7. Proposed Works to Town Bridge (Pages 11 - 14) Proposed works for the installation of additional kerbing and pedestrian railings will start in January 2020. Wiltshire Council are seeking the Town Council’s View on the following traffic management proposals:

 Full Road Closure, except for pedestrians and cyclists (5 weeks duration)  Temporary One Way Traffic Order (Direction of Traffic to be agreed) (10 weeks duration)  Temporary Two Way Traffic Lights (10 week duration)

8. Wiltshire Council: Notice of Variation of Charges for Off Street Parking (Pages 15 - 16) To note changes for residents permits for off street parking.

9. Planning Local (Pages 17 - 18) To note information contained within the October Issue of Planning Local.

10. Temporary Road Closure - Xmas Fayre (Pages 19 - 26) To note a road closure has been submitted to Wiltshire Council regarding the Xmas Fayre/Lights Switch on for Saturday, 7 December.

11. Temporary Road Closure - Lower Woodrow and Forest Road (Pages 27 - 30) To note a Temporary Road Closure has been approved for Lower Woodrow (part) and Forest Road, which will come into operation on 12 December until 13 December from 09:00hrs-15:30hrs to allow Openreach to carry out cabling work.

12. Waiting and Parking Requests (Pages 31 - 36) To consider any waiting and parking restriction requests to submit to Wiltshire Council prior to the 31 January 2020 deadline.

13. CATG/Highway Matters

13.1 Minutes of Meeting held on Thursday, 17 October 2019 (Pages 37 - 54) To note minutes and comments raised with regard to the following:

9-12-2: Snarlton Lane – Highways requested to produce an estimate for a children warning sign and coloured high friction surface. The Town Council to considered a percentage contribute towards this scheme.

6-19-4: Bath Road/Union Street. It is estimated 4-5 bollards for this purpose would cost £1,500. The Town Council were asked to consider the provision of planters as an alternative.

13.2 Temporary Speed Indicator Devices (Pages 55 - 60) To note criteria changes for site eligibility and deployment of speed indicator devices.

13.3 Installation of Bollards Church Street (Pages 61 - 62) To consider a request from a resident for the installation of bollards in Church Street in order to deter delivery drivers parking outside their property.

13.4 Lowbourne - Request for Speeding Restrictions (Pages 63 - 64) To consider a request from a local resident that speed restrictions are introduced on Lowbourne in order to slow traffic down.

The minutes of the meeting held on 30 September 2019, having previously been circulated were approved and signed as a correct record by the Chair, Councillor Westbrook.

The Town Council had no objection to the following planning applications:

37.1/19 Steering Group Minutes

The Neighbourhood Plan Steering Group minutes of 25 September 2019 were noted.

37.2/19 A350 By-Pass

Councillor Watts explained at the Steering Group would write to Wiltshire Council to advise them their preferred option was route C. It was suggested that the Town Council and Parish Council do the same.

Support was requested from Members to write to Wiltshire Council and the Western Gateway Sub National Transport Body objecting to route A and B but supporting option C, being the only actual by-pass route proposed.

It was proposed by Councillor Watts seconded by Councillor Hubbard, and

UNANIMOUSLY RESOLVED, it is the Town Council’s policy, as long as sufficient mitigation is provided to the communities, environment and wildlife in/close to any route, that the Town Council supports a full by-pass as indicated by route C outlined in the business case submitted to the Department of Transport in July 2019 and to write to Wiltshire Council and the Western Gateway Sub National Transport Body accordingly.

37.3/19 Expenditure to Date

To note expenditure to date on the Neighbourhood Plan.

38/19 Trees

38.1/19 Melksham House & St Michael's Church

Councillor Iles as Chair of Melksham in Bloom had asked if the trees within the grounds of Melksham House could have Tree Preservations placed on them due to their historic and environmental value. Both Melksham Town Council ‘s Tree Wardens supported the request for TPOs on the existing and remaining trees at Melksham House grounds. The Tree Wardens had also requested that the ancient healthy yew trees in St Michael and All Angels Church grounds were also considered for TPOs.

Councillor Watts noted that the grounds of Melksham House were currently the subject of a planning application, therefore TPOs could not be applied for at present and suggested the Town Clerk speak informally to Wiltshire Council officers to see what could be done to protect trees on this site.

The Town Clerk suggested the Environment Working Group could undertake a town wide tree survey, drawing up a list of those which warranted TPOs being placed on them. Members supported this suggestion.

38.2/19 Tree Planting Budget

Councillor Watts explained the Environment Working Group were looking at lots of issues including additional tree planting and at the same time seeking permission from Highways and other landowners. He requested that Members consider recommending to the Asset Management Committee the £4000 monies in earmarked reserves (green spaces) budget be allocated towards tree planting.

A concern was raised that various projects had recently been approved, against varying budgets, therefore a word of caution was expressed that some of the monies above may have already been allocated elsewhere.

It was proposed by Councillor Hubbard, seconded by Councillor Watts, and

RESOLVED, subject to confirmation from the Town Clerk that £4000 was available from the green spaces budget in earmarked reserves, that a recommendation be made to the Asset Management Committee, that any remaining monies in this budget be allocated towards tree planting.

It was suggested that an extra ordinary meeting of the Asset Management Committee take place on Monday, 4 November 2019 to discuss the recommendation.

38.3/19 Tree Preservation Order - Crown House

Members noted that to safeguard the visual amenity and character of the area Wiltshire Council had applied for a Tree Preservation Order for a walnut tree located to the rear of Crown House.

Page 4 4 39/19 Melksham Campus

Councillor Watts had asked that this item be placed on the agenda stating whilst the Town Council had not objected to the campus project planning application on 30 September, there were aspects of the project which were a cause for concern, including the felling of two trees and the relocation of one listed gate post.

Councillor Watts explained whilst it was proposed to fell two trees, one was in a poor state and needed felling, however, the other a Lawson Cypress still had some life left and wished to see it retained.

Councillor Watts also expressed concern at the relocating of one pillar adjacent to a fire door of the Assembly Hall, as well as the impact this pillar could have, being so close to the Assembly Hall on any future plans for the building.

It was proposed by Councillor Watts, seconded by Councillor Westbrook, and

RESOLVED, that the Town Clerk be tasked with arranging an informal meeting, which Members should be invited to, with the Wiltshire Council Campus Project Team to discuss retaining the Lawson Cypress tree and alternative arrangements for relocation of the gateposts.

40/19 CATG Requests

40.1/19 Dropped Kerbs - Old Broughton Road

It was proposed by Councillor Hubbard, seconded by Councillor Westbrook, and

RESOLVED, to recommend to the Community Area Transport Group that two dropped kerbs be installed either side of ‘The City’ junction with Old Broughton Road, stating the Town Council would be prepared to contribute up to 50% of the costs, if necessary in order to get the work done.

This newsletter focuses on two recent Government releases: National Planning Guidance and the Environment Bill.

New: National Design Guide

The revised NPPF places great emphasis on encouraging planning to secure high quality design. This is highlighted in NPPF 125 which states that design policies should be developed with local communities and should reflect local aspirations, grounded in an understanding and evaluation of each area’s defining characteristics. NPPF 130 states that permission "should be refused for development of poor design that fails to take the opportunities available for improving the character and quality of an area and the way it functions", taking into account any local design guides or policies.

For neighbourhood planners, this means that it will be necessary to “define each area’s characteristics” which is usually done in a Character Assessment. There is a Locality toolkit on design that has recently been updated: Locality toolkit. The Oxford toolkit is also excellent: Oxford City Toolkit .

The Government has just updated its own design advice with the new National Design Guide. The Design Guide sets out a framework for defining good design and also for assessing whether proposals are suitable.

The Design Guide provides very useful definitions that would help neighbourhood planners and Parish Councils understand how to describe good and bad design. Design in planning is one of those very heavily jargon-laden disciplines and it helps to be able to use the correct language when writing policies or commenting on applications.

The National Design Guide sets out ten characteristics of well-designed places. It also begins to address how design is related to climate, community and character.

New: Environment Bill

DEFRA published its Environment Bill in October 2019.

Developers will be required to deliver a 10% biodiversity net gain through their developments. A “biodiversity metric” will be produced by Government to calculate the “biodiversity value” of any habitat.

Neighbourhood planners should start to consider how their policies will assist in delivering meaningful net gain by identifying those areas that are most at risk, most in need of improvement or species that should be targeted. The more specific neighbourhood plan policies are, the more likely that focused improvements can be achieved, rather than leaving it to developers to determine how they wish to make their net gain.

Along these lines, local planning authorities will be required to produce “local nature recovery strategies” to identify how provision should be delivered. A sound neighbourhood planning evidence base can either feed into this process or add useful local detail. Since the requirement for supporting nature will become statutory, it may be that eventually, Government will develop more sophisticated data and tools to assist.

There is also reference to “biodiversity credits” that developers can purchase to offset their requirements if they cannot be delivered as part of their scheme. The metrics for the credits are not yet clear, nor how the funds will be charged or spent. However, if your neighbourhood plan has a clear strategy, you will be in a better position to bid for this money if that becomes possible.

All properties in the proposed area will be advised of the closure by letter and advance signage.

2. The Lowbourne junction will be a marshalled gateway with a moveable barrier, allowing vehicles to leave the closure during the duration of the event and only allowing taxis and emergency vehicles to enter the closure area.

3. A sign will be placed at the Lowbourne junction stating “No Access to Church Street Car Park between 16:00-20:00hrs”.

Notice is hereby given that the Wiltshire Council has made an Order to close temporarily to all traffic:

Lower Woodrow (Part), Melksham Without; from its junction with Bridleway MELW55 to its junction with Forest Road;

Forest Road, Melksham Without and Lacock; from its junction with Lower Woodrow to its junction with Bowden Hill.

To enable: Openreach to carry out cabling for new service, access to overhead network.

Alternative route: via Bowden Hill – The Wharf – Hither Way – Melksham Road – Chapel Hill – Cantax Hill – A350 – Semington Road – King Street – A3102 – Forest Road – Woodrow Road – Lower Woodrow (unaffected length) and vice versa.

The closure and diversion route will be clearly indicated by traffic signs.

This Order will come into operation on 12 December 2019 and the closure will be required between the hours of 09:30 and 15:30 until 13 December 2019. It is anticipated that the works will take the stated duration to complete depending upon weather conditions. Access will be maintained for residents and businesses where possible, although delays are likely due to the nature of the works. The Order will have a maximum duration of 18 months.

r) Issue 9-19-11 – Bowerhill New request submitted by Melksham Without Parish Council. Parish Council to discuss PC Portal Road – Request for Bowerhill nameplate and white Siting signs and gates on this approach might prove difficult Area Board to note Jon gates due to the presence of the shared-use footway and needing to maintain head clearance for cyclists of 2.4m. There is some limited highway verge space on the nearside as you enter Portal Way beyond the extent of the footway.

e) Shaw Hill / Corsham Road The traffic signal controller at this junction has failed numerous Area Bord to note. Traffic Signals times in recent months and with parts no longer obtainable the system needs to be replaced. Consequently, this junction has been given high priority for a complete upgrade and work on the ground is provisionally programmed for March / April next year. Full details will be released in due course but the upgrade will include:

• New signal heads and controller. • A pedestrian crossing from Shaw Hill to Bath Road • Kerb re-alignment and surfacing work During the work temporary signals will be deployed and a road closure is also likely to be required.

Both temporary signals and a road closure will be used to accommodate the installation.

WILTSHIRE PRACTICE NOTE

TEMPORARY SPEED INDICATOR DEVICE SITE ELIGIBILITY AND DEPLOYMENT CRITERIA

1.0 Introduction

1.1 Speed Indicator Devices are a means of raising awareness of vehicle speeds and educating driver behaviour. They are useful in supporting other methods of direct speed control such as Police enforcement and Community Speedwatch (CSW) programmes. They can provide a means of highlighting speed issues where direct measures cannot be used, such as where speeding occurs at night or at locations with difficult access.

1.2 SIDs should only be used at the sites meeting the eligibility criteria.

1.3 SIDs should be deployed on a temporary basis and are normally in place at a site for between 2 and 8 weeks.. To maintain their effectiveness they should not be redeployed until a minimum time of 4 weeks has elapsed. SIDs should only be deployed on roads subject to 20, 30 and 40 mph speed limits. Enforcement activities on roads with higher speed limits remains solely within the remit of the Police.

2.0 Eligibility Criteria

2.1 The Council can undertake traffic counts at each requested site in order to measure vehicle speeds and allow assessment against the criteria. The counters will be in situ for a week at each site and will record vehicle speeds and volumes at all times during that week. If the request indicates that speeding is a problem at certain times of the year this will be taken into account. This enables determination of any trends relating to speed at certain times of the day or night. No site will be considered for SID deployment until a traffic count is undertaken.

2.2 The eligibility criteria for the use of SIDs is set out in the table below. The threshold levels have been set to accord with the National Police Chiefs Council (NPCC) speed enforcement guidelines.

2.3 A flow chart illustrating the process is included at Appendix A

3.0 SID Deployment

3.1 SIDs should be deployed on a temporary basis and should be insitu for between 2 and 8 weeks. Research by the Transport Research Laboratory has indicated that the effect of the SID on speed reduction is greatest within the first two weeks of deployment, with sites having SIDs in situ for longer recording little or no further speed reductions after two weeks (‘Effectiveness of Speed Indicator Devices on reducing vehicle speeds in London’, TRL, 2008). Deployment periods between 2 and 8 weeks are at the discretion of the relevant Town or Parish Council based on individual site circumstances but it is recommended that this is evidence led.

3.2 Town & Parish Council’s either singularly or in collaboration are responsible for the sourcing and purchase of suitable SID units.

3.3 The Town and Parish Council’s will be responsible for putting together, monitoring and reviewing a programme for SID deployment.

3.4. Deployment of the SIDs must be undertaken by an approved Contactor. The approved Contractor must have Operators Streetworks accreditation (for more details see https://www.gov.uk/government/publications/street-works-qualifications-in- england ) and Public Liability Insurance of at least £5,000,000. Responsibility for checking and approval of suitable contractors rests with Town & Parish Councils and is therefore self-policing.

3.5 It will be for the Town & Parish Council’s to decide on how many contractors are engaged and how any payment mechanism should work. Deployment by members of the public or other groups is not permitted due to safety and liability considerations.

3.6 Town and Parish Councils are encouraged to review, amend or add to the deployment programme not less than every six months to take into account new sites or to allow sites which may not have been deemed a priority during the initial programme to be incorporated.

Appendix B

Temporary Speed Indicator Devices (SID) Deployment Guidelines

1. These guidelines apply to all SIDs used on the Wiltshire Highway network regardless of the funding source, ownership and device location

2. Sites should meet the eligibility criteria as set out in the Wiltshire practice note.

3. The SID should be in-situ for between 2 and 8 weeks at any eligible site.

4. The SID should not return to monitor an eligible site within 4 weeks of the previous visit.

5. The exact location of the SID within the eligible site can be varied within the site limits at each visit

6. Wiltshire Council reserves the right to remove any device where either the duration of 8 weeks is exceeded, the location is considered a road safety hazard, or if the SID is not being deployed in accordance with the stated guidelines.

7. Any additional infrastructure required to enable SID deployment must be funded by the Area Board / Community Area Transport Group or the relevant Town / Parish Council and approved by Highways officers prior to installation

8. Trigger Speeds of the device should be set to match the Police threshold levels for prosecution and as such should not be altered. In a 20mph limit the trigger speed is 24mph, in a 30mph it is 35mph and in a 40mph it is 46mph.

9. SID’s must be mounted at a minimum height of 2.0 metres above ground level (to avoid damage / vandalism) in verge areas and 2.4 metres in footway and cycle-ways. . Devices must have a minimum edge clearance to the running carriageway of 450mm and cannot be fixed to telegraph poles or concrete street lighting columns. No ladders, step ladders or other climbing aids should be placed in direct contact with or leant against the lighting column or post as the additional weight may result in sudden failure. It will be for the Town & Parish Council’s to ensure that approved contractors are aware of these requirements. Any damage to Highway furniture will be recharged.

10. Additional posts can be provided to facilitate SID deployment. However they must not be permanently left in place when the SID is not deployed. Posts must be fixed via a socketed ground anchor to allow for post removal. 11. Where SIDs are erected on existing street lighting columns, advance notification must be given to Wiltshire Council by sending an email to [email protected] providing the dates of deployment, the road name, and the column identification number.

12. SID’s require a straight road on the approach, free of obstruction, to allow the radar to accurately assess vehicle speed. Dips in the road will affect the operation of the SIDs, as can bus shelters reflecting the sun. Careful consideration is required to direct devices away from property windows and avoid problems associated with light pollution. SID’s must not be positioned close to or at speed limit terminal points. Wiltshire Council Page 58 September 2019

SIDs - Frequently Asked Questions

1. Why can SIDs only be deployed on roads subject to 20, 30 and 40 mph speed limits? Enforcement of speed limits on roads subject to limits over 40mph has to be done by Police Officers who are suitable trained using in car or hand held speed enforcement devices. This is national practise agreed by the National Police Chiefs Council (NPCC) not just applicable to Wiltshire.

2. Why can’t SIDs stay at one location for longer than 8 weeks? Research by the Transport Research Laboratory has indicated that the effect of the SID on speed reduction is greatest within the first two weeks of deployment, with sites having SIDs in situ for longer recording little or no further speed reductions after two weeks. In addition, case studies from Kingston upon Thames, where the use of SIDs is wide ranging, have shown that SIDs effectiveness reduces over time. Deployment periods between 2 and 8 weeks are at the discretion of the relevant Town or Parish Council based on individual site circumstances but it is recommended that this is evidence led.

3. Why does a count have to be carried out before SID deployment takes place? Counts are undertaken to establish if there is speeding taking place, the extent of the speeding problem and to identify the correct solution. Pedestrians and residents routinely overestimate the speed of vehicles passing by and it is vital that factual data is used. This helps to identify those locations which genuinely have a speeding problem and also means that further comparative counts can be undertaken to establish whether the problem has been addressed. 4. Can a SID be used to collect traffic data? The data capture capability that some SIDs have has not been utilised due to concerns over the reliability of the data. The presence of the SID itself may alter driver behaviour and collecting data from it may give a false impression or different set of results that may not be representative. In addition data is only collected in one direction. To enable comparison between before and after speeds, those sites where SIDs are deployed may be subject to further counts as these provide more reliable data.

5. What does the 85th percentile mean and why is it chosen? Doesn’t this mean that speeding is being tolerated? The concept of the 85%ile speed has been developed from the considerable body of research and observation carried out to analyse driver behaviour. It is the highest speed at which most drivers can be considered to be driving sensibly and in a manner appropriate for the prevailing conditions. Those drivers exceeding the 85%ile value are therefore much less likely to conform to reasonable patterns of behaviour and consequently would pay little regard to safety enforcement measures. The 85%ile value can therefore be regarded as a cut off point beyond which safety measures would have no reliable practical or statistical value. The 85%ile speed is defined as that which reasonable people tend to adopt according to the road environment and is calculated by recording the speeds at or below which 85% of all vehicles travel under free flowing conditions past a nominated point. For example if a count records the speeds of 100 vehicles then the top 15 are discounted and the resulting highest speed is then the 85%ile value.

6. Can we have a permanent SID like the ones we see elsewhere in other counties?

National evidence has shown that the effectiveness of permanently installed vehicle activated signs for speed education purposes reduces with time. The use of temporary SID’s is intended to maximise the impact of this type of sign on motorists.

7. Can SID’s be used at sites not meeting the criteria?

The Town & Parish Council’s may, at their discretion, choose to add sites that have been subject to an automatic traffic count but that do not meet the eligibility criteria to the SID deployment list. . It will be for the Town & Parish Council’s to decide if the SID deployment is justifiable in these circumstances. However use of SIDs at sites where there is no speeding problem is not encouraged as this may impact on the availability and frequency of deployment at those sites with a speeding problem and lessen the overall impact that SIDs are intended to have.

To all Councillors

Good afternoon

As you are aware there is an issue with speeding motorists in Melksham and in particular Lowbourne & Sandridge Road. My wife is the coordinator for the local community speed watch (in conjunction with ) in Lowbourne and we operate from Ruskin Avenue and the Rivermead School/Lowbourne Osteopath's area's. We are residents in Lowbourne and are very aware of the speeding vehicles on an hourly basis.

The times that we operate vary from 07.30am until 19.00 and the one common denominating factor is the percentage of motorists who travel in excess of the 30mph limit. We have a criteria that we observe when using the speed device and this is set at 35MPH anything over this is noted and relevant details are passed to Wiltshire Police. On average motorists are travelling at anything between 33 and 36mph in a designated 30mph limit.

We have had cars travelling at 50mph and lorries at 37mph and this at times when children are on the way to school in the mornings so I ask why is it not possible to put speed cushions down in Lowbourne to slow vehicles and make it a safer place ? Alternatively, and a cheaper option, the simple painting of 30MPH on the tarmac surface to remind drivers of their legal obligation to travel within the designated speed limit? I see this has been done in Ruskin Avenue so would like to think that this could be applied in Lowbourne & Sandridge Road.

I look forward to comment and trust this issue will be brought up in council at one of your appropriate meetings.
