This gave a statutory deadline for responding of 5 August 2019 under the terms of the Freedom of Information (Scotland) Act 2002. In your request, you specifically asked for; Subject: [EXTERNAL] Freedom of Information request - Security Trustee Dear Serco Ltd, We will be grateful if you would confirm the following: 1. The Name and contact details of your Data Controller. 2. Who is your Security Trustee. 3. Who are the beneficiaries of the accounts you hold. Yours faithfully, George Tsigarides As Serco Ltd operate HMP Kilmarnock under contract to a Scottish public authority, information you requested shall be considered in relation to HMP Kilmarnock as a service whose provision is a function of that authority. After a search of our records I can confirm that Serco Ltd holds some of the information within the scope of your request. Serco Ltd operates HMP Kilmarnock under contract with the Scottish Prison Service. Accordingly, in relation to point 1, the Data Controller for prisoner and visitor information is the Scottish Prison Service, Calton House, 5 Redheughs Rigg, Edinburgh, EH12 9HW. The Data Controller for employee information is Serco Ltd. In relation to point 2, Serco Ltd do not use a Security Trustee in relation to HMP Kilmarnock. Serco Ltd therefore give notice, under the provisions of Section 17 of the Freedom of Information (Scotland) Act 2002 that we do not hold the information you requested. Serco Ltd therefore give notice, under the provisions of Section 17 of the Freedom of Information (Scotland) Act 2002 that we do not hold the information you requested. If you are dissatisfied with this response, you have the right to request an internal review. Your request should be made within 40 working days of the date of receipt of this letter, and we will reply within 20 working days of receiving your request. Under section 20(3)(c)(ii) of the Act your request should outline your reason for seeking a review. If you remain dissatisfied following an internal review, you then have the right to make a formal complaint to the Scottish Information Commissioner.
