The number of chain stores in New York City declined by 0.3 percent over the past year, marking the first year-over-year drop in national retail locations since the Center for an Urban Future began our annual analysis of the city’s chain retailers more than a decade ago. Our eleventh annual analysis of national retailer locations in New York also finds that a record 124 retailers—37 percent of the 331 national retail companies in our study—reduced their footprint over the past year. This compares to 99 retailers that registered a net gain in stores over the past year, and 108 retailers whose footprints remained unchanged. In fact, the number of retailers reducing stores is up by 91 percent; last year, just 65 of the retailers in our report registered a net decline in stores. Overall, our analysis shows that the 331 retailers listed in last year’s ranking reduced their total footprint in New York City by 27 store locations, declining from a total of 7,876 stores in 2017 to 7,849 stores in 2018—an 0.3 percent decrease. The slowdown is led by Manhattan, where the number of chain store locations shrank by 2.3 percent—the sharpest single year decline to date.

MANN, UNITED STATES MAGISTRATE JUDGE: The central question before this Court is whether a former franchisee of a Caribbean- style fast-food chain should be preliminarily enjoined from operating a Caribbean-style fast- food restaurant within the same vicinity of the former franchise and other like franchise locations. Plaintiffs Golden Krust Patties, Inc. and Golden Krust Franchising, Inc., d/b/a Golden Krust Caribbean Bakery & Grill (collectively, “Golden Krust” or “plaintiffs”), brought this lawsuit against Marilyn Bullock (“Bullock”) and Marilyn’s Patties, Inc., d/b/a Golden Krust Bakery (“Marilyn’s Patties”) (collectively, “defendants”). Defendants, until recently, operated a Golden Krust franchise in Elmont, New York (the “Franchise”). Plaintiffs allege that defendants, while operating the Franchise, sold competing food products under the Golden Krust name, in violation of the parties’ franchise agreement and federal trademark laws. Case No. 8:20-mc-104-T-33SPF KEITH CLAYBORNE, et al., Respondents. / ORDER This cause comes before the Court upon Petitioner’s Motion to Compel Subpoena Compliance and for Contempt and Sanctions Against Donnetta Heredia (“Motion to Compel” or “Motion”) (Doc. 1). In its Motion to Compel, Petitioner asks the Court to compel a non-party, Ms. Heredia, to produce certain documents requested in a Subpoena to Produce Documents, Information, or Objects (the “Subpoena”) (Doc. 1-1). As indicated in the Motion’s Certificate of Service, notice of the Motion was served to Ms. Heredia via mail (see Doc. 1 at 6). Ms. Heredia, however, has failed to respond to the Motion to Compel, and the time for doing so has elapsed. See Local Rule 3.01(b), M.D. Fla. (party opposing motion must file response in opposition within 14 days after service). Therefore, the Motion to Compel is deemed unopposed. See Legends Collision Ctr., LLC v. State Farm Mut. Auto. Ins. Co., No. 6:14-cv-6006-ORL-31TBS, 2016 WL 3406409, at *1 (M.D. Fla. June 21, 2016) (stating that a party’s failure to respond to a motion indicates the motion is unopposed). For this reason and the reasons that follow, the Motion to Compel is granted in part and denied in part.
