ORDER (Date of Hearing: 30.07.2009) (Date of Order: 31.07.2009)

1. The Petitioner, Delhi Transco Ltd. filed a petition for approval of incentive based on availability of transmission system of DTL for the year 2007-08. The Petitioner through this petition prayed that the Commission may be pleased to approve the incentive based on the availability of transmission system of DTL for the year 2007-08.

2. The Commission heard the petitioner and the respondents and vide its Order dated 29.8.2008 directed all the parties concerned to hold a meeting and examine the issues in view of each others’ claims and counter claims and thereafter the SLDC was directed to submit a report.

3. Consequent to the directions of the Commission, SLDC organised a meeting of the DTL, Discoms, PPCL, IPGCL and Badarpur Thermal Power Station on 16.9.2008. The minutes of the meeting dated 16.9.2008 were placed before the Commission. The Commission heard the petition on 28.11.2008 and by its Order dated 22.12.2008 directed the DTL to submit the final computation of availability of transmission system and the incentive as per the DERC (Terms and Conditions for

2 Determination of Transmission Tariff) Regulations, 2007. The reports/documents shall be submitted within a period of four weeks from the date of issue of this order.

4. In compliance of the order above mentioned DTL placed on record final computation of availability of transmission system and the incentive as per the DERC (Terms and Conditions for Determination of Transmission Tariff) Regulations, 2007.

5. The Commission heard the petitioner and all the respondents on 30.7.2009 and perused the revised calculations for incentive based on availability of transmission system. On the query of the Commission, it is confirmed by the petitioner and the respondents that they agreed and accept the 99.48% availability of transmission system as claimed by the DTL.

6. In the light of above discussion the Commission directed as under: i) The availability of DTL Transmission System is accepted as 99.48% for the FY 2007-08. ii) Based on the above availability, DTL may raise incentive bills in accordance with the provisions of the MYT Regulations.
