Council President Martin asked unanimous consent offer the consent agenda of Items 30 - 48 and 56 - 82, asking unanimous consent to move adoption of the ordinances, moved adoption of the ordinances, moved adoption of the resolu- tions, moved to file and spread all communications, refer any that are necessary to appropriate City Departments, Boards and Commissions, approve any appointments, and file any attachments. Unanimous consent granted. Council President Martin moved the consent agenda. Councilwoman Hunt-Robinson seconded the motion. 864 COMMONCOUNCILMINUTES May7,2018 Adopted by the following role call vote: Mr. Brasch, Mrs. Hunt-Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, and the Mayor - 7 - 0. The Mayor introduced Hon. George Lattimer, County Executive, who introduced Executive Order No. 2 of 2018, whereby the County introduced a Good Neighbor Policy, enabling Westchester municipalities and their residents to have input into the decision making process regarding the use of County land that might be located within their borders. The Mayor announced an adjourned public hearing in relation to the proposed amendment to the Zoning Ordinance of the City of White Plains creating a new TD-1 Transit Zoning District and re-zoning a certain property in the B-2 Neighborhood Business Zoning District to TD-1 Transit Zoning District. Mr. Martin moved that the hearing be opened. Mr. Brasch seconded the motion. Carried. The Mayor declared the hearing opened and asked if anyone wished to be heard. Mr. Martin moved that the hearing be adjourned to June 4, 2018. Mr. Brasch seconded the motion. Carried. The Mayor announced a public hearing to consider the Tax Budget of the City of White Plains for Fiscal Year 2018-2019. Mr. Brasch moved that the hearing be opened. Mrs. Hunt-Robinson seconded the motion. Carried. The Mayor declared the hearing opened and asked if anyone wished to be heard. The Mayor granted the privilege of the floor to Richard Payne, member of the Budget and Management Advisory Committee, and Paula Piekos, resident. Mr. Brasch moved that the hearing be closed. Mrs. Hunt-Robinson seconded the motion. Carried. May 7, 2018 COMMON COUNCIL MINUTES 865 The Mayor announced a public hearing in relation to a proposed amendment to the Zoning Ordinance to re-zone certain properties on: A) Cobb Avenue from the R1-12.5 Single Family Zoning District to the R1-5 Single Family Zoning District; and B) Saxon Wood Park Drive from the R1-12.5 Single Family Zoning District to the R1-7.5 Single Family Zoning District. Mrs. Hunt-Robinson moved that the hearing be opened. Mr. Kirkpatrick seconded the motion. Carried. The Mayor declared the hearing opened and asked if anyone wished to be heard. The Mayor granted the privilege of the floor to Chris Gomez, Commis- sioner of Planning. Mrs. Hunt-Robinson moved that the hearing be closed. Mr. Kirkpatrick seconded the motion. Carried. Communications received from Commissioner of Building, Design Review Board, Commissioner of Public Safety, Commissioner of Public Works, Deputy Commissioner, Traffic Division, Transportation Commission, Commissioner of Parking , Conservation Board, Westchester County Planning Board and Environmental Officer. Mrs. Hunt-Robinson moved that it/they be filed and spread in full upon the minutes. Mr. Kirkpatrick seconded the motion. Carried. TO THE HONORABLE THOMAS M. ROACH, MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Per referral by the Common Council on April 3, 2018, the Department of Building has reviewed a proposed amendment to the Zoning Ordinance with respect to re-zoning certain properties on Cobb Avenue and Saxon Wood Park Drive. Commissioner of Building 866 COMMONCOUNCILMINUTES May7,2018 Dated: April 23, 2018 April 13, 2018 TO THE HONORABLE MAYOR AND COMMON COUNCIL OF THE CITY OF WHITE PLAINS Dear Mayor and Council Members: The Design Review Board, at its meeting on April 9, 2018, reviewed a communication from the Planning Department and a proposed amendment to the Zoning Ordinance with respect to re-zoning certain properties on: A) Cobb Avenue from the R1-12.5 Single Family Zoning District to the R1-5 single family zoning district; and B) Saxon Wood Park Dr from the R1-12.5 Family Zoning district to the R1-7.5 single family zoning district, White Plains, NY. Chong Commissioner of Public Safety DEC:bn Dated: April 11, 2018 May 7, 2018 COMMON COUNCIL MINUTES 867 TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Pursuant to the request by the White Plains Planning Department, dated 3/1/18, the Department of Public Works (DPW) has reviewed the proposed amendment to the White Plains Zoning Ordinance to rezone certain properties to more accurately reflect the existing conditions of the affected lots, in which the municipal utility infrastructure was constructed to accommodate the current R1-12.5: A) Cobb Avenue - from the R1-12.5 single family zoning district to the R1-5 single family zoning district; B) Saxon Wood Park Drive - from the R1-12.5 single family zoning district to the R1-7.5 single family zoning district. Development pertaining to these zoning amendments may place increased demand on the City's existing infrastructure, possibly requiring upgrading at the developer's expense. Soyk, PE, PTOE Deputy Commissioner City Transportation Engineer Dated: April 25, 2018 868 COMMONCOUNCILMINUTES May7,2018 TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS The Transportation Commission, at its meeting held on April 18, 2018, reviewed the request for an amendment to the Zoning Ordinance of the City of White Plains regarding a proposed ordinance amendment with respect to re-zoning certain properties on A) Cobb Avenue from the R1-12.5 Single Family Zoning District to the R1-5 Single Family Zoning District: and B) Saxon Wood Park Drive from the R1-12.5 Single Family Zoning District to the R1-7.5 Single Family Zoning District, as referred by the Common Council on April 2, 2018. The Department of Parking has no objection to the approval of this proposed amendment to the Zoning Ordinance and re-zoning of these properties. Larson, Commissioner CWP - Department of Parking Dated: April 25, 2018 May 7, 2018 COMMON COUNCIL MINUTES 869 Date: April 11, 2018 To: White Plains Common Council Subject: Zoning Ordinance Amendment - R1-7.5 Single Family Zoning District at Saxon Wood Park Drive The Conservation Board has reviewed the proposed Zoning Ordinance amendment to re-zone certain properties on Saxon Wood Park Drive from the R1-12.5 to the R1-7.5 Single Family Zoning District. This matter was referred to the Conservation Board because certain affected lots along the Saxon Wood Park Drive represent environmentally sensitive sites that contain steep slopes or are in close proximity to a neighborhood stream. Observations: The Conservation Board offers the follow observations: • The proposed zoning amendment does not involve any specific project or physical development. • The all of the 26 subject properties along Saxon Wood Park Drive are currently developed and occupied by single family homes. • The affected properties do not conform to the dimensional regulations of the existing R1-12.5 District.
