Compulsory Purchase Order 2020 The Cornwall Council (St Austell to A30 Link Road) Compulsory Purchase Order 2020 THE HIGHWAYS ACT 1980 And THE ACQUISITION OF LAND ACT 1981 24142/149/26790247_3 10F5 The Cornwall Council (St Austell to A30 Link Road) Compulsory Purchase Order 2020 THE HIGHWAYS ACT 1980 AND THE ACQUISITION OF LAND ACT 1981 The Cornwall Council (in this Order called "the acquiring authority") hereby makes the following Order: 1. Subject to the provisions of this Order, the acquiring authority is under sections 239, 240, 246, 249, 250 and 260 of the Highways Act 1980, hereby authorised to purchase compulsorily land and new rights over land for the purposes of: (1) The construction and improvement of a highway which will provide a link between the Singlerose Roundabout at the junction between the A391 and B327 4 at Stenalees generally northwards for a distance of 6,740m to tie in with the old A30 (C0120) north of Roche in the Parishes of Treverbyn, Roche and Withiel in the County of Cornwall. (2) The construction of new highways to connect the above mentioned highway with the existing road system in the Parishes of Treverbyn, Roche and Withiel in the County of Cornwall. (3) The construction of ancillary highways and improvement of the following existing highways in the vicinity of the route of the above mentioned highway in pursuance of the Cornwall Council (St Austell to A30 Link Road) (Classified Road) (Side Roads) Order 2020. (4) The provision of new means of access to premises in pursuance of the Cornwall Council (St Austell to A30 Link Road) (Classified Road) (Side Roads) Order 2020. (5) The diversion of watercourses and the carrying out of other works on watercourses in connection with the construction and improvement of highways and the provision of new means of access to premises as aforesaid. (6) The diversion and extinguishment of existing drainage and the carrying out of other drainage works in connection with the construction of highways, including the construction of attenuation ponds, and the provision of new means of access to those attenuation ponds. (7) Use by the acquiring authority in connection with the construction and improvement of highways, the diversion of watercourses and drainage and the provision of new means of access to premises as aforesaid. 24142/149/26790247_3 2 OF 5 (8)e The improvement or development of frontages to the above mentioned new ande existing highways or of the land adjoining or adjacent thereto.e (9)e Mitigating the adverse effect which the existence or use of certain of the highwayse proposed to be constructed or improved will have on the surroundings thereof.e (10)e Giving in exchange for the land and new rights referred to in this paragraph thee land described in Schedule 2.e 2.e The land authorised to be purchased compulsorily under this order is the land which ise described in the Schedule 1 hereto and delineated and shown coloured pink on the mape hereinafter mentioned and the rights which are specified in the said Schedule 1 over thee land which is described therein and is delineated and shown coloured blue on the saide map. The land referred to in sub-paragraph (10) above the land described in Schedule 2e is shown delineated and coloured green on the said map.e 3.e The map aforesaid is a map consisting of six (6) sheets numbered 01 to 06 respectively,e prepared in duplicate, sealed with the Common Seal of the acquiring authority and markede "Map referred to in The Cornwall Council (St Austell to A30 Link Road) Compulsorye Purchase Order 2020". (1) In this paragraph "the order land" means the land described in Schedule 1 and "the exchange land" means the land described in Schedule 2. (2) As from the latest of the dates mentioned in sub-paragraph (3) of this paragraph, the exchange land shall vest in the persons in whom the order land was vested immediately before it was vested in the acquiring authority, subject to the like rights, trusts and incidents as attached to the order land; and the order land shall thereupon be discharged from all rights, trusts and incidents to which it was previously subject.     Appendix A - Responsibilities for Flood Risk Management The Department for the Environment, Food and Rural Affairs (Defra) has overall responsibility for flood risk management in England. Their aim is to reduce flood risk by: • discouraging inappropriate development in areas at risk of flooding. • encouraging adequate and cost effective flood warning systems. • encouraging adequate technically, environmentally and economically sound and sustainable flood defence measures. The Government’s Foresight Programme has recently produced a report called Future Flooding, which warns that the risk of flooding will increase between 2 and 20 times over the next 75 years. The report produced by the Office of Science and Technology has a long-term vision for the future (2030 – 2100), helping to make sure that effective strategies are developed now. Sir David King, the Chief Scientific Advisor to the Government concluded: “continuing with existing policies is not an option – in virtually every scenario considered (for climate change), the risks grow to unacceptable levels. Secondly, the risk needs to be tackled across a broad front. However, this is unlikely to be sufficient in itself. Hard choices need to be taken – we must either invest in more sustainable approaches to flood and coastal management or learn to live with increasing flooding”. In response to this, Defra is leading the development of a new strategy for flood and coastal erosion for the next 20 years. This programme, called “Making Space for Water” will help define and set the agenda for the Government’s future strategic approach to flood risk. Within this strategy there will be an overall approach to the assessing options through a strong and continuing commitment to CFMPs and SMPs within a broader planning framework which will include River Basin Management Plans prepared under the Water Framework Directive and Integrated Coastal Zone Management.
