ELECTION REPORT CASES CLOSED FEBRUARY 2009 NOTE: This monthly report lists the outcome of secret-ballot voting by employees in NLRB-conducted representation elections as officially certified following resolution of post-election objections and/or challenges. Inquiries regarding the contents of this report should be directed to the Division of Information, National Labor Relations Board, 1099 Fourteenth St., N.W., Washington, D.C. 20570. The NLRB continues to improve its techniques for tracking and collecting case activity data. While significant efforts are made to verify the accuracy of data, some inconsistencies can be found between some of the tables in the election reports and the data in the Annual Report. Data fields on “AFL-CIO” elections in the FY 2002-2009 annual reports and the election reports may inadvertently include elections involving various unions that have disaffiliated from the AFL–CIO. Explanatory Note Election Report data is derived from the National Labor Relations Board’s Case Activity Tracking System (CATS). The Agency has an active program to ensure a high level of accuracy in the collection and dissemination of case-related information. However, monthly election data describes dynamic case activity that is subject to revision and correction during the course of the year and all data should be interpreted with that understanding. Users who have questions about the accuracy of information relating to specific elections reflected in the report are advised to call the Regional Office where the election was conducted for clarification and to report errors.

Report - December 2018 State of the Chains, 2018 Our eleventh annual ranking of national retailers in New York City finds a year-over-year decrease in the number of chain store locations for the first time since this study began. The number of chain stores in New York City declined by 0.3 percent over the past year, marking the first year-over-year drop in national retail locations since the Center for an Urban Future began our annual analysis of the city’s chain retailers more than a decade ago. Our eleventh annual analysis of national retailer locations in New York also finds that a record 124 retailers—37 percent of the 331 national retail companies in our study—reduced their footprint over the past year. This compares to 99 retailers that registered a net gain in stores over the past year, and 108 retailers whose footprints remained unchanged. In fact, the number of retailers reducing stores is up by 91 percent; last year, just 65 of the retailers in our report registered a net decline in stores. Overall, our analysis shows that the 331 retailers listed in last year’s ranking reduced their total footprint in New York City by 27 store locations, declining from a total of 7,876 stores in 2017 to 7,849 stores in 2018—an 0.3 percent decrease. The slowdown is led by Manhattan, where the number of chain store locations shrank by 2.3 percent—the sharpest single year decline to date.

Opinion by Quinn, Administrative Trademark Judge: Gold Crust Baking Company (“Applicant”) filed applications to register the mark GOLD CRUST BAKING COMPANY (in standard characters) (“BAKING COMPANY” disclaimed),1 and the mark shown below 1 Application Serial No. 85678105, filed July 16, 2012 under Section 1(a) of the Trademark Act, 15 U.S.C. § 1051(a), alleging first use anywhere and first use in commerce on March 1, 2000. Application Serial Nos. 85678105 and 85691267 (“BAKING COMPANY, INC.” disclaimed).2 The identification of goods in each application reads “bakery goods, namely, bread and buns” in International Class 30. The Trademark Examining Attorney refused registration in each application under Section 2(d) of the Trademark Act, 15 U.S.C. § 1052(d), on the ground that each of Applicant’s marks, when used in connection with Applicant’s goods, so resembles the previously registered mark shown below (“CARIBBEAN BAKERY & GRILL” disclaimed) for “restaurant services featuring Caribbean style foods” in International Class 43,3 as to be likely to cause confusion. When the Trademark Examining Attorney issued a final refusal, Applicant appealed and requested reconsideration. The Examining Attorney denied the request for reconsideration, and the appeal resumed.
