Titre : Les aspects criminologiques et pénaux des délits culturellement motivés Résumé : Le problème de ma recherche se pose ainsi : comment le droit pénal et la politique criminelle dans les sociétés multiculturelles et démocratiques doivent-ils réagir face aux délits culturellement motivés, commis par les immigrés -ou de leurs descendants? La dissertation analyse des réponses de la justice pénale des pays occidentaux déterminés face aux trois tipes soi-disant pratiques culturelles néfastes aux femmes qui constituent les exemples des conflits des cultures. Tout d’abord j’analyse comment les pays européens ont réagi aux suivantes pratiques controverses : la violence liée a l’honneur, les mutilations sexuelles féminines et mariages forcés. Ensuite, je présente le concept de la défense par la culture, caractéristique pour le système common law . C’est une stratégie de la défense pour les accusés des délits culturellement motivés. Enfin, j’étudie les contextes et réponses différentes aux délits culturellement motivés en l’Europe et aux Etats Unis et aussi la dimension internationale du problème. Je finalise ma dissertation avec une conclusion que le système de droit pénal et la justice dans les pays démocratiques libéraux et multiculturels doivent être un garant de la validité de consensus de la protection égale et non-discriminatoire des valeurs fondamentales pour tous les membres de la société sans égard a leur genre ou l’ethnicité. Mots clés : multiculturalisme, la violence a l’égard des femmes, les pratiques culturelles néfastes aux femmes, la défense par la culture Title : Criminological issues of culturally motivated crimes Abstract : The main research problem is how penal law and criminal policy in multicultural and liberal states should react on culturally motivated crimes committed by immigrants. The dissertation analyses the criminal justice responses of certain western countries to three types of so-called harmful traditional practices, which are fine examples of conflict of cultures. Firstly, I analyse how European countries addressed following harmful traditional practices: ‘honour’-related violence, female genital mutilation and forced marriages. Secondly, I present the concept of cultural defence, generic for common law, which is a strategy of defence for offenders for culturally motivated crimes. Thirdly, I study the different contexts and responses to culturally motivated crimes in Europe and United States, so the international dimension of the problem. Finally, I culminate my dissertation with the conclusion that criminal law and criminal justice in democratic liberal and multicultural states should be a guarantor of the validity of consensus for equal and non- discriminatory protection of basic values for all members of society regardless their ethnic origin or gender. To co w jednym spo łecze ństwie uchodzi na normalne, w innym niekoniecznie jest akceptowane, a nawet mo że spotyka ć si ę z pot ępieniem spo łecznym. Warto ści spo łeczne tworz ą normy i standardy post ępowania, których granice znajduj ą odzwierciedlenie nie tylko w normach prawa karnego, ale w równym stopniu w praktyce organów ścigania i wymiaru sprawiedliwo ści. Zdarza si ę jednak, że w obr ębie jednego spo łecze ństwa i systemu prawnego nast ępuje starcie pomi ędzy ró żnymi, cz ęsto nie do pogodzenia ze sob ą, tradycjami i normami kulturowymi poszczególnych grup.

Nevertheless the concept of honour has become a powerful expression through which certain ‘culturalised’ forms of violence have been differentiated from ‘mainstream’ forms of violence against women.     Honor Killing in Legal, Cultural and Human Rights Perspective Zenny Rezania Dewantari President University Fulltime Lecturer [email protected] Abstrak This paper is talking about honor killing, a form of murder in which the act itself is considered as a necessity. This term is common used to picture a murder of a woman conducted by a man in a patriarchal community, as a retaliation of what she did that‟s brought shame to a family. In a broader term, honor killing means a necessary murder by a family member to a victim who is believed to have brought shame to a family. Motives behind honor killing are what make this killing unique. The motives are commonly to restore the equilibrium after the damage brought by the victim to the family. There are no certain criteria of what damaging behavior is. Victims were usually women with some cases were involving men as a victim. Right of life is stated in Universal Declaration of Human Rights. Many human rights conventions also state a protection of women‟s human rights. So in a human rights perspective, honor killing is against human rights especially right of life and specifically for women, it is against rights of a woman. Naturally, human rights are universal. Problem occurs when this universality meets local cultures, beliefs, and traditions. Honor killing is sometimes allowed in those certain groups. So it is a challenge of human rights enforcement to get inside the cultures and beliefs of some state‟s ideology that might be different with UDHR statements, including honor killing phenomenon.

    Escaping discourse: a critical analysis of fleeing a forced marriage as a journey of personal transformation Amanda Muhleisen BBus (Hons), Swinburne University of Technology A thesis submitted in fulfilment of the requirements for the degree of Doctor of Philosophy Faculty of Business and Law Swinburne University of Technology 2017 Abstract The purpose of this thesis is to analyse the concept of ‘escaping discourse’ in the sense of attempting to understand how individual agents who are born and socialised into a strict discourse are capable of escaping from that discourse and doing something different. The thesis takes as its data source the case of Jasvinder Sanghera as depicted in her memoir Shame (2007) that chronicles her escape from a forced marriage and the consequences she experienced thereafter. Sanghera was socialised into a discourse that promulgated adherence to the concepts of family honour, amongst which the practice of forced marriage was normalised. Her transformational journey of physical flight from the family home in order to avoid a forced marriage and her later establishment of the charity Karma Nirvana, are described in detail in her memoir. The thesis takes a qualitative approach towards addressing the research purpose. Critical discourse analysis, specifically sociocognitive analysis, is employed as the methodology of critical inquiry, whilst grounded theory is used to code and analyse the data. The mechanism of escape that comprises the findings of the thesis is depicted as a three- stage model within the central concept of ‘subjugation – the cultural role of females’. These three stages comprise ‘cloistering strategies’, ‘drifting back to the family fold’, and ‘disownment mitigation strategies’.

    The Globalization Bulletin Women January 2017 NEWS COVERAGE PERIOD FROM JANUARY 23RD TO JANUARY 29TH 2017 ‘WOMAN IS EITHER DISCUSSED FROM PERSPECTIVE OF VICTIMHOOD OR IS OVER GLAMORISED’ Dawn January 23rd, 2017 Mohammad Hussain Khan HYDERABAD: Speakers at the second edition of Lahooti Mello that concluded at Hyderabad Club on Sunday discussed gender issues and revival of Pakistani films and remarked that woman was either talked about from the perspective of victimhood or was over glamorised. “Eve’s power play” was one of the important sessions moderated by Sahar Gul with panellists Senator Sassui Palijo, university teacher Arfana Mallah, architect Marvi Mazhar. On Saturday the Mello was inaugurated by Sindh Minister for Culture Syed Sardar Ali Shah and US Consul General Grace W. Shelton. US Consulate Karachi was also partner in the event. Marvi Mazhar said: “Since I belong to a political family and party like PPP I didn’t face any hurdle but still there are barriers for women. Such support is not usually available for an average woman who will have to assert herself”. To a question from audience, she said that a woman was most likely not to lie. “It is perhaps because of a woman’s upbringing that her score on honesty’s count is better,” she remarked. Her co-panellist Arfana Mallah disagreed, saying “it is in fact society’s checks and balances over a woman that she can’t afford being dishonest”. Moderator agreed with a questioner, Wusatullah Khan, that it was a process and struggle that mattered and there were many heroes like Fatima Jinnah who stood against a dictator and Nusrat Bhutto who fought for democracy and remained unsung in history.
