REGULAR HEADING The Regular Stated Meeting of the Common Council held Monday, April 3, 2017, at seven thirty o'clock in the evening in the Common Council Chamber in the Municipal Building. Mayor Roach presiding and the following members present: Mrs. Hunt-Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin and Mrs. Smayda. Council President Kirkpatrick stated that some time ago Mercedes Benz was a client, and although he has no contact out of an abundance of caution he wished to recuse himself from voting on Items 39 and 40 to avoid even an appearance of conflict. Council President Kirkpatrick asked unanimous consent to substitute Items 38s, 48s and 49s for Items 38, 48 and 49 respectively to correct typographical errors, and offered the consent agenda of Items 1a, 15 - 4 7, and 50, asking unanimous consent to move adoption of the ordinances, moved adoption of the ordinances, moved adoption of the resolutions, moved to file and spread all communications and refer those that are necessary to appropriate City Departments, Boards and Commissions, and file any attachments. Mr. Martin seconded the motion. Adopted by the following role call vote: Mrs. Hunt-Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, Mrs. Smayda and the Mayor - 7 - 0. Seconded the motion. Communication received from Council President. Mr. Martin moved that it/they be filed and spread in full upon the minutes, and approved. Mrs. Smayda seconded the motion. Carried. Mr. Martin moved that the hearing be opened. Mrs. Smayda seconded the motion. Carried. The Mayor declared the hearing opened and asked if anyone wished to be heard. The Mayor granted the privilege of the floor to Janet Geris, attorney for the applicant, and Gary Warshauer, architect. Mr. Martin moved that the hearing be closed. Mrs. Lecuona seconded the motion. Carried. Communications received from Commissioner of Building, Design Review Board, Commissioner of Planning , Planning Board (2), Commissioner of Public Safety, Commissioner of Public Works, Deputy Commissioner, Traffic Division, Transportation Commission, Commissioner of Parking, Westchester County Planning Board, and Environmental Officer. The petition was submitted by DelBello, Donnellan, Weingarten, Wise & Wiederkehr, LLP on behalf of the applicant, Mt Hope A.M.E. Zion Church. The applicant owns the property at 65 Lake Street. The property is located in a B-3 Zoning District (Intermediate Business) and is designated on the City of White Plains Tax Map as Section 126.45, Block 6, Lot 2. ZION CHURCH (PETITIONER) A PETITION FOR AMENDMENT TO THE CITY OF WHITE PLAINS ZONING ORDINANCE REGARDING THE B-3 INTERMEDIATE BUSINESS ZONING DISTRICT On January 27, 2017, a petition on behalf of Mount Hope A.M.E. Zion Church (the "Petitioner" or "Church"), was submitted to the City of White Plains to amend the Zoning Ordinance in order to permit the development of a property located at 65 Lake Street. The property is located in the B-3 (Intermediate Business) Zoning District and consists of approximately 52,500 square feet of lot area. The property is currently improved with an approximately 21, 711 square foot, four-story building containing the Church sanctuary and ancillary facilities, and approximately 44 surface parking spaces. In 2008, Petitioner formed the Mount Hope Community Development Corporation (CDC) for the purposes of creating senior affordable housing to serve the needs of the community. Subject to approval of the proposed zoning petition and subsequent subdivision and site plan approval, the Church and the CDC propose to: • Construct a 4,352 square foot addition to the existing building, which will contain a new lobby on the ground floor, and will add additional space on the other floors for administrative/office use, and the Church's nursery school. With this addition, the total gross floor area of the Church will be approximately 26,063 feet. THE BIRTHPLACE OF ORK-~ • Construct a new six-story, approximately 78,132 square foot apartment building with a total of 56 residential units. Approximately 59,511 square feet of the building will be for the residential units and 18,621 square feet will be devoted to parking. Fifty-two (52) units (48 one-bedroom units and four two-bedroom units) will be affordable senior citizen residences qualifying at 60% of Area Median Income. The remaining four two bedroom units will unrestricted affordable. A total of 74 parking spaces will be provided - 27 for the residences and 47 for the church. These spaces will be located on the ground and second floor of the new building. The proposed project complies with the current use, lot, and bulk requirements for the B-3 Zoning District except as follows, pursuant to Section 5.3: Schedule of Dimensional Regulations, Non residential: • The "minimum lot area per dwelling unit" in the B-3 Zoning District is 800 square feet per dwelling unit (outside of the Central Parking Area). The Church proposes a minimum lot area per dwelling unit of 587 square feet. • The maximum "height" of a building in the B-3 Zoning District is 50 feet (outside of the Central Parking Area) and four stories. The Church proposes a 65-foot, six-story apartment building. Height • Footnote (x): In the Central Parking Area, residential floors may exceed the stated "height" by up to 100 feet on issuance of a special permit by the Common Council; outside the Central Parking Area, on "lots" greater than 30,000 square feet in "area", residential floors may exceed the stated height by one (]) story or 15 feet on issuance of a special permit by the Common Council; outside the Central Parking Area, on "lots" greater than 30,000 square feet in "area" and for which at least 50% of the dwelling units are reserved as affordable for moderate income residents as defined by the City of White Plains Affordable Housing Program Rules and Procedures, residential floors may exceed the stated "height" by up to two (2) "stories" or 20 feet on issuance of a special permit by the Common Council.
