Communications JANUARY 26-28 January 2017- Judges Livia Doina Stanciu and Simona-Maya Teodoroiu, accompanied by Ms Mona-Manuela Răus, counsellor, represented the Constitutional Court of Romania at the opening ceremony of the judicial year 2017 at the European Court of Human Rights, and at the seminar organised on that occasion (‘Non-refoulement as a principle of international law and the role of the judiciary in its implementation’), held in Strasbourg, France. The seminar included two parallel workshops (Workshop no.1 - Assessment of the credibility of asylum-seekers: burden of proof and the limits of the ECHR’s examination, Workshop no. 2 –Reception of migrants: material and procedural guarantees for settled migrants). The delegation of the Constitutional Court of Romania has participated in Workshop no. 1. That workshop included, inter alia, a presentation of the Superior Courts Network, a project started in 2015 for strengthening the dialogue and cooperation between the European Court of Human Rights and the constitutional and supreme courts of the Member States field; abuse of office – criminal offense assimilated to corruption criminal offences; the interpretation of the notions of act, which is not referred to by the criminal law, and of punishment, within other limits than those set by law, in the extraordinary remedy of the appeal in cassation; the constitutionality of the criminal and criminal procedural norms; from the foreseeability of the criminal law to the foreseeability of the judicial practice). FEBRUARY 2-3 February 2017 - Mr Mircea Ștefan MINEA, Judge, and Mr Fabian NICULAE, Assistant-Magistrate, attended the Meeting of the Bureau of the Association of Constitutional Courts using the French Language (A.C.C.P.U.F.), organised by the Constitutional Council of the Kingdom of Morocco, in Rabat. -

Short history: Referendums and plebiscites held in Romania: 10 to 14 May 1864 - Approval of Developer Statute of the Paris Convention, proposed by Alexandru Ioan Cuza. - Basically, the bicameral parliamentary system was introduced in Romania through this plebiscite. 2 to 8 April 1866 - Approval of Carol I as Prince of the United Principalities February 24, 1938 - Approval of the Romanian Constitution adopted at the initiative of King Carol II 2 to 5 March 1941 - Approval of General Ion Antonescu policy 9 to 16 November 1941 - The second plebiscite for the approval of Marshal Ion Antonescu policy November 23, 1986 - Approval of a 5% reduction of armaments, troops and military spending 1989 - Prohibition of foreign debt, proposed by Ceausescu December 8, 1991 - Approval of the Romanian Constitution (constitutional referendum in Romania, 1991) - Votes expressed 10,948,468 (67%?) Of voters: YES 77.3% (NSF, PUNR) NO 20.4% (UDMR PNTCD PNL) canceled 2.3% 18 to 19 November 2003 - Approval of revision of the Romanian Constitution (constitutional referendum in Romania, 2003) - The constitutional referendum was held on 18-19 October 2003. The estimates were probably needed two days to collect 50% + 1 voters. Voters: 17,842,103 Voted: 9,938,441 (55.7%) YES: 8,915,022 (89.70%) NO: 875,172 (8.81%) null votes: 148,247 (1.49%) May 19, 2007 - President Traian Basescu's impeachment referendum, 2007 On March 21, announced that Dan Voiculescu report by the President Basescu stated that "violated the Constitution and is involved in criminal acts". -

The Story of the Infamous Psd Leadership Meetings Transcripts: a Case Study in (Failing) Rule of Law in Romania
POLSCI DOCUMENTS THE STORY OF THE INFAMOUS PSD LEADERSHIP MEETINGS TRANSCRIPTS: A CASE STUDY IN (FAILING) RULE OF LAW IN ROMANIA The EU Commission has repeatedly signaled that during the Social Democratic Party (PSD) mandate of 2001-2004 Romania was falling short of meeting the Copenhagen criteria for EU admission. In particular, the government was blamed for being slow on the depoliticization of judiciary, ineffective in tackling corruption at the top, and not very keen on media independence. Bucharest has always been prompt in denying such accusations as groundless. Until November 2004, that is. One week before the first round of the national elections, hundreds of pages of transcripts from the PSD leadership's meetings in the past two years leaked to the public. A couple of newspapers still independent ran full pages with excerpts; one of them edited a book in three volumes with all the documents1; while the EU Delegation sent to Brussels an English language synthesis of the most interesting parts. The discussions held in these party meetings - some including statements with criminal implications for those who made them - came as a confirmation of the public's most pessimistic expectations. By and large, the PSD leaders were scheming how to manipulate judicial investigations and influence the decisions of courts; how to block the activity of the nominally independent agencies, such as the Court of Accounts, in order to cover the actions of ministers who misused public funds; and how to control more effectively the media, both public and private. What is more, some fragments were only confirming statements made before by other top officials, such as the president of the Court of Accounts, who in his draft annual report for 2003 was mentioning the pressure put on him by "high political circles". -

2 Women and Constitution-Making in * Post-Communist Romania a˘ ş 2.1 Introduction The role of women in constitution-making in Central and Eastern Europe (CEE) is an under-researched topic, as is the topic of women’s role in the transition of the region to democracy.1 Literature regarding women’s role in organisations involved in the collapse of communism such as the Solidarity Movement in Poland, or on women dissidents in Romania, does exist.2 However, very little attention, if any, has been * We want to thank to the editors of this book for all their useful comments and their patience.
