Date: May 8, 2018 To: All Involved Agencies From: White Plains Common Council Municipal Building 255 Main Street White Plains, New York 10601 Proposed Action: 52 North Broadway Development WP Development NB, LLC Zoning Ordinance amendment to create new “Planned Residential Development” District Lead Agency Coordination This notice is issued pursuant to Part 6NYCRR617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law (“SEQR”). The White Plains Common Council is considering a petition submitted on behalf of WP Development NB, LLC, for an amendment to the Zoning Ordinance to create new “Planned Residential Development” District affecting the former Good Counsel property at 52 North Broadway (herein after referred to as the “Proposed Action”) On May 7, 2018, the White Plains Common Council, as Lead Agency under SEQR, accepted the Draft Environmental Impact Statement (DEIS) dated April 2018, as adequate for the purpose of commencing public review and comment regarding issues addressed in the adopted Scoping Outline for the Proposed Action described below. A public hearing regarding the DEIS will be held during the regularly scheduled meeting of the Common Council on June 4, 2018, starting at 7:30 P.M., in the Common Council Chambers, White Plains City Hall, 255 Main Street, White Plains, New York for the purpose of receiving public comments on the DEIS. -1- Written comments regarding the DEIS will be accepted by the Common Council until the close of business on June 14, 2018, or 10 days following the close of the public hearing if adjourned to a later date. Written comments should be addressed to the following Contact Person: White Plains City Clerk 255 Main Street, White Plains, NY 10601 Phone: (914) 422-1228 FAX: (914) 422-1330 E-mail: [email protected] The DEIS provides a description of the Proposed Action and a discussion of existing conditions, potential impacts associated with the Proposed Action, measures designed to avoid or minimize identified impacts and project alternatives, as appropriate. The DEIS has been posted on the City of White Plains website (www.cityofwhiteplains.com /52NorthBroadway), and is also available for review at the White Plains Public Library, 100 Martine Avenue, White Plains, NY 10601 (Telephone Number 914-422-1480) during normal Library hours. Copies of the DEIS are available on a computer disk for purchase from the White Plains City Clerk upon receipt of a written request. Project Location: The 16.09 acre site is located at 52 North Broadway, White Plains, NY 10603, Westchester County, between Lake Street and Crane Avenue and with additional street frontage on Ross Street and Stewart Place. The subject property is designated as Section 125.52, Block 2 Lot 5.1 on the Official Map of the City of White Plains (“Project Site,”). The Project Site, which was previously owned by The Sisters of Divine Compassion, includes the convent and chapel buildings, and the former Academy of Our Lady of Good Counsel. The site also contains the Good Counsel Complex and the Mapleton House, which are listed on the State & National Register of Historic Places and designated as a White Plains Local Landmark. SEQR Status: The Proposed Action achieves thresholds for a Type I Action under SEQR regulations since it involves the construction of 250 or more new residential units and over 100,000 square feet of nonresidential floor area in a city of less than 150,000 population. Description of Proposed Action: Under the existing RM-1.5 Residential Multi-Family Zoning District the Project Site could be developed with approximately 467 residential dwelling units and also with an additional 736,000 square feet floor area (Floor Area Ratio of 0.8) for other various permitted uses such as, but not limited to, public and privates schools, colleges, nursing homes, dormitories, etc. The existing building height limit is 3-stories. Petitioner proposes to rezone the Project Site from the existing RM-1.5 District to create a new “Planned Residential Development District” (“PRDD”) intended to facilitate a mixed-use redevelopment including 400-units of market rate housing in two 10-story buildings, a 90-95 unit Assisted Living and Memory Care Facility, an academic housing building for approximately 120 individuals in 70 suites and approximately 657 parking spaces located within a parking structure and other at-grade parking lots (herein after referred to as the “Conceptual Development Plan”). The proposed amendment to the Zoning Ordinance to create new “Planned Residential Development” district includes the following components: 1. A maximum density of multi-family housing not to exceed one dwelling unit for every 1,500 sq. ft. of land area or 467 dwelling units. -2- 2. Graduate/professional academic housing not to exceed a maximum Floor Area Ratio of 0.15 or 105,132 sq. ft. of floor area. 3. Any combination of assisted living and memory care uses not to exceed a maximum Floor Area Ratio of 0.15 or 105,132 sq. ft. of floor area. 4. Nonresidential uses not to exceed a maximum Floor Area Ratio of 0.10 or 77,088 sq. ft. of floor area. 5. The total nonresidential uses, including all ancillary and accessory uses, shall not to exceed a maximum FAR of 0.4 or approximately 280,352 square feet of floor area. 6. In an effort to preserve the North Broadway corridor vista, reduce building coverage, and maximize open space on site, the amendment would increase the maximum permitted building height from 35 feet to 140 feet provided such structures are set back at least 800 feet from a State or County Roadway (North Broadway). Requested Approvals: The following review or approval actions by governmental agencies (“Involved Agencies”) have been identified in regard to the proposed zoning amendment and related Conceptual Development Plan: • Approval of an amendment to the Zoning Ordinance to create a new “Planned Residential Development” District affecting real property known as 52 North Broadway by the White Plains Common Council. • Approval of any Special Use Permits by the White Plains Common Council. • Approval of a Site Plan under Section 7 of the Zoning Ordinance by the White Plains Common Council. • Approval of a Stormwater Pollution Prevention Plan (SWPPP) by the White Plains Department of Public Works. • Approval of a SPDES General Permit for Stormwater Discharges from Construction Activity by the New York State Department of Environmental Conservation (NYSDEC). • Approval of connections to City of White Plains sanitary sewer and water lines by the White Plains Department of Public Works. • Approval by the Westchester County Department of Public Works and Transportation under Section 239F of General Municipal Law regarding roadway modifications, if any, to North Broadway, County Road 87 • Approval of water supply and sanitary sewer utility upgrades and modifications by the Westchester County Department of Health. • Approval by NYSDEC regarding an Order on Consent with the Department resulting from the previous unauthorized disposal of construction and demolition debris on a portion of the site. • Approval to Operate an Adult Care Facility (NYS Department of Health (NYSDOH)) • Westchester County Planning Board review pursuant to Section 239 L, M and N of the General Municipal Law and Section 277.61 of the County Administrative Code. • Review pursuant to Section 14.09 of the New York State Park Recreation and Historic Preservation Law regarding the Good Counsel Complex (15PR07570) and the Mapleton House, both listed on the State/National Register of Historic Places, by the New York State Division for Historic Preservation. -3- • Review and determination by the White Plains Historic Preservation Commission regarding a Certificate of Appropriateness for alteration, demolition, or new construction affecting a Local Landmark pursuant to Section 9-6 of the White Plains Municipal Code. • Other approvals related to the Conceptual Development Plan, including but not limited to amendments to the Traffic Ordinance; capital projects, building permits and related permits such as water and sewer connections, signage approvals, etc. A copy of this Notice has been sent to the following parties SEQR Agency Approval Action Status City of White Plains Zoning Amendment Mayor Thomas M.
