We are so proud of their accomplishments and know that they will continue to represent the Lott Institute in their future endeavors! “Studying abroad for a semester in Melbourne, Australia was one of the most rewarding things I’ve done at Ole Miss. I was nervous about being so far from home but I grew as a person and was able to experience so much. I joined a sports club, traveled all over Australia and New Zealand, and made life long friends. I took some of the most interesting classes involving Australian foreign policy and Australian culture. Overall, my experience abroad challenged me and broadened my perspective of the world.” -- Mason Myers (‘20) “I spent a month in Salerno learning all about the rich culture and history of southern Italy. I took Italian classes and conversed exclusively in Italian with my host family. I walked on the lungomare, or seafront, on the way to class each morning and spent my afternoons at the beach or shopping. The Origins (and Fragility) of Judicial Independence Tara Leigh Grove* The federal judiciary today takes certain things for granted. Political actors will not attempt to remove Article II judges outside the impeachment process; they will not obstruct federal court orders; and they will not tinker with the Supreme Court's size in order to pack it with like-minded Justices. And yet a closer look reveals that these "self- evident truths" of judicial independence are neither self-evident nor necessary implications of our constitutional text, structure, and history. This Article demonstrates that many government officials once viewed these court-curbing measures as not only constitutionally permissible but also desirable (and politically viable) methods of "checking" the judiciary. The Article tells the story of how political actors came to treat each measure as "out of bounds" and thus built what the Article calls "conventions of judicial independence." But implicit in this story is a cautionary tale about the fragility of judicial independence. -

I examined historical changes in the administrative powers of the Surgeon General, to explain what factors affect how a Surgeon General utilizes the office’s “bully pulpit,” and assess changes in the political environment and in who oversees the Surgeon General that may affect the Surgeon General’s future ability to influence public opinion and health. This research involved collecting and analyzing the opinions of journalists and key informants such as current and former government health officials. George I. Sanchez and the Civil Rights Movement: 1940-1960 Ricardo Romo* This article is a tribute to Dr. George I. Sanchez and examines the important contributions he made in establishing the American Council of Spanish-Speaking People (ACSSP) in 1951. The ACSSP funded dozens of civil rights cases in the Southwest during the early 1950's and repre- sented the first large-scale effort by Mexican Americans to establish a national civil rights organization. As such, ACSSP was a precursor of the Mexican American Legal Defense and Educational Fund (MALDEF) and other organizations concerned with protecting the legal rights of Mexican Americans in the Southwest. The period covered here extends from 1940 to 1960, two crucial decades when Mexican Ameri- cans made a concerted effort to challenge segregation in public schools, discrimination in housing and employment, and the denial of equal ac- cess to public places such as theaters, restaurants, and barber shops. Although Mexican Americans are still confronted today by de facto seg- regation and job discrimination, it is of historical and legal interest that Mexican American legal victories, in areas such as school desegregation, predated by many years the 1954 Supreme Court decision in Brown v. Board of Education and the civil rights movement of the 1960's. Sanchez' pioneering leadership and the activities of ACSSP merit exami- nation if we are to fully comprehend the historical struggle of the Mexi- can American civil rights movement. In a recent article, Karen O'Conner and Lee Epstein traced the ori- gins of MALDEF to the 1960's civil rights era.' The authors argued that "Chicanos early on recongized their inability to seek rights through traditional political avenues and thus sporadically resorted to litigation .. -

ABSTRACT CHAMBERS, CHERYL. Institutional Racism: Is Law Used as a Tool to Perpetuate Racial Inequality? (Under the direction of Richard Della Fave.) Law is a mechanism we use to instigate social change and bring about equality. It is also the tool that has been used to institutionalize, legitimize and perpetuate inequality. In the past beliefs of racial inferiority and savagery may have resulted in legislation designed to perpetuate a group’s subordinate status. Laws and public policy are created within an historical and political context. Is there a connection between social climate and the advent of federal drug legislation? In this research, conflict and racial inequality perspectives are applied to the role of the economy and politics to foster understanding of opium laws in the late 1800’s and early 1900’s, the Marihuana Tax Act of 1937, and the Anti-Drug Abuse Act of 1986 and the contexts from which they emerged. It is hypothesized that an historical analysis of the Congressional discussions surrounding these drug laws will illustrate that competition and threat, economic and/or political, were present prior to the enactment of the laws. Analyses indicate that while economic and to a limited extent political competition between Chinese immigrants and white Americans affected the passage of the opium laws, economic and political competition had little effect on the passage of the Marihuana Tax Act or the Anti-Drug Abuse Act. While vilification of and anti-minority sentiment during the opium legislation was clear and recognizable, it was almost non-existent during the marijuana legislation, and present in only nuances in the 1980’s.
