Now there chanced to be there a base man, whose name was Sheba, the son of Bichri, a Benjamite; and he blew a 'shofar' and declared, "We have no portion of David, neither have we an inheritence in the son of Jesse; every man to his tents, O' Israel." 2. And all the men of Israel went up from after David, following Sheba the son of Bichri, but the men of Judah cleaved to their king from the Jordan until Jerusalem… 6. And David said to Abishai, "Now Sheba the son of Bichri will cause us more harm than did Absalom; [therefore] take you your lord's servants and pursue after him, lest he find for himself fortified cities and save [himself before] our eyes." 7. And Joab's men went after him with the archers and the slingers and all the warriors; and they went out of Jerusalem to pursue Sheba the son of Bichri… 16. And a wise woman called out from within the city, 'Hear, hear; say, I pray you, to Joab: 'Come closer to here so that I may speak to you.' 17. And he came near to her, and the woman said, "Are you Joab?" And he said, "I am" And she said to him: 'Hear the words of your handmaid.' And he said: 'I am listening.' 18. And she spoke saying: "Surely they should have spoken first [to hear what they have] to say, had they inquired of [the people of] Abel, and so would they have made peace. 19. I am of [those] that are peaceful and faithful to Israel; [Why then] do you seek to destroy a city and a mother in Israel? Why should you swallow up the inheritance of the Lord?" 20. And Joab answered: 'Far be it, far be it from me, that I should swallow up, or that I should destroy. 21. The matter is not so; but a man of the hills of Ephraim named Sheba the son of Bichri has lifted his hand against the king, against David; Give us him alone and I will depart from the city.' And the woman said to Joab, "His head shall be thrown to you over the wall." 22. And the woman came to all the people in her wisdom. And they cut off the head of Sheba the son of Bichri and threw it to Joab. And he blew the shofar, and they dispersed from the city, every man to his tents. And Joab returned to Jerusalem to the king. 4. כסף משנה, הלכות יסודי התורה ה:ה כתב הרמ''ך אף על פי שנמצא בתוספתא כדבריו לא ידענא טעמא מאי דהא מסיק בגמרא (פסחים כ''ה) דמש''ה אמרינן בשפיכות דמים יהרג ואל יעבור דסברא הוא מאי חזית דדמא דידך סומק טפי והכא ליכא האי סברא דהא יהרגו כלם והוא עצמו ומוטב שיהרג הוא עצמו ואל יהרגו כולם... 5. אבן האזל הלכות יסודי התורה פרק ה:ה ...ויש לומר דהא הוקש נערה המאורסה לרוצח; אף דליכא סברא ממילא גם ברוצח יהרג ואל יעבור אף דליכא סברא, ועיין מש"כ בהלכה ד'. 6. ט"ז יורה דעה סימן קנז ס"ק ח ...ועוד נראה לי דבמקום שאין מוסרין אותו אין חילוק בין מסירה למיתה או לשאר יסורים או אפילו לממון... 7. סנהדרין ע״ג. מתני': ואלו הן שמצילין אותן בנפשן הרודף אחר חבירו להרגו ואחר הזכר ואחר הנערה המאורסה... 8. מסכת אהלות ז:ו האישה שהיא מקשה לילד - מחתכין את הוולד במעיה, ומוציאין אותו אברים אברים מפני שחייה קודמין לחייו. יצא רובו - אין נוגעין בו, שאין דוחין נפש מפני נפש. 9. מנחת חינוך מצוה רצה-רצו ומבואר ג"כ בזה דמורד במלכות אין הדין כנגמר דינו . ומה שמבואר - דאם ייחדו והוא חייב כשבע ב"ב מותר למסרו - היינו כשהמלך מבקשו להרגו כעובדא דשבע ב"ב... ואם אדם אחר הורגו בודאי נהרג עליו. מ"מ מותר למסרו כיון דהמלך רוצה להרגו ע"י ה"ל כרודף דבפשיעתו הוא וכ"ה בט"ז שם אפי' הוא מורד במלך אשר לא ממלכי ב"ד מ"מ כיון דבפשיעתו הו"ל כרודף ומותר למסרו וז"פ וכן מבואר כאן בנשים שהלכו ורוצה האנס שימסרו א' ויטמאוה ואם לאו יטמאו כולם יטמאו כולם ואל ימסרו נפש מישראל. ואם א' מהם יחדו תלוי בפלוגתא הנ"ל כי כאן ל"ש חייב כשבע ב"ב כ"כ הט"ז. וע"ש עוד שאם אמר שימסרו לו א' ויטמא ואם לאו יהרוג כולם בודאי מוסרין כי אפי' היא עצמה תעבור ואל תהרג כמבואר לעיל. 10. ב"ח יורה דעה סימן קנז ...הנה אם אותו פלוני חייב בכך על ידי מעשיו שעשה כנגד הגוים יכולין למסור אותו בידי גוים. וכסברת הרמב"ם אליבא דריש לקיש, דמאחר דאיהו גרם לנפשיה ע"י מעשיו אין אנו נתפסים עליו אלא דמו בראשו הוא דגרם לנפשיה. ואע"פ דהרמב"ם כתב דאין מורין לכתחלה כך, אין זה אלא היכא ששואלין בפירוש להרגו; אבל בסתם שאלה, דאפשר דלא באו להרגו, יכולין למסרו ואין עובר בזה על משנת חסידים. ושלשה חילוקים בדבר. אחד אם חייב מיתה בדין תורה כשבע בן בכרי מורין לכתחלה. ב' אם אינו חייב מיתה בדין תורה אלא בדיניהם ושאלו להרגו לאו משנת חסידים הוא ואין מורין כך לכתחלה. ג' אם שאלוהו בסתם שימסרוהו להם ולא נודע אם דעתם להרגו אם לאו, אם חייב בדיניהם שימסרוהו להם יכולין למסרו להן ומורין כך לכתחלה. 11. ט"ז יורה דעה סימן קנז ס"ק ח חייב מיתה כשבע בן בכרי: נראה דלהכי נקטיה כשבע בן בכרי דאע"פ דבדין תורה לא היה חייב מיתה אלא מצד חוק המלכות שמרד בדוד מ"מ מוסרין אותו אם יחדוהו.

    Strategic and Non-policy Voting: A Coalitional Analysis of Israeli Electoral Reform Ethan Bueno de Mesquita Department of Government Harvard University Forthcoming in Comparative Politics, October 2000. Strategic and Non-policy Voting: A Coalitional Analysis of Israeli Electoral Reform Abstract I examine why a majority of Israel’s legislators voted for direct election of the prime minister, reforming the electoral system that vested them with power. The analysis incorporates coalitional politics, strategic voting, and voter preferences over non-policy issues such as candidate charisma. The model generates novel hypotheses that are tested against empirical evidence. It explains five empirical puzzles that are not fully addressed by extant explanations: why Labour supported the reform, why Likud opposed it, why small left-wing parties supported the reform, small right-wing parties were split, and religious parties opposed it, why the Likud leadership, which opposed reform, lifted party discipline in the final reading of the bill, and why electoral reform passed at the particular time that it did. Strategic and Non-policy Voting: A Coalitional Analysis of Israeli Electoral Reform On March 18, 1992, Israel’s twelfth Knesset legislated the direct election of the Prime Minister, fundamentally altering Israel’s electoral system. Such large-scale electoral reform is rare in democracies.1 This is because electoral reform requires that those who have been vested with power by a particular system vote for a new system whose consequences are uncertain. Efforts to explain the political causes of Israeli electoral reform leave critical questions unanswered. A theory of electoral reform must explain both the interests of the political actors involved as well as why reform occurred at a particular time; it must specify the changes in the actors’ interests or in the political system that led to reform.

    ZIV FINAL 3/2/2009 8:46:47 AM REGULATION OF ISRAELI LAWYERS: FROM PROFESSIONAL AUTONOMY TO MULTI- INSTITUTIONAL REGULATION Neta Ziv* INTRODUCTION** Since the 1950s, research on the social organization of lawyers has attracted legal scholars and social scientists interested in jurisprudence and the justice system. Law is no longer considered only a system of state commands or a technical mechanism to resolve disputes, but also a body of knowledge shaped by experts and professionals and a site of power for controlling the production of such knowledge. Thus, questions about the groups that comprise the legal profession have become an integral part of research about law and the legal system. Lawyers, a dominant group within the legal profession (alongside judges and the legal academia), are part of “law making.” As Philip S. C. Lewis contends, “[lawyers] stand between the formal legal system and those who are subject to or take advantage of it.”1 They are necessary agents for people who wish to enjoy the protection of law. They draw legal materials that constitute the basis of legal arguments and reasoning. They formulate contracts, take part in drafting legislation, manage negotiations, and are necessary agents within adjudication.2 This Symposium inquires into the relationship between lawyers and democracy. The richness of its essays attests to the variety of paradigms in which one could examine this question.     Review of the Year UNITED STATES United States National Affairs A OR THE JEWISH COMMUNITY—as for the entire nation—1998 was the year of the Monica Lewinsky scandal, a black hole that swallowed up media attention and the time and energies of countless government officials and com- mentators. The diversion created by the scandal notwithstanding, the year was filled with issues and events of considerable importance to the Jewish commu- nity. Congressional elections were held in 1998. It was also a year in which the House of Representatives voted down a proposed constitutional amendment that would have had profound implications for religious liberty, as well as a year in which the constitutionality of vouchers was addressed by the highest American court ever to consider the issue. It was a year, too, of profound developments in Catholic-Jewish relations, including the release by the Vatican of its historic state- ment on the Holocaust, and a year in which the U.S. Supreme Court declined to find that the American Jewish community's leading voice on American-Israeli re- lations was obligated to register as a "political action committee" (but left the issue open for further consideration). Finally, 1998 was the year when it appeared that John Demjanjuk, at one time sentenced to death as a war criminal and still viewed as such by many in the Jewish community, might well be allowed to live out his remaining years as an American citizen.     DEMOCRACY, IDENTITY AND SECURITY IN ISRAEL’S ETHNIC DEMOCRACY: THE IDEATIONAL UNDERPINNINGS OF INSTITUTIONAL CHANGE By Dubi Kanengisser A thesis submitted in conformity with the requirements for the degree of Doctor of Philosophy Graduate Department of Political Science University of Toronto © Copyright by Dubi Kanengisser, 2016 Democracy, Identity and Security in Israel’s Ethnic Democracy: The Ideational Underpinnings of Institutional Change, Doctor of Philosophy, 2016, Dubi Kanengisser, Graduate Department of Political Science, University of Toronto Abstract This work expands on the growing ideational institutionalist literature by proposing that institutional change and stability are influenced most substantially by changes to the underlying ideational network which link core societal ideas. These core ideas create the framework on which institutions are built and in which form they are fashioned. Changes to the ideational network lead to adaptive changes in institutions, but the difficulty in completely removing core ideas from these networks protects the institutions from substantial change. The theory is demonstrated using the case of the surprising stability of ethnic democracy in Israel in the wake of the substantial changes to the country’s economic and security realities. Small adaptive changes in the institution of ethnic democracy are traced back to changes in the balance between three core ideas: democracy, Jewish identity, and security. The overall stability of the institution, however, is linked to the enduring linkages of the three core ideas even as they experienced changes in their individual meanings. ii Too many years the Israeli left also accepted the separation between Jews and Arabs. The analysis focuses on the behavior and political participation of players as a sort of human behavior which designs, directly or indirectly, a given social, collective reality. The conceptual framework uses theoretical tools of public policy and administration as well as new institutional approaches. In this context, the article defines policy entrepreneur, identifies the main characteristics of entrepreneurial activities, describes various strategies which the policy entrepreneur may employ, and characterizes a model of successful and effective policy entrepreneurship. The article emphasizes the importance of policy entrepreneurs in the public policy arena and suggests several insights regarding the conditions for their activity, their motivations and main strategies. The theoretical framework and main insights regarding the processes of institutional change in public policy are used in the analysis of the design of the Israel National Health Law of 1994 as a case study.     TRAFFIC CIRCLES: THE LEGAL LOGIC OF DRUG EXTRADITIONS EDWARD M. MORGAN* ABSTRACT This Article examines nationality, transjudicialism, and the “war on drugs” as they have played out in extradition proceedings around the world. The judicial decisions explored here are from the Privy Council (on appeal from the English-speaking Caribbean), the Israeli Supreme Court, and the Supreme Court of Canada. All of the judgments cite the same sources, engage in the same analytic process, and are under the same legal influence: a common language that talks about constitutional rights and then circles back to a starting point in international relations that augments rather than restricts state power. They also share a similar approach to the subject of drug policy and extradition law, in that all three national courts are located in states that have embraced U.S.-sponsored law enforcement while they at the same time have eschewed U.S. jurisprudence as a legal source. As the Article’s title suggests, the theory presented here is that the anti- drug campaign, with its non-American legal sources harnessed in support of American policy, has produced a self-referential legal world built on a peculiar form of logic whose circularity is hard to escape. 1.     Chapter 2 Noteworthy Jewish Descendants of Mariampole and Vicinity INTRODUCTION Some Mariampolers managed to survive not only the difficulties of life under the Russian Tsar and the Communists, but also the far more murderous designs of the Nazi regime. Those who managed to save themselves by immigrating to America and other parts of the world multiplied, and, in time, prospered as well. Within two or three generations, their descendants contributed to society in a great number of professions and community services. Some Jewish Mariampoler descendants have risen to high levels of achievement. By recognizing the work of those who have survived, we can surmise how much poorer our world is for the loss of those whose lives were cut short. While this is by no means a complete account of all of the descendants who have made valuable contributions, it is my hope that these biographical sketches will encourage others to share with me their stories so that they can be included in a subsequent edition of this project.
