(6) Update on procedures and improvements to the APAS planning application processing system Reported – The Head of Development Management and Compliance presented the report and background. Members were provided with a demonstration of the system’s functions and arising thereon, made the following observations:- - at the annual meeting with Councils, officers should discuss the most effective ways for Community Councils to respond to consultations, with the emphasis on providing sound planning reasons. - during the annual meeting, officers should provide training on electronic communication and demonstrate how to access the link to weekly lists etc. RESOLVED to note the report, for information.

Applicant: Description: Mr. Gwyn Williams Construction of 4 dwellings (2 affordable Clydfan and 2 open market) together with the Ffordd y Felin installation of a sewage treatment plant and Bryncrug extension to estate road. Gwynedd LL36 9NT

Site: The site (approx. 0.4 hectares) forms part of a larger agricultural field located on the western side of Ffordd y Felin. The site is surrounded to the north, east and south by residential properties of various types and sizes, and open agricultural land to the west.

Proposal: This application is for the construction of 4 detached two-storey dwellings (2 affordable and 2 open market) with attached garages, together with the installation of a sewage treatment plant. The development would be accessed by an estate road (a private road) extending from the existing estate road of Ffordd y Felin.

Responses from consultees: Bryncrug Community Council No objection – proposal welcomed Gwynedd Council - Highways Recommended that the estate road’s design be amended to comply with the Highway Authority’s adoption requirements. Awaiting further comments following confirmation that the estate road will be a private road. Gwynedd Council - No response received Environmental Health Gwynedd Council - Building No response received Regulations Natural Resources Concerns – The development site is within close proximity of a public sewer system. The applicant is required to confirm that the foul drainage will be connected to the mains sewer, otherwise demonstrate it is not feasible to connect to the main sewer. North Wales Fire Service No observations Dwr Cymru / Welsh Water Comments - advised that the applicant contact Natural Resources Wales as it is intended to utilise a private treatment works. Asked to be re-consulted should circumstances change and a connection to the public sewerage system is sought. Ecology Comments – landscaping plan requested Forestry Comments – landscaping plan requested

Responses as a result of site notice and neighbour consultation: Letters of objection have been received from one immediate neighbour and the Ffordd y Felin Action Committee (which includes 16 signatures). Their comments/objections are summarised as follows:  New dwellings would encroach upon, and overlook, 2 Mill Lane.  Access to the field is very limited and is subject to flooding.  Additional traffic during and after construction would be disruptive along Mill Lane and Ffordd y Felin.  Noise generated during the construction of the development will be disruptive to neighbours.  The sheep occupying the field provide a lot of interest to the locals and visitors.  Concerns that additional houses will be sought on the site at a later date.  Concerns over the affordability of those assigned as affordable houses.  Loss of view.  Effect on saleability of existing dwellings on the estate.  There are a number of houses for sale in the area with little interest. No need for more.  The previous applications were refused; what is different this time?  Detached two-storey houses out of character.  Concerns regarding the maintenance of the residual piece of land designated on the site plan as ‘Land to remain as existing’.  Concerns regarding effect of the proposed development on the parking requirements along the existing estate.

Relevant Planning Policies – Eryri Local Plan: Policy No. Policy SP A National Park Purposes and Sustainable Development SP G Housing DP 1 General Development Principles DP 6 Sustainable Design and Materials

Background: Planning applications NP5/55/60C and NP5/55/60D were refused in 2012, and an appeal was subsequently dismissed in 2013, for the construction of a total of 4 dwellings along the eastern boundary of the larger site immediately opposite the grass verge along Ffordd y Felin. The applications were refused on design, setting and layout.

The inspector came to the conclusion that the proposed layout of the houses (where the rear gardens of the dwellings would face Ffordd y Felin) would be at odds with the prevailing pattern of development and would result in an incongruous and isolated development. The development would have a harmful impact on the character and appearance of the area and the special qualities of the National Park. The development would also significantly harm the living conditions of neighbouring residents. A copy of the appeal decision is included in document bundle no.1.

Assessment: Pre-application was sought initially for 9 dwellings on the site. Officers raised concerns that the proposed scheme would not overcome the concerns raised with the previous applications. It was advised that a maximum of 4 dwellings along the western boundary of the site may be considered more favourably, with the remainder of the site safeguarded as open space to ensure no detrimental impact on the amenities of the existing and proposed dwellings.

The proposed development subject to this application is for the construction of 4 two-storey detached dwellings, located as per officer’s advice along the western boundary of the field. The proposed layout is considered to safeguard the amenities of both the existing and proposed dwellings and there would be no direct overlooking given the distances between the properties. It is also considered that there would be no harmful impact on the character and appearance of the area; the orientation of the dwellings would follow the overall pattern of development within the village, i.e. that being mainly detached houses facing onto their respective roads.

Whilst there has been concerns that the proposed two-storey detached dwellings would not be in keeping within the estate of bungalows and dormer bungalows, it should be noted that within the village of Bryncrug there are a number of housing developments of various designs and sizes. Examples of two-storey dwellings in the immediate vicinity can be found to the north of the site (Cilvan House and Glyn Saron on Mill Lane). The area does not have a particularly distinctive character and could accept variety in terms of design of new dwellings.

Materials proposed are stone facing on the front elevation of each dwelling and render to all remaining elevations. The agent has been advised that the proposed stone facing would be unnecessary in this context as the predominant material within the existing estate is pebbledash/render, and has been invited to submit amended plans to this effect. These are awaited at the time of writing.

Strategic Policy G seeks 50% affordable housing to meet local need on privately owned allocated sites within the housing development boundaries of settlements.

Of the four dwellings proposed two have been allocated as affordable dwellings; the other two would be open market dwellings. The proposal therefore complies with Strategic Policy G. In addition, the size of the affordable units (120m2) complies with the requirements of Supplementary Planning Guidance 4: Affordable Housing with regards to the maximum size of a two-storey, 3-5 bedroomed. The size restriction is to ensure that the size of the dwelling is proportionate with the needs of the intended household and is affordable to current and future occupiers.

The applicant has been invited to enter into a Section 106 Agreement restricting occupancy of the dwellings to persons satisfying the ‘local person’ criteria and in housing need. At the time of writing the applicant was yet to confirm their willingness to enter into a s106 agreement.

Following comments from consultees a landscaping scheme has been sought and the agent has made enquiries with Welsh Water regarding connection with the public sewer network. Further plans/information were awaited at the time of writing. Further comments are also awaited from Highways following confirmation that the extended estate road is to be a private road.

In response to the remaining concerns raised by local residents:  Officers consider there would be no detrimental impact on the residential amenity of Golygfa (2 Mill Lane). There would be no direct overlooking between plot 4 and Golygfa due to the orientation and layout of the proposed dwelling. Appropriate landscaping/boundary treatments can overcome any potential overlooking within the private gardens.  NRW have not raised any concerns regarding flooding.  No concerns have been received from Highways in relation to any traffic implications during and after construction.  A condition can be imposed restricting the hours of construction to protect the amenity of local residents from noise disturbance.  The merits of any further development of the site will be considered if/when an application is submitted. Local residents will have the opportunity to comment on any further applications that are received.  The future affordability, management and ownership of the affordable dwellings will be safeguarded in perpetuity through the imposition of a planning agreement under section 106 of the Town and Country Planning Act 1990.  With regards to concerns over loss of view, it is well established that it is not the role of the planning system to protect the views of private individuals. This cannot be regarded as a material planning consideration.  The saleability of existing dwellings on the estate and cannot be regarded as a material planning consideration. The planning system does not exist to protect the private interests of one person against the activities of another.  There are significant differences between the current application and those previously refused. The layout of the proposed development is no longer at odds with the prevailing pattern of development with the dwellings orientated towards the new estate road and Ffordd y Felin. There would be no inactive frontage facing Ffordd y Felin. There are also no concerns regarding disturbance and harm to the living conditions of the residents of Cilvan House and Golygfa by means of the lights of cars using the estate road.  Further clarification regarding the maintenance of the residual piece of land designated on the site plan as ‘Land to remain as existing’ has been requested from the agent.

Conclusion: The proposed development is considered to comply with the relevant policies identified above. The nature, location, form and scale of the development is compatible with the character of the site and will not significantly harm the amenity of neighbouring properties.

Subject to the submission of the additional information as detailed in the assessment, and any further comments received as a result of further consultation, it is officers opinion that the application should be supported.

RECOMMENDATION: To approve (subject to relevant conditions) following submission of satisfactory information/amended plans with regards to external materials, landscaping scheme, connection with the public sewer network, and the successful completion of a s106 agreement.

The second prosecution took place on the 18th April 2018 where the owners of St. David’s Hotel were fined £20,900 and ordered to pay costs of £782 and a victim surcharge of £170.

The Authority are exploring the possibility of initiating ‘direct action’ under Section 219, to attempt to secure the demolition of the hotel.

PURPOSE To approve the appointment of 1 casual vacancy for the Southern Local Access Forum

1. BACKGROUND

1.1 In April 2002 the Authority established two Local Access Forums; one for the north and one for the south of the National Park.

1.2 The South Snowdonia Local Access Forum has 18 members - 14 “lay” members and one representative each for Gwynedd Council, Conwy Council, SNPA and one representative for people with disabilities. Membership must be balanced between land management and recreational interests, and all members are required to demonstrate a commitment to improving access to the countryside. No interest group (other than interests of disabled people) is to have direct representation on the Forum.

Within recent months a vacancy have arisen due to the loss of a member for unavoidable personal reasons. This members was a representative of the equine interests on the SLAF. Therefore a replacement is necessary to ensure that this interest group is represented.

The prospective member attended the last meeting in March (by permission of the SLAF Chair) and has indicated that they are willing to stand as a replacement. The application were proposed and approved unanimously by the SLAF members as a casual appointee. With this in mid the SLAF Chair on behalf of the members has requested formal ratification of the candidate by the Authority.

1.3 Regulations - The Countryside Access Forums (Wales) published by the Welsh Assembly Government – stipulate that membership of a Forum continues for three years from the date of the first meeting of the Forum. However, the Regulations (Sect 5 {1}) also allow for the appointment of casual vacancies when standing members decide to leave the Forum/s for whatever reason within their formal term of appointment. These casual appointments are to ensure that the LAF membership remains balanced throughout.

1.4 It is suggested that the following procedure is followed.

That the Authority considers the casual appointment as presented.

PURPOSE To report for information on discussions and issues raised at meetings in March 2018 Northern and Southern Snowdonia Access Forums

1. BACKGROUND

1.1 There are two Access Forums in the Snowdonia National Park - one for Northern Snowdonia and one for Southern Snowdonia.

1.2 The Access Forums are statutory (with a term of three years) appointed under the CROW Act 2000 (Section 94.4) to advise the Authority on improvements in access in the area in order to facilitate recreation and enjoyment in the outdoors. The meetings are held every quarter - in March, June, September and late November / early December.

1.3 Representatives from the Authority are nominated for both Forums.

2. March 2018 meetings

2.1 Matters discussed in both Forums 2.1.1 Discussion was had around the letter from both Forums sent to Chairman and Chief Executive of SNPA regarding the proposed budgetary cuts to the Warden & Access Section.

2.1.2 Discussions were had around letter from both forums sent to the WG Minister regarding the proposed reduction in SNP annual grant and the removal of ROWIP funding to local authorities.

2.1.3 Received an interesting presentation on the past, present and future of the All Wales Coastal Path from Quentin Grimley, NRW.

2.14 Presentation from Max Grant, Ramblers Cymru on the Donate a Gate Scheme operating in the Isle of Wight and how it is administered.

2.15 An update from Max Grant on the latest development and situation with the Project.

2.2 Matters discussed at the Northern Forum only (5/3/18)

2.2.1 Discussion was had on the potential for disabled access point on the road near leading to Marchlyn dam – Site visit will be arranged with First Hydro once the weather improves.

2.2.2 HLF Carneddau – interested in looking at cost and accessibility route for tramper at Cowlyd section and if that is feasible – Peter Rutherford will produce maps of circular for next meeting 2.2.3 Suggestions were made for site visit to the upper Conwy river to view canoe access/eagress point as well as the Glaslyn - early Summer

2.3 Matters discussed at the Southern Forum only (13/3/2018) 2.3.1 Members were informed that the proposals discussed at the November meeting for the Dolgoch access point will now be taken forward to resolve the issue. 2.3.2 4x4 problem at section above Dysyrnant, Cwm Maethlon was discussed – discussions are taking place for someone to remove the car that has been left on the site. 2.3.3 Members were updated on the Mawddach trail equine access following a recent meeting with NRW on site. Some legal issues need to be resolved before further progression.

Appeal Ref: APP/H9504/A/18/3192552 Site address: Plot 4 & 5, Felindre, Pennal, Gwynedd The Welsh Ministers have transferred the authority to decide this appeal to me as the appointed Inspector. • The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant planning permission. • The appeal is made by Mr A Sutton against the decision of Snowdonia National Park Authority. • The application Ref NP5/75/234A, dated 28/09/2017, was refused by notice dated 28/11/17. • The development proposed is a new dwelling.

Decision

1. The appeal is allowed and planning permission is granted for a new dwelling at Plot 4 & 5, Felindre, Pennal, Gwynedd in accordance with the terms of the application, Ref NP5/75/234A, dated 28/09/2017, and the plans submitted with it, subject to the conditions in the attached schedule.

Procedural matter

2. The initial application (ref: NP5/75/234), dated 15/11/16, was refused planning permission on 06/02/17. This appeal is in relation to the amended scheme that followed the initial application.

Main Issue

3. This is the effect of the development proposed on the character and appearance of the locality.

Reasons

4. Pennal is a small rural settlement that is set within the countryside in this part of the National Park where partially wooded hillsides start to rise up on the northern side of the River Dyfi and its estuary. Much of the development in Pennal is along the A493 and around its junctions with roads such as Tower Road. The appeal site is on Tower Road.

5. Existing development within Pennal varies in type, style and design, but buildings are often faced with stone or render. They include detached, semi-detached and terraced houses, along with church, public and business premises. Some buildings are next to the highway and others have considerable areas of amenity space around them.

6. The appeal site comprises two vacant development plots on the eastern side of Tower Road that are the subject of an outline planning permission for residential development granted in 2005. Bryn Awel is immediately to the south of the appeal site, while Ty Felindre is to the north. Ty Felindre is separated from the appeal site by a number of very recently constructed dwellings that include a small terrace, a detached house and a semi-detached block.

7. These recently constructed dwellings are of differing contemporary designs, but their heights and massing now combine to create a strong eastern edge to Tower Road, except for the gap provided by the undeveloped appeal site. This strong edge is especially evident when the recent additions to the street are viewed along with Ty Felindre, or Bryn Awel and development in the centre of Pennal to the south.

8. Ty Felidre and Bryn Awel appear to be buildings of some age, and they reflect historic architectural themes within Pennal that contribute to the established character and appearance of the settlement. Both buildings are accessed from doors in a side elevation, which at Ty Felindre is the side elevation of a two-storey front projection that may be an addition to the original building. A number of semi-detached bungalows on the opposite side of Tower Road also have entrance doors in their side elevations rather than the highway frontage. Many of the ‘front’ doors of houses in the settlement are on the highway frontage. However within the context of existing development in Pennal, a side entrance into the proposed dwelling is in keeping with the established character and appearance of the settlement and the variety within it.

9. The architecture of the proposed dwelling would result in a contemporary pitch roof structure that would have a principle ridgeline parallel to the highway. In addition to the resulting northern and southern side elevation gables, the building would include gable features to the front and rear. Both the principal orientation of the roof and gables facing the highway are elements of the street scene in the vicinity of the appeal site.

10. Accommodation within the appeal proposal would be on two floors adjacent to Bryn Awel, and on one floor in the northern part of the building. Land levels rising across the appeal site to the north would provide a higher gable next to Bryn Awel, and the proposed accommodation in the roof void would be apparent through the fenestration in the front gable.

11. Drawings indicate that the ridge height of the appeal scheme’s single storey element would be considerably lower than the neighbouring full height two storey semi- detached block to the north. However, the southern gable would be next to the single storey garage that extends out from the much taller and larger hip roofed main part of Bryn Awel.

12. It is apparent that the proposed built form would complement the existing variety along Tower Road, which includes very recent interpretations of local character and appearance. While the proposed dwelling would have its upper floor within the roof void, it would nonetheless have sufficient scale to integrate appropriately with the massing around it. It would clearly reflect the character of Pennal, and especially the varying heights of built forms in the settlement’s historic core around the A493.

13. Eryri Local Development Plan 2007-2022, adopted 13 July 2011 (‘LDP’), Development Policy 1 seeks to conserve and enhance the special qualities and purposes of the National Park and is only permissive of development that would be, amongst other things, of a nature, location and siting, height, form and scale that is compatible with the capacity and character of the site and locality.

14. Planning Policy Wales – 9th edition (‘PPW’) confirms that the statutory purposes of National Parks are to conserve and enhance their natural beauty, wildlife and cultural heritage and to promote opportunities for public understanding and enjoyment of their special qualities.1 PPW also highlights that in locations such as National Parks, Areas of Outstanding Natural Beauty and Conservation Areas it can be appropriate to seek to promote or reinforce traditional and local distinctiveness.

15. PPW Technical Advice Note (‘TAN’) 12 – Design states that design which is inappropriate in its context, or which fails to grasp opportunities to enhance the character, quality and function of an area, should not be accepted, as these have detrimental effects on existing communities.2

16. For the reasons above, it is evident that the appeal proposal would reinforce local distinctiveness in Pennal, which contributes to the character of the settlement and highlights the natural beauty of the National Park around it. In this regard, the proposal would conserve and enhance the natural beauty of the National Park and complies with LDP Development Policy 1 and the relevant parts of PPW and TAN 12.

Conditions

17. If this appeal were to be allowed, in addition to a condition to address the time period for commencing the development, for the avoidance of doubt and to ensure an appropriate form of development, a condition would be imposed regarding the approved drawings. In the interests of the character and appearance of the locality, conditions would be imposed to address the external materials and finishes used in the dwelling and the removal of the redundant access to the lower plot. In the interests of highway safety, local living conditions and the character and appearance of the locality, a condition would be imposed in relation to the provision of vehicle parking and turning areas. In the interests of protecting the natural environment and local living conditions, a condition would be imposed in regard to drainage.

18. The National Park Authority has suggested a condition that would control a number of permitted development types that, in the absence of the condition, would be allowed on the appeal site without further planning approval. Welsh Government Circular WGC 016/2014 – The Use of Planning Conditions for Development Management states that “…Save in exceptional circumstances, conditions should not be imposed which restrict either permitted development rights granted by development orders or future changes of use which the Use Classes Order would otherwise allow…”.3

19. However in this case, the appeal proposal occupies a large plot on the edge of a village in the National Park. Retaining the architectural integrity of the proposed dwelling and the openness around it would contribute to, and reinforce, the character of the group of contemporary dwellings on this side of Tower Road, the village, and the National Park. It is evident that the specific circumstances of the appeal proposal are exceptional and justify the restriction of permitted development rights in relation to the proposed dwelling. Therefore, a condition would be imposed to control permitted development.

20. All representations in this case have been taken into account. For the reasons given above, the proposal would conserve and enhance the natural beauty of the National Park, and no matters have been found to outweigh the identified compatibility of the proposal for its location and the resulting policy compliance. Accordingly, the appeal should be allowed.

21. In reaching my decision, I have taken into account the requirements of sections 3 and 5 of the Well Being of Future Generations (Wales) Act 2015. I consider that this decision is in accordance with the Act’s sustainable development principle through its contribution towards the Welsh Ministers’ well-being objective of supporting safe, cohesive and resilient communities.
