Freiheit 36 wieder aufleben Hamburg, November 2018 – Colin Hay, Sänger, Gitarrist und führender Songschreiber der Grammy Preisträger und Multi-Platin-Formation Men At Work freut sich auf eine Tour durch sieben verschiedene Länder und dreizehn Städte kreuz und quer durch Europa im Sommer 2019. Neben seinem Anteil am Men At Work Erfolg, hat Hay 13 Soloalben veröffentlicht und war erst kürzlich Teil von Ringo Starr’s All Starr Band. „Es war auf der Tour mit Ringo, als ich diesen unersättlichen Appetit des Publikums nach älteren Liedern spürte“, sagt Colin Hay. „Ich fand die Idee spannend, auch mit meiner eigenen Band auf Tour zu gehen“. Am 24.06.19 ist in der Gr. Freiheit 36 in Hamburg endlich wieder live zu erleben, was das heißt! Colin war 1979 eines der Gründungsmitglieder von Men At Work, die 1981 zu erstaunlichem Erfolg mit ihrem Debut Album „Business as Usual“ fanden. Das Nachfolge Album „Cargo“ enthielt die beliebten Singles „Overkill“ und „It’s a Mistake“. Gleichwohl war die Original Besetzung recht kurzlebig und es verblieben lediglich Colin Hay und Greg Ham (Saxophon, Flöte und Keyboards) als Kern-Band. Man tourte ausgiebig als Men At Work über die 90er und 2000er Jahre. Leider starb Greg Ham 2012 aber sein prägender Sound und sein charakteristischer Einfluss auf Men At Work überdauern ihn. Genau wie die Musik, die aus dem Rundfunk nicht mehr wegzudenken ist und es wirklich verdient einer neuen Generation auch live nahegebracht zu werden, was uns in die Gegenwart führt. Men At Work starten live in England und lassen die Tour nach drei Wochen im Juni/Juli 2019 in Mailand, Italien ausklingen. Der Schwerpunkt ihrer Tour wird sie für sieben Shows nach Deutschland bringen und dabei u.a. in Berlin im Huxley’s, in Leipzig in der Open Air Parkbühne, in Hannovers Capitol machen. Dazu kommen Shows in Hamburg, Köln, Stuttgart und München. Men At Work mit Colin Hay und seine fantastische Tour Band aus Session Musikern aus Los Angeles freuen sich auf viele Spielstätten mit großer Historie in Deutschland und Europa. In this case, a copyright action was brought by Larrikin Records against Men at Work, alleging copyright infringement by Down Under of the Kookaburra song composed by Marion Sinclair. The dispute raised a host of doctrinal matters. There was disquiet over the length of the copyright term. There were fierce contests as to the copyright ownership of the Kookaburra song. The litigation raised questions about copyright infringement and substantiality — particularly in relation to musical works. The case highlighted frailties in Australia’s regime of copyright exceptions. The litigation should spur the Australian Law Reform Commission to make recommendations for law reform in its inquiry, Copyright and the Digital Economy. This paper provides a critical evaluation of the options of a defence for transformative use; a defence for fair use; and statutory licensing. The paper also examines the question of appropriate remedies in respect of copyright infringement. The conclusion considers the implications of the Kookaburra case for other forms of musical works — including digital sampling, mash-ups, and creative remixes. It finishes with an elegy for Greg Ham — paying tribute to the multi- instrumentalist for Men at Work. He followed the ‘Down Under’ case and has always believed that the story behind it is a great tragedy. Born in 1958, he played in rock bands during the 1980s and later taught English in Sydney. He now lives in central western New South Wales, where he is building a house in the bush. On the news at nine, a grim-faced reporter stood outside a home in Melbourne. Someone’s dead: a musician. Not famous … well, not since the eighties. He was in that band that had that song, you know? Of course you do. The one with the flute and the reggae beat, about the overseas travel experiences of a naive Aussie. A Kombi van, Vegemite … and chunder? It’s a strange song. And not one you’d expect to become an alternative national anthem. ‘Down Under’ was born in a marijuana-laced jam session and first performed in the back room of a dingy Richmond tavern, before being consigned to the musical wastebasket. It was then given a second chance, and went on to conquer the biggest music charts in the world. But there’s another thread to the story, and it has no happy ending. In 2009, ‘Down Under’ was busted for copyright infringement, its writers and publishers taken to court.
