Indonesia Briefing Jakarta/Brussels, 21 February 2001 INDONESIA'S PRESIDENTIAL CRISIS The Abdurrahman Wahid presidency was dealt a devastating blow by the Indonesian parliament (DPR) on 1 February 2001 when it voted 393 to 4 to begin proceedings that could end with the impeachment of the president.1 This followed the walk-out of 48 members of Abdurrahman's own National Awakening Party (PKB). Under Indonesia's presidential system, a parliamentary 'no-confidence' motion cannot bring down the government but the recent vote has begun a drawn-out process that could lead to the convening of a Special Session of the People's Consultative Assembly (MPR) - the body that has the constitutional authority both to elect the president and withdraw the presidential mandate. The most fundamental source of the president's political vulnerability arises from the fact that his party, PKB, won only 13 per cent of the votes in the 1999 national election and holds only 51 seats in the 500-member DPR and 58 in the 695-member MPR. The PKB is based on the Nahdlatul Ulama (NU), a traditionalist Muslim organisation that had previously been led by Gus Dur, as the president is usually called. Although the NU's membership is estimated at more than 30 million, the PKB's support is drawn mainly from the rural parts of Java, especially East Java, where it was the leading party in the general election. Gus Dur's election as president occurred in somewhat fortuitous circumstances. The front-runner in the presidential race was Megawati Soekarnoputri, whose secular- nationalist Indonesian Democratic Party of Struggle (PDI-P) won 34 per cent of the votes in the general election. -

BAB II KONDISI OBJEKTIF DPD Partai Keadilan Sejahtera (PKS) Kota Cilegon A. Sejarah Partai Keadilan Sejahtera Partai keadilan sejahtera (PKS) merupakan partai yang berdasarkan Islam yang pendiriannya terkait dengan pertumbuhan aktivitas dakwa Islam semenjak awal tahun delapan puluhan. Partai dengan lambing dua bulan sabit berwarna kuning emas ini merupakan kelanjutan dari partai Keadilan yang didirikan pada tanggal 20 Juli 1998.1 Partai keadilan sejahtera (PKS), sebelumnya bernama Partai Keadilan (PK) adalah sebuah partai politik berbasis Islam di Indonesia. Partai Keadilan didirikan oleh para aktivis intelektual Islam yang sering disebut komunitas dakwa, yang lahir dari fenomena politik kampus semenjak akhir 1970an, terutama setelah diberlakukannya kebijakan Nasionalisasi Kehidupan Kampus (NKK) yang mempersempit ruang kebebasan 1 Ali Said Damanik, Fenomena Partai Keadilan: Transformasi 20 Tahun Gerakan Tarbiyah di Indonesia, (Jakarta: Teraju, 2002) h. 218 26 27 dakwah. Pada awal 1980an mulai muncul gerakan keislaman dengan masjid-masjid sebagai basis oprasional dan strukturalnya, terutama masjid kampus. Ketika ada gerakan reformasi yang di ikuti oleh lengsernya soeharto, komunitas dakwah ini tidak menyia-nyiakan waktu untuk mendirikan partai. Berdasarkan latar belakang seperti itulah, partai keadilan didirikan dengan menggunakan Islam sebagai asas partai dan dideklarasikan pada tanggal 9 Agustus 1998. Partai yang dikomandani dengan istilah presiden partai oleh Dr. Ir. H. Nur Mahmudi Ismail dan Sekertaris Jendral H. Anis Matta, Lc. Ini berorientasi pada ajaran Islam guna mencapai tujuan dakwah Islam. Bersama dengan 41 partai politik lainnya, partai keadilan mempelopori tuntutan perubahan ketentuan Undang-undang pemilu tentang electoral threshold yang dirasakan tidak adil oleh mereka. Namun upaya ini menghadapi jalan buntu karna dihadang oleh sebagian kekuatan partai-partai besar yang khawatir akan revalitas dari kekuatan yang baru tumbuh. -

Despite much analysis of the role of this kiyai, the fact that the tidal position of kiyai in pesantren[s] is increasingly seen its inconsistency. This can be evidenced by the involvement of kiyai practically in politics, thus affecting the existence of pesantren[s]. The results of the author's analysis illustrate that kiyai at this time must be returning to its central role as the main figure, it is important to be done, so that the existence of pesantren[s] in the era can be maintained and focus on reformulation of moral fortress and morality. The reformulation that authors offer is through internalization and adaptation of modern civilization and focus on improvements in educational institutions, both in the economic, socio-cultural, and technological. Anak Agung Banyu Perwita. Indonesia and the Muslim World: Islam and Secularism in the Foreign Policy of Soeharto and Beyond. Copenhagen: NIAS Press, 2007. 238 pages. Michael Laffan We are often told that Indonesia is doubly distinct for being the largest Muslim nation on earth without being an Islamic state. Yet few Muslim countries are "Islamic states" if we take the premise that it is the implementation of Islamic law that defines the polity in such terms. I also suspect that the leaders of a bare minority of majority- Muslim nations ever base their foreign policy decisions on globalist Islamic sentiment rather than national or regional interest, unless domestic opinion is completely unbridled, which brings us to the particular book at hand. Following Rizal Sukma, Anak Agung Banyu Perwita, a senior lecturer at Bandung's Parahyangan Catholic University, claims that the major hypothesis of his book Indonesia and the Muslim World is that "foreign policies are ... influenced by the religious views and beliefs of policymakers and their constituents" (p. 2). Yet in this compact and useful set of essays, Anak Agung seems to have demonstrated the exact opposite. That is, the bebas-aktif (in his translation: "independent and active") foreign policy formulated by Indonesia's founding fathers has long trumped the religious concerns ascribed to or demonstrated by the majority of its citizens. More precisely, Anak Agung reflects on foreign policy actions taken in relation to a number of institutions and instances. These are, in order of discussion, the Organization of the Islamic Conference (OIC, founded in September 1969), "the Middle East Conflict" (actually a series of issues and events ranging from the question of Palestine to the Gulf Wars), the Moro "problem,"1 and the war in Bosnia-Herzegovina. -

Singapore: ISEAS Publishing, Institute of Southeast Asian Studies, 2009. 452 pp. Julie Chernov Hwang To date, most of the published scholarship on Islamist parties in Indonesia has fallen into two main categories, either single case studies, often focusing on the Prosperous Justice Party (PKS, Partai Keadilan Sejahtera), or articles that assess the grand sweep of Indonesian political parties, highlighting the most significant characteristics of individual parties and addressing the broad trends in party behavior. While many of those studies are highly insightful and theoretically grounded, comparatively few have succeeded in balancing depth with breadth. Islamism in Indonesia is a robust comparative study assessing the three most significant Islamist parties in the Indonesian political system: Partai Keadilan (PK, Justice Party; also, since 2003, PKS), Partai Persatuan Pembangunan (PPP, United Development Party), and Partai Bulan Bintang (PBB, Crescent and Star Party). While Bernard Platzdasch's book spans the period from 1955 to 2009, the bulk of his analysis centers on the transition period, between 1998 and 2002. Platzdasch contends that Islamists endeavor to apply Islamic philosophy, law, and morality to politics for very specific doctrinal, theological, and historical reasons. Most Muslims believe that Sharia deals with all aspects of their life. However, the history of Sharia shows that categories of Sharia vary depending on time and place. Through the ages, Sharia has developed and it has also been confronted with various challenges. The most recent developments in Sharia show that it contests various values and laws, including issues surrounding its position within the legal system of a nation state. This chapter aims to present the position of Sharia in Muslim countries; starting from a global picture and ending at the latest developments in Minangkabau, West Sumatra. To this end, the chapter begins with a brief discussion regarding the concept of Sharia. Subsequently, it presents the position of Sharia in a number of Muslims countries, which, in turn, will illustrate its position within the Indonesian legal system. This will also outline elements of Sharia that have been legalized and incorporated into the national law. Crucially, this chapter also discusses the situation since the government implemented a policy of decentralization and regional autonomy in 2000 that has resulted in the legislation of Sharia for provincial and regional/municipal laws. It also discusses the validity of provincial or regional /municipal law and the extent to which central government still has the authority to control these laws if they are in contradiction with the constitution or other, higher ranking laws.
