexes et allié-e-s) pursuant to leave granted by the President of the Fifth Section. The present case concerns the French authorities’ refusal to allow for the current “male” gender marker of the applicant, an intersex person, to be replaced by “neutral” or “intersex” on the birth certificate. The third-party interveners contrast the French authorities’ decisions with broader trends at the national, regional and international levels that favour recognizing gender identity on the basis of self-determination, including by allowing for the recognition of non-binary identities. In doing so, the present submission places the Court’s jurisprudence in a wider legal and policy context, drawing from regional and international comparative law. The submission provides information about “intersex” as an umbrella term and the spectrum of variations of sex charateristics (II). It documents the violence and discrimination faced by intersex people due to lack of recognition of their human rights (III). It further reviews the current obstacles faced by intersex people seeking legal gender recognition, providing guidance on how to overcome them (IV). Last, the submission brings to light the emerging trend towards recognition of gender identity as non-binary by placing recent national, regional and international law developments in the context of Article 8 of the Convention (V).
