Was the current head of government or other chief national authority elected through free and fair elections? 4 / 4 Germany’s head of state is a largely ceremonial president, chosen by the Federal Convention, a body formed jointly by the Bundestag (Federal Parliament) and state representatives. The president can serve up to two five-year terms. Former foreign minister Frank-Walter Steinmeier of the SPD was elected president in early 2017. The federal chancellor—the head of government—is elected by the Bundestag and usually serves for the duration of a legislative session. The chancellor’s term can be cut short only if the Bundestag chooses a replacement in a so-called constructive vote of no confidence. Angela Merkel won a fourth term as chancellor following 2017 Bundestag elections, which were held in accordance with democratic standards. After 18 years as the head of the CDU, Merkel announced in October that she would step down as chairperson at year’s end, and that she would not seek another term as chancellor in the 2021 elections. A2. Were the current national legislative representatives elected through free and fair elections? 4 / 4 The German constitution provides for a lower house of parliament, the Bundestag, as well as an upper house, the Bundesrat (Federal Council), which represents the country’s 16 federal states. The Bundestag is elected at least every four years through a mixture of proportional representation and single-member districts, which can lead the number of seats to vary from the minimum of 598. -

It is not hyperbole to call the current round of that relationship a crisis--the most serious constitutional crisis since President Franklin D. Roosevelt tried to pack the Supreme Court in 1937. Roosevelt's court-packing initiative was highly visible and the reaction to it violent and widespread. It came to an abrupt and dramatic end, some said as the result of Divine intervention, when Senator Joseph T. Robinson, the Senate Majority leader, dropped dead on the floor of the Senate while defending the President's bill. -

ARTICLES BEYOND ACCOUNTABILITY: ARBITRARINESS AND LEGITIMACY IN THE ADMINISTRATIVE STATE LISA SCHULTZ BRESSMAN* This Article argues that efforts to square the administrative state with the constitu- tional structure have become too fixated on the concern for political accountability. As a result, those efforts have overlooked an important obstacle to agency legiti- macy: the concern for administrative arbitrariness. Such thinking is evident in the prevailing model of the administrative state, which seeks to legitimate agencies by placing their policy decisions firmly under the control of the one elected official responsive to the entire nation-the President. This Article contends that the "pres- idential control" model cannot legitimate agencies because the model rests on a mistaken assumption about the sufficiency of political accountability for that pur- pose. The assumption resonates with the premise, familiar in constitutional theory, that majoritarianism is the hallmark of legitimate government. -

(CC BY-NC-ND 3.0) Ed -I DOI: 10.2478/pof-2018-0013 VOLUME 10, ISSUE 2, 2018 Abstract This special issue publishes a number of conference papers presented at the conference ‘Representing Regions, Challenging Bicameralism’ that took place on 22 and 23 March 2018 at the University of Innsbruck, Austria. In this issue, the developments of European bicameral parliaments in (quasi-)federal states are dealt with as well as the political impact of shared rule and alternative models to second chambers. Several papers compare the organizational and functional design of territorial second chambers. Finally, closer examination is given to the EU’s Committee of Regions and the second chambers in Austria, Belgium, Germany, Spain, Switzerland and the UK.
