Establishing Fruit and Vegetable (FAV)/Wild Rice (WR) and Double-Cropping Regions Approved by: Deputy Administrator, Farm Programs

1 Overview

A Background

Section 1114(e)(1) of the (2014 Farm Bill) as amended by the Agriculture Improvement Act of 2018 (2018 Farm Bill) permits the planting of fruits and vegetables, other than mung beans and pulse crops, or wild rice (FAV/WR), on payment acres enrolled in the ARC and PLC Program. However, if FAV/WR is planted on payment acres, an acre-for-acre reduction will apply unless the FAV/WR is destroyed without benefit before harvest.

Note: Payment acres are equal to 65 percent of base acres for a farm elected and enrolled in ARC-IC, and 85 percent of base acres for a farm elected and enrolled in ARC-CO or PLC. Payment acres do not include unassigned generic base acres.

Exception: An acre-for-acre payment reduction will not apply in regions where double-cropping covered commodities with FAV’s or WR is approved and the specific double-crop combination is approved by STC according to 2-CP.

In 2014, STC’s designated FAV/WR double-cropping regions for those locations where the plantings of FAV/WR and covered commodities met the definition of double-cropping.

A review of the previously approved double-cropping regions is required to determine if these regions still meet the double-cropping standards, and to determine if additional regions meet the standard to be included as a double-cropping region.

B Purpose

This notice provides:

 definitions to be used in designating FAV/WR double-cropping regions  instructions to STC’s for designating FAV/WR double-cropping regions  the deadline for submitting the designation requests to DAFP for FR publication.

2 Definitions for Designating FAV/WR Double-Cropping Regions

A Definitions

The following definitions will be used by STC’s when designating FAV/WR double-cropping regions:

 covered commodity means wheat, oats, and barley (including wheat, oats, and barley used for haying and grazing), corn, grain sorghum, long grain rice, medium grain rice, seed cotton, pulse crops, soybeans, other oilseeds, and peanuts

 double-cropping FAV/WR with covered commodities means planting and harvesting of a covered commodity in cycle with the planting and harvesting of FAV or WR on the same acreage in a 12-month period with the ability to plant and harvest the same 2 crops in the immediately succeeding 12-month period, under normal growing conditions.

Note: FAV/WR may be planted either before or after the planting of the covered commodity to be considered double-cropped.

A designated FAV or WR double-cropping region must:

 be an entire county  follow county borders  be determined on a county-by-county basis  not be for an area greater than an entire county.

A portion of a county cannot be designated as a double-cropping region. Although each county in a State may be a region, an entire State cannot be designated as a region. All designated FAV/WR double-cropping regions will be published in FR; after STC-designated FAV/WR double-cropping regions are published in FR, no additional regions shall be designated

Note: The importance of correctly designating FAV/WR double-cropping regions cannot be overemphasized. Designation of a county as an FAV/WR double-cropping region will impact payment program compliance for producers in the county.

3 State Office Action

A Action Required

STC’s shall designate FAV/WR double-cropping regions according to the following table.

Step Action 1 STC’s will determine whether it is customary to plant FAV/WR in a double-cropping sequence with a covered commodity in consultation with NIFA, land grant universities, and other agencies or organizations.

STC’s will make the determination on a county-by-county basis using the definitions in paragraph 2.

Counties that are already designated as FAV/WR double-cropping regions do not need to be addressed unless STC’s decide to request to remove those counties as FAV/WR double-cropping regions. See Exhibit 1.

Important: Determinations will be based on the planting history for the county before the 2019 crop year. 2 STC’s will designate the counties as FAV/WR double-cropping regions by:

 documenting the designated counties, and the sources used to designate the counties, in STC minutes

 submitting the list of additional counties designated as FAV/WR double-cropping regions by STC to DAFP no later than May 1, 2019.

Notes: Negative reports are required.
